    Indian film producer loses copyright battle over Lootere title

    MUMBAI: A Hindi film producer who made a 1993 film starring Sunny Deol has lost his bid to stop Disney+ Hotstar from streaming a digital series with the same title, after a Bombay high court judge ruled that film titles cannot be copyrighted.

    Sunil Darshan Saberwal, who produced the Hindi feature film Lootere three decades ago, sued Star India (now JioStar India) and others in March 2024, seeking to prevent them from using what he claimed was his registered title for their piracy-themed web series.

    But justice Sandeep Marne dismissed Saberwal’s application for a temporary injunction on 18 August, delivering a comprehensive rejection of his copyright claims and dealing a significant blow to long-standing industry practices around title registration.

    The judge ruled that “there cannot be a copyright in mere title of a film”, citing Supreme Court precedent that titles are “incomplete in themselves” and do not qualify as literary works under India’s Copyright Act of 1957. The ruling follows the apex court’s 2016 decision in Krishika Lulla v Shyam Vithalrao Devkatta, which established that commonplace words like Desi Boys lack the originality required for copyright protection.

    Saberwal’s 1993 romantic drama bears no resemblance to Star India’s eight-episode series about Somalian pirates hijacking an Indian vessel. The court noted that “except similarity in the title, plaintiff’s cinematograph film Lootere admittedly does not have any similarity in terms of story with the series.”

    The producer had registered the title Lootere with film industry associations including the Western India Film Producers Association, arguing this gave him exclusive rights. But the court dismissed such registrations as “purely private arrangements having no sanctity in law,” enforceable only between association members through contract.

    “The associations formed by film producers and registrations granted by such associations are nothing but an internal contractual arrangement between the members,” justice Marne stated. Since Star India was not a member of the relevant association, it could not be bound by Saberwal’s registration.

    The judgment highlighted how Bollywood routinely produces multiple films with identical titles—citing examples including Hera Pheri, Aankhen and Dilwale —without legal challenge, provided the underlying stories differ.

    The court also criticised Saberwal’s lengthy delay in pursuing legal action. Though he first noticed the series trailer in September 2022, he waited until March 2024 to file suit—by which time the series had already been streaming on Disney+ Hotstar for months.

    “Plaintiff has whiled away substantial time of about two years despite acquiring knowledge of plans,” the judge observed, noting this delay was “fatal” to claims for emergency relief.

    The decision undermines the film industry’s practice of treating title registrations as conferring legal rights, potentially opening the door to more disputes over popular names. Industry associations have historically operated these registration systems to prevent conflicts between producers, but the ruling clarifies they carry no statutory weight against non-members.

    Saberwal’s legal team had argued that Star India’s own attempts to secure clearance for the title from producer Boney Kapoor proved the industry recognises such rights. But the court found this irrelevant since it was undertaken by a production services company, not Star India itself.

    The series Lootere continues streaming on Disney+ Hotstar, having premiered in March 2024. Saberwal retains the option to pursue damages rather than injunctive relief, though his suit contains no such claim.

    The ruling reinforces that while films and their underlying literary works enjoy copyright protection, titles remain in the public domain unless they achieve trademark status or generate sufficient goodwill for passing-off claims—a much higher bar than simple registration with industry bodies.

    The evening unfolded by celebrating some of the towering leaders pioneering India’s road from Recovery to Resurgence. The ‘Young Turk of the Year’ award was bagged by PhonePe CEO Sameer Nigam and the ‘Young Turk Startup of the Year’, was awarded to BluSmart. While ONDC bagged ‘The Disruptor Award’, Persistent Systems received the ‘Most Promising Company of the Year’ recognition. The ‘IBLA Trailblazers of 2023’ title was awarded to India’s Javelin gold medallist at Asian Games 2023 Annu Rani, India’s champion steeplechaser Parul Chaudhary and the Indian Men’s Relay Team. Sheetal Devi, who won gold medals at the Para Asian Games 2023 was honoured with the title ‘Special and Para Sports Leader of the Year Award’.

    ‘The Sports Leader of the Year Award’ was given to Shubman Gill, Chandrayaan 3 received IBLA ‘Outstanding Contribution to Brand India’ title and Apollo Hospitals received the ‘Outstanding Company of the Year Award’. Deepak Parekh got inducted into IBLA’s ‘Hall of Fame’. IBLA In Memoriam, honoured industry stalwarts posthumously – MS Swaminathan and Mr. Ashwin Dani.

    Bollywood’s action-packed performer, Sunny Deol, was honoured with the prestigious ‘Entertainment Leader of the Year Award’ for his blockbuster hit ‘Gadar 2’ which broke all records at the box office. The evening was illuminated by Sunny’s rendition of his legendary lines from the films ‘Damini’ and ‘Gadar,’ evoking a wave of nostalgia among the audience.

    Katrina’s Kay Beauty was honoured with ‘Breakout Brand of the Year’ title, while the former CEO of NITI Aayog, Amitabh Kant received the ‘Outstanding Contribution to Public Service Award’.     Zee Cinema to air World Television Premiere of ‘Pal Pal Dil Ke Paas’ this Valentine’s Day

    It is often said that ‘there is no right time and place for love, it can happen anytime, anywhere’! With this thought at its core, the romantic drama ‘Pal Pal Dil Ke Paas’ celebrates limitless love. Stated to be Sunny Deol’s third directorial venture, the movie narrates a love story that strives to understand the emotion and essence of a first-time romance, with all its innocence, doubts and complexities. Bringing to life this story are the captivating debutants i.e. Deol Scion – Karan Deol along with the charming Sahher Bambba in the lead. 

    This Valentine’s Day, 14 February experience the escapade of love with the World Television Premiere of the biggest love story ‘Pal Pal Dil Ke Paas’ at 8 pm only on Zee Cinema.

