    Stakeholders welcome easing of FDI norms for broadcasting; want DAS to move faster

    NEW DELHI: The broadcasting sector and particularly the cable sector welcomed the government’s announcement bringing almost the entire broadcasting sector under the automatic route for foreign direct investment.

    Stakeholders said the step was very timely as the country was on the verge of completing the transformation to digital addressable systems for cable television.

    The government had this morning announced opening up setting up of teleports, direct-to-home, cable networks, headend-in-the-sky and mobile television to 100 per cent foreign direct investment through the automatic route.

    The announcement from the Prime Minister’s office said this had been done with the objective of providing major impetus to employment and job creation in India.

    However with regard to the broadcasting sector, it was made clear that infusion of fresh foreign investment beyond 49 percent in a company not seeking license/permission from sectoral Ministry, resulting in change in the ownership pattern or transfer of stake by existing investor to new foreign investor, will require approval of the Foreign Investments Promotion Board.

    However, Hinduja Ventures Ltd whole-time director and former president of the MSO Alliance Ashok Mansukhani told indiantelevision.com that these changes would have real meaning only if the government is able to bring back DAS ‘on the rails.’

    He said that just around six months were left for the final Phase of DAS and Phase III was already mired in several cases all over the country. Although the Supreme Court had directed that these be transferred to Delhi High Court, this process had not been completed with the result that the High Court could not proceed to hear the matter.

    Phase III was to cover 7,700 cities and Phase four is to cover 61 million (6.1 crore) television households, but all this will be derailed unless the government is able to implement the different phases.

    In a general reaction to the liberalization in FDI, FICCI Secretary-General Didar Singh said“There is no doubt that India today is the most preferred investment destination in the world. While the attraction of our market is known to all, there is now even more reason for global investors to commit themselves for making and doing business in India. Our government is translating words into action and after having made a strongest pitch ever to global investors, it if following up with a major overhaul of the FDI framework so that the interest generated is captured in the form of higher investment flows which are on a rise since the last two years”.

    National Cable and Telecommunication Association President Vikki Choudhuri, while welcoming the move, said the government should also immediately re-look at the regulations which are not favourable for BPOs and the last mile operator.

    Cable Operators Federation of India president Roop Sharma said that while the relaxation for cable and multi system sector going through automatic route was welcome, it would not serve any purpose unless the last mile operator is educated about this.

    As a result, she said it would only lead to creation of monopolies in the hands of a few large cable and MSO operators. This was because cable operators in smaller towns never even came to know about the changes since no effort was made by the government to educate them.

    MIB sends TV channels’ list to Home Ministry for fresh security clearance

    NEW DELHI: The Ministry of Information and Broadcasting (MIB) has forwarded a list of 82 TV channels, teleports and news agencies to the Home Ministry for a fresh round of security clearance as their initial ten-year licenses expire.

     

    Last week, the Home Ministry had also agreed to examine all cases of multi-system operators (MSOs) awaiting security clearance to get licenses for digital addressable system. MIB secretary Bimal Julka told Indiantelevision.com that the initial license was for ten years. Julka will also be meeting concerned officials of the Home Ministry in this regard.

     

    If found suitable, permission will be granted for renewal for an interim period up to 31 December, 2015 or till the final decision on channels’ application for renewal of permission is taken, whichever is earlier.

     

    However, TV channels, teleports, news agencies and MSOs have been asked to furnish an affidavit to the effect that the company will abide by all the provisions of the latest Uplinking/ Downlinking Guidelines and other relevant instructions/ modifications issued from time to time.

     

    All applicants have been asked to send the information to the MIB along with supporting documents within l5 days to enable it to proceed further in the matter.

     

    Prominent names among those whose cases are coming up for renewal include several channels of Bennett, Coleman & Co., Eenadu Television, Panorama Television, Prism TV, Television Eighteen India, Zee Entertainment Enterprises, Zee Media Corporation (erstwhile Zee News), IBN18 Broadcast and Times Global Broadcasting Company.

     

    Broadcasters may also enclose the details of Board of Directors (BOD) and latest Share Holding Pattern (SHP) including foreign direct investment (FDI) component, if any, duly accompanied by requisite approval of the Foreign Investments Promotion Board (FIPB).

     

    The companies were also asked to ensure submission of the annual renewal fee for both Uplinking and Downlinking at rates as applicable as per Guidelines and for the period that may be due.

    MUMBAI: The Economic Survey for 2013-14 that was tabled by the Finance Minister Arun Jaitley shows that both the centre and the state governments will benefit from the digitisation of the cable TV industry in India because of the increase in tax collection from it.

     

    Jaitley in Parliament said, “Preliminary data from the state governments show that there is already two to three fold increase in entertainment tax collections.” The transparency in the subscriber base is set to add to the manifold increase in tax collection.

