  • Asci releases ‘sector report card 2021-22’: Ad violations by top six sectors

Asci releases ‘sector report card 2021-22’: Ad violations by top six sectors

Mumbai: The Advertising Standards Council of India (Asci) has recently released its annual complaints report for the financial year 21-22. The report provided information on the complaints examined and advertisements handled by the self-regulatory organisation. The report processed 4,184 advertisements across mediums including print, digital media and television.

The significance of the digital ecosystem was reflected in the fact that 48 per cent of the ads that Asci processed were published digitally, 29 per cent of the complaints that were filed concerned influencers, and the top six violative categories showed the emergence of sectors like gaming and cryptocurrency.

The report also delves into the specifics of the advertisements examined, the types of complaints, the results of the ads processed, and the involvement of influencers and celebrities in each sector. Education, with 23 per cent increase in comparison to last year, remains the single largest violative industry, followed by gaming (472 per cent increase) and personal care (261 per cent increase).

    Education

ASCI discovered 23 per cent more violations in this category during fiscal years 2020–21. The edtech category accounted for six per cent of the 1,728 ads checked. In total, 90 per cent of these advertisements were in print. 1.2 per cent were broadcast on television, 8.8 per cent were digital, and 0.1 per cent were distributed through other mediums.

Nine ads featuring celebrities were found to be misleading, and 12 more were added with influencer disclosure violations.

Only one per cent of the ads were rejected, while the other 99 per cent required modification. Under the procedural outcomes of cases requiring modification – 17 per cent had informal resolution, 83 per cent were upheld.

The report stated, “Most of the violative claims against the education industry were pertaining to leadership, awards and rankings, and job guarantee claims. Comparative superlative claims like highest success, lowest fees, etc, and performance outcome claims like best results, success assured were also common. In addition to these, there were a significant number of money back guarantee claims, usually clubbed with result-oriented or outcome-related claims.”

    Gaming

The gaming industry grew by 472 per cent in fiscal years 2021-22 compared to the previous year. Asci, in total, looked into 383 cases in this category. Where four per cent of the records were not valid, three per cent were dismissed, and 94 per cent required some modification. 11 per cent of ads were upheld while 89 per cent of them had an informal resolution: not contested.

In total, one per cent of these advertisements were in print. One per cent was broadcast on television, 99 per cent on digital, and none were distributed via other means.

Eight ads featuring celebrities were found to be misleading, and 22 added with influencer disclosure violations.

“Most violative claims in the gaming industry were pertaining to leadership, guaranteed winnings, prize money assurance and safety, security & privacy claims. Other claims like consumer trust – trusted by three billion users etc., and comparative claims like win better, Xtimes more winnings were also seen,” said the report.

    Personal Care

Surprisingly, Asci’s total number of ads checked increased by 261 per cent in the previous fiscal year, to 531. As per the report, four per cent of these were nullified, five per cent dismissed, and 91 per cent required modifications.

While 69 per cent had an informal resolution—not contested, 31 per cent were upheld. Four per cent of these ads appeared in print, six per cent on television, 88 per cent in digital, and two per cent in other mediums. Four ads featuring celebrities were found to be misleading, and 371 ads were found to be violating the influencer disclosure code.

In the report, Asci stated, “There were various claims made in the advertisements looked into under this category. Most of the violative claims were pertaining to product performance. Owing to the ongoing pandemic, we saw a number of protection and prevention claims, particularly those claiming protection from germs like viruses and bacteria. Besides these, there were comparative claims, ingredient performance-led claims, natural and organic product claims, leadership claims, consumer trust and recommendation by experts claims.”

    Healthcare

The previous year saw a surge in Covid cure/protection claims that settled as the pandemic progressed, resulting in a 20 per cent decrease in ads seen by Asci on a fiscal year basis, from 967 to 775 in FY’22.

The procedural outcomes of cases are: while 19 per cent had an informal resolution—not contested, 62 per cent were upheld, and 19 per cent were in DMR/Covid violations. Adding to that, 0.3 per cent of complaints were not valid, 1.7 per cent were dismissed, and 98 per cent required modification.

Five ads featuring celebrities were found to be misleading, and 15 more were found to be violating the influencer disclosure code.

The medium split of the platforms where these ads are published is: 75 per cent of these ads are in print, three per cent on television, 21 per cent in digital, and one per cent in other media.

According to the report, the majority of the most egregious claims in the healthcare industry concerned leadership, awards and rankings, and comparative claims, particularly in clinics and hospitals. Treatment assurance claims were also fairly common. For drugs and medicinal products, claims of cure, prevention, and protection were the most common. Health condition reversal and product performance claims were among the other violative claims noted. There has been a rise in the occurrence of natural ingredient or procedure-led treatment or cure claims.

