  • Passing the Copyright Amendment Bill will resolve many issues

Passing the Copyright Amendment Bill will resolve many issues

MUMBAI: How does one react on the issue of copyright when a person appeals to a Court to remove a dialogue of the Salman Khan starrer ‘Veer’ because this person had uttered it some years earlier?

The filmmaker had to finally give in after which the dialogues were indeed deleted from the film on grounds that ‘the expression of the person while uttering the dialogue was copied.’

Said Anand And Anand Managing Director Rahul Ajatshatru, “Our lawyers and judges are not well versed with the Copyright Act while talking about the subject or passing an order on this topic. It is time the Copyright Amendment Bill is passed.”

Agreeing, Film Federation of India Secretary General Supran Sen said, “Some years ago the Mumbai High Court had said that if a particular video of a film is shown at home nothing happens, but if it is shown in society then copyright is infringed. This issue was challenged in the Madras High Court that said the Bombay High Court stand was wrong. Later it held that special courts should be set up to hear these matters.”

The matter led to a lot of debate after which it was decided to come out with a Copyright Amendment Bill. But though this has been through the Lok Sabha, it is yet to get the approval of the Rajya Sabha. “Hopefully this would be done after the Budget session of Parliament,” opined Amarchand Managing Partner Shardul Shroff.

The views were expressed during a discussion on the process of IP transfer and its legal ramifications in the specific case of film remakes during the FICCI Frames. RCL Motion Pictures head and producer Jagdish Rajpurohit, UTV Motion Pictures creative director Amar Butala, French Embassy, TV & Cinema head Deborah Benattar and International Federation of Film Producers Association former Director General Bertrand Mouiller also spoke.

Referring to RCL Motion Pictures obtaining the copyright of the French film ‘L’emmerduer’, Rajpurohit said:” “When we approached the French film producers, they were a little inquisitive, but decided to give us the remaking rights after some thought.”

But they will decide on associating with the Hindi remake ‘Bumboo’ after they come down to India and see whether the makers have followed the content verbatim or have deviated from the same. “I am sure they will be happy after watching the film and associate with our film,” observed Rajpurohit. The film releases in India on 31 July.

Butala said: “These days things have changed a lot and producers don’t want to go to Court on matters of copyright infringement. They sort the matter amicably.”

Paan Singh Tomar to release in the Gulf on Thursday

MUMBAI: UTV Motion Pictures is set to release Paan Singh Tomar in the Gulf.

Paan Singh Tomar is made on a budget of Rs 45 million. UTV claims the movie has already collected Rs 90 million from India.

Said UTV Motion Pictures senior Vice President, International Distribution and Syndication Amrita Pandey, “For high concept movies that are not traditionally released overseas due to lack of a big star cast or content that is different from the mainstream, our strategy is to allow for word of mouth from India to spread and for audience demand to build, so that it becomes impossible for distributors and exhibitors to ignore our content.

This helps us get better distribution and showcasing for these movies overseas, and we have followed the same strategy in the past for some of our other path breaking content like A Wednesday and Welcome to Sajjanpur. Demand for Paan Singh Tomar has now reached a peak and it is just the right time for us to do an extensive release in the Gulf.”

Film Distributors’ associations to appeal in SC against CCI ruling

MUMBAI: Seven distributor associations across India who were, in an order of the Competition Commission Of India (CCI), told to pay a penalty of 10 per cent of their annual income against following alleged unfair laws, have decided to file an appeal in the Supreme Court against the ruling.

It was last Saturday when the CCI gave its judgement asking these associations to co-operate with production houses like Reliance Entertainment, UTV Motion Pictures, Eros International and Shree Ashtavinayak Cinevision.

Besides, it has also ordered that associations can no longer compel anyone to become their member as a pre-condition for the exhibition of the film in territories under their control and can‘t discriminate between regional and non-regional movies with an undertaking that they won‘t restrict the number of screens for any film.

The associations are the Karnataka Film Chamber of Commerce (KFCC), Central Circuit Cine Association (CCCA), Bihar and Jharkhand Motion Pictures Association (BJMPA), and two others.

As a fall out of the order, other distributor associations that would be affected are Eastern India Motion Picture Association (EIMPA), Hyderabad State Film Chamber of Commerce, Northern India Motion Pictures Association, Indian Motion Pictures Distributors Association, Orissa Film Distributors Syndicate and The Chennai Kanchipuram Thiruvallur District Films Distributors Association.

The legal dispute started after Rakesh Roshan‘s Kites, distributed by Reliance, was not allowed to play in 50-60 screens due to a KFCC diktat. Later, other corporates like UTV and Eros, who were penalised by Rs 500,000 for not agreeing to the associations‘ timeline for satellite screening and home video release of their films like Kurbaan and Housefull, also joined in.

MUMBAI: UTV Motion Pictures has signed Vidya Balan for the quirky comic-thriller Ghanchakkar. The production major had earlier signed Emraan Hashmi and director Rajkumar Gupta.

UTV Motion Pictures CEO Siddharth Roy Kapur said, “It is a pleasure to announce Ghanchakkar, our third film in a row with Rajkumar Gupta. With Emraan and Vidya in the lead roles, we have managed to get our dream cast for roles that were virtually written with them in mind.