     

    Due to digitisation, opportunities are being created for the domestic manufacturers to delve into more set top box (STB) production. It stated that over three crore STBs have already been installed in the eight metros and 36 cities of the phase I and II of digitisation. The deadline for complete digitisation (phase III and IV) has been set to 31 December 2014.

     

    India has nearly 16 crore TV households with nearly 800 channels. Also there are 88 teleports. However, the benefits of digitisation are yet to kick in even in the phase I and phase II markets with only a few cities being billed as per the rules. Uneven and high entertainment tax is an issue that all the stakeholders including DTH, MSOs and broadcasters are standing up to and urging the government to look into and provide them relief. DTH operators are double taxed as they also have to pay a service tax apart from the entertainment tax.

     

    While DTH operators are adding 10 lakh customers each year, the government has also allowed two more operators to provide services through headend-in-the-sky (HITS) system. Effects of digitisation are already visible on film exhibition where 95 of the big screens are now digitised and the sector is ‘poised for buoyant growth in the long run.’

     

    The survey also stated that the media and entertainment industry has had tremendous growth and according to a FICCI-KPMG report, it is expected to touch Rs 1,78,600 crore by 2018. However, piracy remains a big challenge for the film industry and the government has approved an anti-piracy plan to combat it through legal methods.

    I&B Ministry to create online mechanism for all applications for TV channels, teleports

    NEW DELHI: The Information and Broadcasting Ministry has once again asked prospective broadcasters to deal directly with the Ministry with regards to permissions for television channels or teleports and not appoint any intermediaries or consultants.

     

    In a public notice issued today by Joint Secretary (Broadcasting) Supriya Sahu, similar to the one issued late last year, the Ministry said anyone who wishes to apply for permission to start a television channel, teleport or various permissions under the Uplinking and Downlinking guidelines, can seek clarifications at the Open House held every month for the purpose and also get information on pending issues.

     

    The Ministry will not entertain any intermediary, consultant, advisor, consultancy organisation or firm to liaise with the Ministry on behalf of applicants and permission holders for following up on their requests.

     

    The Ministry follows an absolutely transparent and open process to grant various permissions to television channels, teleport operators, news agencies etc.

     

    In addition, the Ministry has also put in place a specialised software, Satellite Television Channels Application Tracking System (STATS), for those who have already applied to the Ministry for various permissions. An lD and password have been given to all of them to track the status of their pending applications.

     

    The Ministry is in the process of automating the entire Broadcasting Wing to ensure that an online mechanism is brought for various applications. Once in operation, this web enabled software will help applicants to apply online and also make payments of various fees etc., through the payment gateway.

     

    All applicants and permission holders have therefore been advised not to approach anyone who claims to be an advisor, consultant or facilitator on behalf of applicants.

    NEW DELHI: The government has decided to hold review meetings of all permitted teleport operators who have been divided in batches over three days to meet different officials of the Information and Broadcasting Ministry (I&B) on 1, 2 and 5 May.

     

    24 teleport operators have been summoned on 1 May, while another 24 will be meeting the designated officials on 2 May and 17 will meet the officials on 5 May.  

     

    The details of those who have been summoned and the officials they will meet in the I&B are available on the Ministry’s website mib.nic.in.

     

    The operators have been asked to bring details to establish continued eligibility of teleport operators. Apart from the list of TV channels uplinked from their port, each of the operators have to bring recent photograph of the facility/teleport; recent photographs of the present directors on the board of the company, key executive of the company along with the details of directors/key executives in the format given on the website.

     

    This should contain the name of the director/key executives with date of appointment and date of Ministry approval among other personal details. In addition, details have to be submitted about audited balance sheet of the company for the financial year 2012-13 or the latest; net worth certificate from the statutory auditor of the company; latest shareholding pattern of the company and details of foreign investment in the company; operational status of the teleport – WPC validity and NOCC Certificate; and any other submission the company may wish to make as relevant to the permission granted by this Ministry including details regarding non-operational status etc.

     

    They will be required to bring the latest report of the teleport duly filled in the prescribed format with details of the TV channels being uplinked, current operational status, details of Teleport NOCC Reference and date and name of the company to whom TV channels are permitted; and STV license number along with validity.

    NEW DELHI: The Information & Broadcasting Ministry (I&B) has asked the broadcasters and teleport operators to provide full details relating to the companies operating them. The stakeholders will need to furnish the report by March end.

     

    The I&B has pointed out that it is the responsibility of the company to intimate any changes to the Ministry promptly.

     

    In a letter sent to all the television channels and teleport operators, the Ministry has asked among other things for contact details of the company including the registered address, any additional address, e-mail IDs, telephone and fax numbers.

     

    In addition, the channels and teleports have been asked to supply the name of the authorised representative with his/her e-mail ID and mobile number.