    Food & Beverages

ASCI found a 31 per cent increase in violations in this category during fiscal years 2020–21. Asci, in total, looked into 373 cases. As mentioned in the report, 16 per cent of these advertisements were in print. Seven per cent were broadcast on television, 73 per cent were digital, and four per cent were distributed through other means.

The procedural outcomes of cases requiring modification recorded 53 per cent informal resolution: not contested and 47 per cent upheld. Adding to that, two per cent of complaints were not valid, 14 per cent were dismissed, and 84 per cent (two cases are currently sub-judice) required modification.

The number of ads featuring celebrities found to be misleading and violating the influencer disclosure code is two and 131, respectively.

The report said, “Almost every product sub-category under F&B had immunity boosting claims along with ingredient benefit and product performance claims. Comparative claims, leadership claims, and health and disease risk reduction claims were also common. Like many other categories, there was an increase in claims pertaining to protection from and prevention of various diseases caused by viruses and bacteria. Other claims included awards and rankings, natural source/organic foods, consumer trust, and quality claims.”

    Virtual Digital Assets (VDA)

The Asci report highlighted that advertising in this category had not been so prominent in the previous years. Therefore, the recorded number this year included only 394 ads in the process, of which four per cent were invalid, one per cent were rejected, and 95 per cent required modification.

Additionally, while 53 per cent were informal resolution: not contested, 47 per cent were upheld.

None of the ads featuring celebrities were found to be misleading this year. The number of violations in influencer disclosure stood at 385.

The medium split of the platforms where these ads are published is: one per cent of these ads are in print, one per cent on television and 98 per cent in digital media.

The report added, “Most of the advertisements looked into under this industry were influencer disclosure cases, where influencers were talking about how to navigate the VDA platforms or sharing information about the category and how the platform is easy to operate. From some of the ads that made misleading claims, leadership and consumer trust claims were most common. Guaranteed earnings and performance comparisons with other modes of investment like gold and stock investment are followed. The other commonly found claims revolved around promoting the category through referral programme claims like ‘refer a friend and win’.”

  • Rise in inflation likely to hurt advertising revenue growth of TV broadcasters, says market analyst

Rise in inflation likely to hurt advertising revenue growth of TV broadcasters, says market analyst

Mumbai: The rising inflation is playing a spoilsport for the television segment currently, impacting its revenue as advertisers are cutting down the marketing spends. The impact of soaring inflation is observed in one of the most significant categories of the TV industry-FMCG sector. The new age internet companies are also reducing their ad spend. Currently, the advertisers are feeling apprehensive due to the macro weakness and inflationary headwinds.

    Inflation heat to hurt profitability

As per financial analysts at Elara Securities, television was the first traditional medium to recover to pre-COVID levels in the financial year 2022. The company estimated the operating profitability of all broadcasters to be muted due to content investments and lower advertising revenue.

Earlier, experts stated that the advertising revenue for television broadcasters is recovering and will reach the pre-covid levels. They predicted that the TV ad revenue will grow 12 per cent in the next financial year. However, the rising inflation has created bottlenecks as companies curtailed their advertising campaigns and adopted a wait-and-watch approach. The FMCG companies also have reported a slowdown in consumer spending. Moreover, the rising input costs also have forced price hikes, which is impacting the overall consumer sentiments and behaviour.

According to data released by the National Statistical Office (NSO), retail inflation touched 7.04 per cent in May 2022. The Reserve Bank of India (RBI) has updated its inflation projection for the current fiscal (FY23) to 6.7 per cent.

According to EY-FICCI’s media & entertainment 2022 report, the television revenue is expected to reach Rs 826 billion by 2024 and will grow at a CARG of 4-5 per cent. In such a case, if the advertisers squeeze their ad spends, it will be difficult for the TV industry to recover and reach the target as estimated, the experts believe.

In 2021, television advertising revenue grew 25 per cent to reach Rs 313 billion, recovering from a 21.5 per cent drop in 2020. Due to Covid pandemic pressure, TV advertising revenue declined. Moreover, the ad revenue stood at Rs 320 billion in 2019 during the pre-Covid times.

    Industry’s observations despite challenges

Elara Securities also estimated that overall revenue of the major players like Zee, Sun TV and TV Today is slated to grow by 4.7 per cent, 23.2 per cent and 23 per cent year-on-year (YoY), respectively. Zee’s revenue growth is negatively impacted by lower operating income (“Dhaakad film”), while its net profit is expected to witness a growth of 26.4 per cent driven by the redemption of preferential shares (paid off in Q4 FY22).