    Along with quintessential love story, Pal Pal Dil Ke Paas has a holistic music album comprising of fun and heart-warming tracks. The title track ‘Pal Pal Dil Ke Paas’ that is a rendition of Dharmendra ji’s old song successfully struck a chord with the audience with its soul-stirring lyrics. Making the soundtrack more interesting is the debutante Karan Deol’s rap in the song ‘Aadha Bhi Zyaada’.

    Also, giving an ode to the carefree life are the peppy songs ‘Ho Jaa Awara’ & ‘Ishaq Chaliya’ that gets you hooked at the very first go.

    Commenting on the title of his debut film and its importance, Karan Deol said, “I am a die-hard romantic and starting my acting career with a romantic film is ideal. Pal Pal Dil Ke Paas was one of my grandfather’s iconic songs and the film is a tribute to the evergreen song. Hence it is not only special but is also something I am very proud to be associated with. He had told me once, that acting is technically reacting and reciprocating to actions and I should not complicate it. I intend on keeping these pearls of wisdom in mind going forward as well. While the movie is a love story, it also has an action aspect to it, which is unveiled as the film progresses. To sum it up, the film is about external factors which influence the love of the couple and try to stop the romance from blossoming. With the movie all set to premiere on Zee Cinema, I just hope that people will see my work and appreciate the efforts I have put in.”

    Commenting on his grandson’s debut film, the proud grandfather Dharmendra Ji says, “It was an emotional moment for me when I got to know my grandson decided to join the industry and continue our family legacy. I remember telling him to be a good observer as life is beautiful struggle. It is also very important for an actor to be like a sponge, absorbing and learning new things because this is a very unpredictable industry. When the film was about to release, I had the same jitters as if it was my own film releasing but at the same time, I was also excited. And, Karan did make all of us proud. I wish him all the luck and whoever has missed this film in the theatres do catch the World Television Premiere on 14 th February only on Zee Cinema.”

    Actor turned director Sunny Deol commented, “Although this film wasn’t my first stint as a director, it gave me a feeling like no other film has. I was launching my son and directing his debut film, so there was nervousness but more than that my excitement had no bounds. Pal Pal Dil Ke Paas is an innocent love story that captures the raw emotions of lovers and our intention while making the film was to capture this very vulnerable emotion. Last year we released the first poster of the movie on 14 February and this year the movie is premiering on television on Valentine’s Day. So, do catch the movie on 14 th February only on Zee Cinema to witness this captivating love story.”

    Set against picturesque mountains of Himachal Pradesh, the movie revolves around the life of Karan Sehgal (Karan Deol), a mountaineer who runs a trekking camp, Ujhi Dhaar. On the other hand, Saher Sethi (Sahher Bambba), is a hard-to-please video blogger who enrolls with Karan’s company for a trek with the intention of exposing the overpriced trek. Over the course of one week, the two who are poles apart sail through adverse conditions during the trek, share emotional outbursts and form a connection. While both are attracted to each other, they don’t realize it until they bid each other goodbye post the trek. However, their contrasting backgrounds come to the forefront which influences their love story.

    Poster Boys is a remake of the 2014 Marathi film, Poshter Boyz. A comedy, the film also carries a social message for men to go for vasectomy as there was no shame in doing so while also not forcing only women to take that responsibility.

    The characters played by Sunny Deol, Bobby Deol and Shreyas Talpade are three individuals from different walks of life.

    Sunny is an ex-army man and a ‘chaudhary,’ the head of the house and much respected in the locality. Bobby, a schoolteacher, is a henpecked husband and a father of two daughters. Bobby’s wife is known to throw tantrums at the end of which walks off to her ‘maika.’ So much so that the driver and conductor on the bus to her village are also familiar with the couple.

    The role played by Shreyas is a footloose young man, using strong-arm tactics working as a loan recovery agent along with his two childhood friends. Shreyas is in love with a girl and plans to marry her.

    Sunny is preparing for his sister’s engagement ceremony but when it is time for the groom and his family, he is told that the match is off and the groom’s family did want to have anything more with Sunny’s family. However, no explanation is forthcoming.

    Similarly, Shreyas’s match is vetoed by the girl’s father but he won’t explain why.

    Bobby faces his usual problem, his wife walks out on him for devising a way to destroy their hope for a son. Bobby is at sea about what she means.

    The three are out when, one by one, they face the cause of their problem and ostracisation by people. They see posted behind a state transport bus a poster with three of them modelling for vasectomy/nasbandi and advocating its virtues. The place the trio comes from, it is like sacrilege, something akin to losing one’s manhood! The trio becomes a butt of jokes and ridicule.

    Of the three, Sunny is the mighty one but opts for peace and logic most of the time; Shreyas is aggressive and ready to fight while Bobby is the shy, xxx kind. The three, on Sunny’s say-so, decide to go to the root of this problem as to how and why their pictures were used, and who is responsible.

    They realize that, in the era of digital cameras, their zest for selfies and posing for pictures has been misused.

    The film is a frame-to-frame remake of its Marathi version, and has a script that cares more for gags. Some characters could have been avoided or given limited footage.

    Direction is fair as Shreyas makes his directorial debut but follows the original to the T. Dialogue and gags are the lifeline and have an impact at places.

    The film has one song by Daler Mehndi from Sunny Deol’s 1999 film, Arjun, that works. The production value is shoddy.

    As for performances, Sunny is restrained and effective. Bobby is awkward at times but that goes with his character. Shreyas has the author -backed role of an extrovert and caters to the gallery.

    Poster Boys is an average entertainer. Having opened below par, it has the weekend to cash in on. The prospects thereafter hold limited hope.
