  • HC restrains unauthorised broadcast of Tokyo Olympics by cable operators

HC restrains unauthorised broadcast of Tokyo Olympics by cable operators

New Delhi: The Delhi high court has restrained the unauthorised broadcast of the upcoming Tokyo Olympics by several rogue websites, multi-system operators, and local cable operators. The much-awaited international sports extravaganza is set to begin on 23 July and conclude on 8 August.

The court was hearing a plea filed by Sony Pictures Networks India, which is the official, exclusive broadcaster of the 2020 Tokyo Olympics in India.

According to the SPN, over 40 websites and over 30 multi-system operators, and local cable operators illegally broadcasted pirated content in violation of the copyright act and argued that the new IT Rules of 2021 required an ISP to protect a party’s proprietary rights. In the plea, Sony Pictures has stated that these websites and cable TV operators were habitual defaulters as they have in the past infringed its exclusive rights for the broadcast of certain cricket matches.

The court thus directed the internet service providers (ISPs) to block access to these websites illegally broadcasting the games on their platforms. The ex-parte interim order will remain in force till the next date of hearing on 29 September, it added.

The court has asked the government to issue necessary directions/notifications calling upon various ISPs to block access to rogue websites. It has also issued summons in the plea and sought response from the defendants within four weeks.

Sony Pictures owns and operates the Sony Ten Network of channels which includes Sony Ten 1, Sony Ten 1 HD, Sony Ten 2, Sony Ten 3, Sony Ten 2 HD, Sony Ten 3 HD, Sony ESPN, Sony ESPN HD, Sony Six, Sony Six HD.

In its agreement with the International Olympics Association, SPN has the exclusive right to broadcast the games over any media platform. The network has also put together a series of ‘Hum Honge Kamyab’ films on-air and on their social media platforms led by eminent personalities sending their best wishes to the Indian contingent for the Olympic Games Tokyo 2020.

The Olympic Games Tokyo 2020 will be telecast LIVE on SONY TEN 1, SONY TEN 2, SONY TEN 3, SONY TEN 4, and SONY SIX channels from 23 July to 8 August.

Voter Baddi – ABP Ananda parody videos running in its news wheels. The parody songs/music were composed by top bands and singers of West Bengal, while their videos were produced by the channel itself.

There was also MukhoMukhi – a show which entailed a series of face-offs and exclusive interviews with political titans.  AayByay – A special capsule on the declared property of heavy weights, and NiyomNasti– an irregular segmenton ‘rules being broken’by political partiesduring campaigns.

Additionally, ABP Ananda conducted Opinion Polls and Exit Polls to gauge the electoral pulse of the voters, besides an edge-of-the-seat Live counting of ballots on Results Day. Discussions with expert panellists with a neutral take on all issues confronting the state at large were other highlights of the election coverage that sought to bring all aspects of the on-ground proceedings to its viewers, precisely and instantly.

Furthermore, there was exclusive content streamed via its Digital platforms, with Vox-pop series and “BHADRA BHAABE VOTE” (election well behaved) – a quirky digital series that reminded viewers to be well-behaved during the election season. The latest internet sensation, Sayan Ghosh as a protagonist took the audience through it in his usual humorous ways. There were a total of eight digital-only films and the total views garnered on YouTube is over 19.55 lakhs.

In fact, the pulse-pounding election coverage of ABP Ananda’s YouTube channel clocked over seven million views. The view count was recorded till 7 March, according to Pepper Media—YouTube. As a testimonial of ABP Ananda’s high-intensity reporting from the remotest parts of the state an umbrella Campaign TVC was launched– Phase II BANGLAR KHABOR. BANGLA THEKE (News of Bengal. From Bengal). This was a brand film with real locations, shot across 20+ places over eight districts of West Bengal – highlighting issues about that particular area. It underscored how the channel brought in real news for the viewers despite hurdles amidst myriad challenges. It garnered over 6.38 lakh views on YouTube.

  • NBA challenges amended Cable TV rules in Kerala High Court

NBA challenges amended Cable TV rules in Kerala High Court

New Delhi: The Kerala high court has directed the ministry of information and broadcasting (I&B) not to take any coercive action against members of the News Broadcasters Association (NBA) over non-compliance with the Cable TV Act.

The court issued the orders on a plea filed by the NBA which represents several news channels against certain provisions of the amended Cable TV Rules which provide for an oversight mechanism over the content of news channels. The court has also issued notice to the ministry and sought its stand on the NBA’s petition within two weeks.

In its plea, NBA contended that the amended provisions in the Cable TV Rules create an oversight mechanism that gives the executive “unfettered, unbridled and excessive powers to regulate the content of the television channels of the news broadcasters”.

NBA’s counsel told the court that the amended rules are similar to the new IT rules which NBA had challenged recently. “Under the amended Cable TV Rules also, the oversight mechanism would be headed by an additional secretary-level officer who would have the power to overrule decisions of the self-regulatory body already in place and which is headed by a retired judge of the Supreme Court,” he added.

Last month, the Centre had notified the Cable Television Network (Amendment) Rules, 2021 to provide for a three-layer statutory mechanism for the redressal of consumer’s complaints relating to the content broadcast by TV channels.

The amended rules stipulate a three-layer grievance redressal mechanism – self-regulation by broadcasters, self-regulation by the self-regulating bodies of broadcasters, and an oversight mechanism by the central government. The rules require each broadcaster to establish a grievance or complaint redressal mechanism, appoint an officer to deal with the complaints, display the contact details of their grievance officer on their website or interface and be a member of a self-regulating body.

As per the rules, any person aggrieved by the content of a programme of a channel may file his/her complaint in writing to the broadcaster first. “The broadcaster shall, within 24 hours of a complaint being filed, generate and issue an acknowledgment to the complainant for his information and record. The broadcaster shall dispose of the complaint and inform the complainant of its decision within 15 days of receipt of such complaint,” the rules stated.