Zee’s overall revenue was up by 14.1 per cent YoY in FY22 at Rs 8189.3 crore. Its profit after tax (PAT) was up by 32 per cent at Rs 955.7 crore. Sun TV’s standalone revenues were up by 12.46 per cent YoY in FY22 at Rs 3504.88 crore. TV Today’s overall revenue was up by 18.76 per cent in FY22 at Rs 973.99 crore.

The company also estimates that advertising revenue for Zee, Sun TV and TV Today will grow 12.7 per cent, 36 per cent and 28 per cent YoY, respectively, on a low base, as they remain between two per cent to ten per cent lower than pre-Covid levels. Subscription revenues for Zee and Sun TV are expected to remain flat YoY.

Zee’s advertising revenue in FY22 stood at Rs 4396.5 crore up by 18 per cent YoY. Its subscription revenue stood at Rs 3246.6 crore. Sun TV’s advertising revenues in FY22 stood at Rs 1300.60 crore up by 30.84 per cent and subscription revenues stood at Rs 1657.13 crore. TV Today’s revenue from television and other media operations stood at Rs 912.03 crore, up by 17.8 per cent in FY22.

  • Zee Cinema brings world television premiere of ‘The Kashmir Files’ & ‘Attack’

Zee Cinema brings world television premiere of ‘The Kashmir Files’ & ‘Attack’

Mumbai: Zee Cinema is all set to present the world television premiere of “The Kashmir Files”, and “Attack” on 25 and 26 June at 8 pm, respectively.

The stirring masterpiece, “The Kashmir Files”, struck a strong connection with audiences and critics alike. The colossal conversation rounds and overwhelming response from the global viewers at the box office is what holds testament to what sincere storytelling with riveting execution is capable of. Donning the role of Pushkar Nath Pandit, Anupam Kher has given one of the most defining performances of his career. Speaking of defining performances, we see gripping performances from Pallavi Joshi, Mithun Chakraborty and Darshan Kumar in significant roles that left the audience in absolute awe. A directorial marvel by the award-winning filmmaker Vivek Agnihotri, “The Kashmir Files”, uncoil the saga of Kashmir’s history in the voice of the Kashmiris. Recounting the tragic event of exodus of Kashmiri Pandits in 1990 in its honest form, left the world spellbound. With the sizable reach of Zee Cinema, the most awaited film by the viewers, “The Kashmir Files”, will be available to the entire nation.

Sharing his experience, Anupam Kher said, “Being someone who has Kashmiri roots, this film was also instrumental in bringing back a lot – memories of cherries coming into my house through a window back in Baramulla, the pleasantness of Kheer Bhawani, Nishad Garden, and Dal Lake that I keep thinking of even after having travelled the world. The “Kashmir Files” is an impeccable example of how a mid-budget film with an impactive story can reach such great heights. For the audience, watching it was an emotional experience. It was instrumental in bringing out a story that deserved to be told, striking a special and lasting connection with the viewers, and to any actor that means more success than anything.”

Director Vivek Agnihotri said, “This film is about humanity, it’s about oneness, and with the response received, I believe the audience of the country, as well as outside, have resonated with it. The emotions that this movie has evoked in people, have left a lasting impression on their mind. I am a person with integrity. I want to work with talented people. My aim is to do creative work and showcase Indian films as a soft power to the world. “The Kashmir Files” has helped reinforce my belief in the strength of honest storytelling.”

“Vivek and I spent four years on the film, and three years on the research. We went down to victims’ houses, interviewed them, sat with them, and ate with them. Apart from my experience of being a producer for the film, my role was also really different from what I’ve done in the past, so this came as a welcome change for me. This is a story that needed to be told in all dimensions, with great fidelity, and a super-strong portrayal of every character,” shared Pallavi Joshi.

The advent of technology has taken Warcraft to a new height. While our weapons and strategies were upgraded with technology, “Attack” took this invention to another level and introduced India’s first ever AI driven Super-soldier. The film showcases how tech induced warfare helps to reduce any kind of human collateral damage. With scintillating performances by John Abraham along with Rakul Preet Singh and Jacqueline Fernandez, get set to be immersed in a wondrous experience of high-octane action, thrill, lined with an impactful story of patriotism. “Attack”, one of India’s first sci-fi action thrillers portraying an unattempted concept of a super-soldier on a quest to destroy some of the most villainous terrorists, won over the audience with its adrenaline-fueled cinematic experience. So, get ready for an ultimate experience jab Ek super-soldier karega aatank pe attack!

