    Digicable part pays dues to MediaPro

    NEW DELHI: Digicable Network India Pvt. Ltd has handed over three post-dated cheques for Rs 25 lakh each as part of the total payment of Rs 9.52 crore to MediaPro Enterprise India Pvt. Ltd.

    The cheques were accepted by MediaPro counsel Tejveer Singh Bhatia “without prejudice to his rights and contentions” in the presence of member B B Srivastava of the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) on 9 August 2016.

    But Bhatia said in the event of any of the cheques not being honoured for payment, the Tribunal may seriously consider attachment of the judgment debtor’s headend.

    The cheques dated 16 August 2016, 31 August 2016 and 30 September 2016 were handed over by Digicable Network counsel Diggaj Pathak.

    The matter was listed for 14 September 2016 by which time additional cheques as well as the revised schedule, if any, for expeditious liquidation of the decretal amount would also be given, the Tribunal said.

    NEW DELHI: The Telecom Disputes Settlement and Arbitration Tribunal asked DigicableNetwork India Pvt. Ltd “by way of last indulgence” to “inform and come with the cheque of theamount it is willing to pay upfront” to Media Pro Enterprise (I) Pvt. Ltd.

    Noting that the submission of Digicable Counsel Diggaj Pathak cannot be termed as “significantamount”, Media Pro counsel Tejveer Singh Bhatia said the Tribunal had itself said on 3 June 2016 that if the MSO did not come up with a significant amount, its property should be attached.

    He therefore submitted that the headends owned and operated by Digicable should be attached.

    Digicable Counsel Diggaj Pathak said his client was willing to pay the decretal amount and presented before the Tribunal a schedule for clearing the total of Rs 9.52 crore in fourteen installments between 31 August 2016 and 31 July 2017.

    The matter has now been listed for 29 July 2016.

    TDSAT asks MSO to reconnect Sun channels for Bhopal, Indore, and Jabalpur

    NEW DELHI: Sity Cable Network Ltd has been directed by the Telecom Disputes Settlement and Appellate Tribunal to reconnect the signals of Sun Distribution Service Pvt. Ltd to Bhopal, Indore and Jabalpur.

    This follows the assurance by Sity Cable counsel Tejveer Singh Bhatia that the amount of Rs2,12,672 will also be paid.

    The three cities will get the signals from the NOIDA headend of the MSO. Jaipur is already getting the signals from the Delhi headend.

    Listing the matter for 26 July 2016, member B B Srivastava also said in his order of 15 July that the two sides will meet before the next date the status of the connection to Nagpur.

    Pan India Network allows removal of equipment from Prasar Bharati’s premises

    NEW DELHI: Pan India Network Infravest Pvt. Ltd., Mumbai is willing and ready to have its equipment removed from the premises of Prasar Bharati licensed out to them under the previous licenses at different kendras.

    These kendras are Nanded, Allahabad, Jalgaon, Varanasi, Agra, Aloka, Amritsar and other kendras in Punjab.

    This was conveyed to the Telecom Disputes Settlement and Appellate Tribunal by Prasar Bharati counsel Tejveer Singh Bhatia.

    However, Bhatia made it clear that the Network had not admitted any of the allegations or statements made in the Miscellaneous Applications 152 to 159 of 2016 filed on behalf of the pubcaster.

    In view of the stand taken by the respondents, chairman justice Aftab Alam and member B B Srivastava disposed off the applications.

    However, the tribunal directed Pan India to have its equipment removed from the premises in question within 30 days.

    TDSAT to hear LCO cases against Siti Cable and Hathway afresh in light of new TRAI regulations

    NEW DELHI: Local cable operators who are members of Karnataka State Digital Cable TV Operators Welfare Association and the Cable Operators Sangram Association of Kolkata have told the Telecom Disputes Settlement and Appellate Tribunal that they will not migrate to any other distributor without seeking prior permission from the tribunal.

    This assurance was given in three cases – one filed by the Karnataka Association against Siti Cable Networks, and the other two by the Kolkata body against Hathway Cable and Datacom. Counsel Nittin Bhatia made the statement on behalf of the members of these association who were involved in the petitions.

    The tribunal was informed by Siti Cable counsel Tejveer Singh Bhatia and Hathway counsel Jayant K. Mehta about the notifications issued by Telecom Regulatory Authority of India on 7 January and 15 March this year which ‘make some fundamental changes in the DAS Interconnection Regulations and have a direct bearing upon the controversies in these cases.’

    Chairman Justice Aftab Alam and member B B Srivastava listed the matter for 27 April for hearing the parties further in the light of the amendments introduced in the DAS Interconnect Regulations.

    The tribunal said that “In the meanwhile, the respondents may apprise the respective petitioners separately and also through their counsel Mr Nittin Bhatia regarding the rates and the terms and conditions including the respective rights and obligations of the parties under clause 10 of Schedule IV of the notification dated 15 March 2016, that the respondents might have executed with any other LCO operating in that area.”

    The Tribunal also made it clear that if any of the LCOs being represented through these petitions were willing to execute the agreement with the respondents on those terms, they were free to do so.