Talking about the film, John Abraham said, “’Attack’ is not a futuristic film, but it’s a very relevant film. I believe that we might anticipate such technology a few years down the line. The idea with “Attack” was to challenge, so we are challenging the audience’s mind and trying to do something different. If Hollywood can make it, why can’t India? It is my humble attempt to make India proud. We’ve all heard that films are made for masses or classes, but I don’t think so. I only think there are two kinds of films: good films and bad films. And this is a good film that I believe families and people of all ages will enjoy. This isn’t a regular action film, but it is meant to put an important message across – nothing can come in the way for a true patriot, as he will fight for his country selflessly, and in all passion with a staunch belief that his nation comes ahead of everything.”

Rakul Preet Singh added, “’Attack’ is a film I am proud of and will always be. Ironically, as a kid, I wanted to be a scientist and with this film, I got to chase that dream. We’ve seen Captain America and Iron Man on international levels creating a space in global audiences’ minds. “Attack” is a great experiment from India. It’s an under-explored genre. More than an actor, after looking at the film as a viewer, what personally spoke to me deeply was how John’s character fought against terrorism selflessly, and relentlessly portraying the essence of a true patriot despite all limitations. Today, we’re a part of a great space. I feel all kinds of cinema and experiments are being celebrated and it is this sentiment that will shape the industry from now on.”

“Attack” moves along the quest of a super-soldier who has lost everything and puts his life on the line to serve his nation, willing to make the ultimate sacrifice.

  • Anant Rangaswami: A friend for life

Anant Rangaswami: A friend for life

Mumbai: It’s indeed a sad day when a dear friend passes. Friends aren’t easily made and acquaintances take years to qualify as friends. They are hugely cherished commodities. I, for one, cannot make friends easily. It takes me a long while to get close to someone. To let my guard down enough to let them into my space. They’re not easy to come by.

So, when one loses a friend, it’s like losing something really special. Words can never do justice to that kind of close connection or convey one’s feelings of grief sufficiently well but I must attempt to do so anyway. Anant entered my life many moons ago and I’m delighted that he did so. We started as colleagues at Star and unwittingly evolved into friends, for life. That day was so far back, almost three decades ago, that I can barely remember but I do recall that we had some fun times along the way. Anant was a great storyteller and was able to get people on his side as a result without offending anyone. He was innovative to the core and occasionally, ( read frequently ) broke boundaries in his quest for securing his relationships. He once turned up at my office with a great big cardboard box ( the size of a box that could carry a washing machine or a dishwasher ) full of airline tickets which he collected from a client of his instead of an outstanding payment for an on-air sponsorship of a cricket event worth a lot of money, even in those halcyon days. This was after Anant was being put under pressure to get his ‘collections’ under control. As an aside, the airline in question went bust shortly after and all we had to show for it was a boxful of airline tickets, which had neither value to man nor beast. I remember telling him that he should have at least got us an aircraft in lieu. His response was classic Anant- ‘well I could stick them with a few more sponsorships in that case,’ he said!

I never once saw him lose his cool even after he was made to knock back spurious quantities of what we called ‘liquid refreshment’. I remember one evening when a group of us were out celebrating a milestone achievement (in those days we would celebrate everything as everything was a milestone ) and young Anant, like the rest of us, had a few too many and we were all getting ‘tired and emotional’. The club we were at was closing, in the early hours, well after closing time of course. Anant was sitting by himself (or he could have been sleeping ) by the exit door. Someone put him in the back of our car and drove him to the hotel he was staying at but as he couldn’t get out himself, he was carried into the hotel. The hotel manager came running out and refused to accept Anant in that state. Anant was made to sit out the night at the reception but bless him – he made it to his red-eye flight the next morning to Chennai and he was back at his office at the start of the day. That’s what made Anant special. He was dedicated to his work and was a great team player. He worked hard and played harder.

He was a charmer during work hours and also after work. He was one of those chaps that could talk the hind legs of a donkey if he was convinced about something whilst also being able to be as stubborn as a mule if he didn’t want to do something. Even though there were times when I came close, I never pulled rank on him except, when at times, he simply never claimed his out of pocket expenses – something I could never understand. I would tell him that either he was being paid so much money that he was happy to fund his employer or that he was simply too lazy to attend to his finances. I’m afraid it was always the latter.

Many years later, Anant convinced me to write a book and had it not been for him I would never have done so. We argued incessantly about several aspects of it and to be fair I changed so much of what I had originally written thanks to his point of view. He persevered diligently and would remind and nudge me to get it done until I did. Over the years I thought of Anant as a confidant, a family member and a true friend. He was indeed a great ally and in my troubled times, he was the first one to stick his neck out and rally people in my support. He never stopped doing so. I am deeply touched by his actions and sentiments. He never needed to do that. He did that purely out of the goodness of his heart and never once did he ever expect anything in return. He owed me nothing but I owe him a lot.

    Anant, I will miss you.
