    IT panel recommends MIB to restructure PCI to cover all types of media

    Mumbai: Parliament’s standing committee on communications and information technology, headed by Congress leader Shashi Tharoor has recommended the ministry of information and broadcasting (MIB) to set up a media council on the lines of the Press Council of India (PCI), with statutory powers over print, television and digital media platforms.

    The recommendation was part of the ‘Ethical Standards in Media Coverage’ report which expresses concerns regarding the limited efficacy of existing regulatory bodies like the PCI and the News Broadcasting and Digital Standards Authority (NBDSA) in enforcing their decisions. This has led to the fourth estate “gradually losing its credibility and integrity.”

    The report noted that while the PCI – a statutory body governing the print media – may entertain complaints and is empowered to warn, admonish or censure newspapers, news agencies, the editor or the journalist concerned, it does not have the power to enforce compliance. Its advisories are not enforceable in a court of law.

    Similarly, while the NBDSA (a self-regulatory body for news broadcasting), has the power to fine, its jurisdiction extends to only those organisations that choose to be members of the News Broadcasters and Digital Association. Compliance with its orders is also voluntary.

    Suggesting restructuring the PCI to cover all types of media, the panel said, “In view of the above, the Committee has opined that the MIB should explore the possibility of establishing a wider Media Council encompassing not just the print media but the electronic and digital media as well, and equip it with statutory powers to enforce its orders where required.”

    The committee also recommended that pending a decision on the council, the ministry should look into the possibility of expanding the regulatory framework to monitor e-newspapers.

    NEW DELHI: The Parliamentary Standing Committee on Information Technology chaired by Congress MP Shashi Tharoor will be taking up the issue of alleged manipulation of TV Rating Points (TRP) by some channels, PTI reported citing some sources.

    The committee has asked representatives of the News Broadcasters Association, Press Council of India and Prasar Bharati to depose on the subject of 'ethical standards in media coverage'.

    This comes on the back of Congress MP and member of the panel Karti Chidambaram’s request to take-up the matter and call the officials of the ministry of information and broadcasting (MIB) before the committee to seek clarification and remedial measures.

    He had said that the government's advertising expenditure depends on this system, and public spending should not be based on flawed data. “Flawed or manipulated TRP cannot be the basis of ad spend. TV companies also base their valuations on TRP. Those valuations are questionable now,” Karti further said.

    The Congress leader’s demand that the parliamentary panel takes up the issue came a day after the Mumbai Police claimed to have busted a TRP manipulation racket and arrested four people.

    "The recent issues surrounding TRPs of television channels have cast doubts on the legitimacy and reliability of the system. TRPs produce essential data on television audiences in India and have become the primary basis for advertising decisions," Karti said in a letter to panel chairman Tharoor.

    "There is a need for further understanding this situation. In light of this, it is important that the standing committee take up this issue. Therefore, I request you to call before the Committee concerned officials of the responsible ministry, MIB to seek necessary clarification on the current situation and remedial measures," he said.

    MUMBAI: The UK’s communications regulator Ofcom recently registered a complaint against “Joanna Lumley’s India” to be ‘materially misleading’. It has been registered under the “Complaints assessed, not investigated” section of Ofcom. Ofcom has decided not to pursue complaints recorded between 1 and 20 August 2017 because they did not raise issues warranting investigation. “Complaints assessed” fall under the procedures for investigating breaches of content standards for television and radio.

    TV show ‘Joanna Lumley’s India’ has been alleged in a section of the UK media for airbrushing history. Lumley had returned to the place of her birth to celebrate India and walk in her ‘family’s footsteps’. However, her show alleged overlooked British oppression in the former colony. In the final instalment of Lumley’s three-part travelogue adventure across India, she explored Rajasthan, Delhi and the mountainous North West ending in Kashmir, the place of her birth.

    Joanna Lumley’s India, shown on ITV, promise to “celebrate” modern India and “walk in my family’s footsteps”. Within minutes of the beginning of the first episode, there was reportedly an omission. Walking through Kolkata, then called Calcutta, Lumley notices the British-inspired architecture. She however fails to mention that the first Anglican cathedral on the subcontinent St John’s Church was built by James Agg, her great-grandfather and the first of her ancestors to arrive in India in 1777. She probably is unaware of the lineage, the Guardian reported.

    But. it was not hard to trace it. Or, it could be because of those four chilling words — British East India Company – the trading corporation turned “aggressive colonial power”, as the historian William Dalrymple pointed out, the activities of which brought the word “loot” (from the Hindustani ‘lut’) into the English dictionary, and from which Agg may have made his fortune.

    The Brit EIC was not just a group of merchants, but a military force that plundered India throughout the 18th and early 19th centuries. In Bengal, the first of the regions to fall to the British Raj, the immediate outcome was full pockets for the Westerners and poverty for the citizens. Indians were stopped from trading, were forced off their land by harsh taxes, and saw their world-renowned textile industry destroyed. 

    The poverty of this great city, Lumley says, was down to “conflict and politics”. Or, did she say: “conquest and policies” – such as the 50 per cent tax on income, the extraction of which was routinely helped along by torture. Defaulters could expect to be caged and left in the burning sun. Or, at worst, to quote Edmund Burke’s 1795 testimony in the Parliament about the horrors inflicted upon Bengali women, “they were dragged out, naked and exposed to the public view, and scourged before all the people … they put the nipples of the women into the sharp edges of split bamboos and tore them from their bodies,” the Guardian wrote.

    As Lumley’s camera crew panned over a child beggar, it began to feel like the presenter was in denial. Take the segment on the Dalits, or “untouchables”. It is hard to imagine, purrs a moralising Lumley, how “this modern country” can “tolerate such discrimination”. Yet, as Shashi Tharoor outlined in his new book “Inglorious Empire,” the British helped to entrench caste prejudice, giving a final shape to it as a means of control. “We had castes,” Tharoor says, “but we did not have the caste system.”

    MUMBAI: The Delhi High Court has asked Republic TV and the kin of late Sunanda Pushkar not to indulge in “name calling” in connection with her death case but said there could be a possibility of some posturing from both sides.

    The court was hearing the Congress leader Shashi Tharoor’s plea seeking to restrain journalist-editor Arnab Goswami and his TV channel from alleged misreporting on his wife’s death, PTI reported. Pushkar was found dead in a south Delhi five-star hotel suite on the night of 17 January, 2014, in mysterious circumstances.

    Justice Manmohan made the above observation after lawyers accused each other of not being careful while tweeting about the case as well as about each other.

    The court has now told Tharoor’s lawyers to file their response to the affidavit filed by Goswami and the channel and listed the case for hearing on 21 September. Tharoor had filed Rs 20 million defamation suit against Goswami and his channel.

    While the media house was now careful in how it reported about the case, senior advocate Salman Khurshid, appearing for Tharoor, said some Republic TV reporters were not taking the same care while tweeting. Appearing for Republic TV, advocate Malvika Trivedi contended that Tharoor had also made endless tweets against it which, she said, were offensive.

    In response, Khurshid said that his client’s remarks about the media house were harsh and funny, but not defamatory and assured the court that such statements would not be made again. Khurshid said he does not want to gag the media. Investigation was their right, he said, but, he said, they had already held him guilty.

    NEW DELHI: Even as the Delhi High Court did not restrain Republic TV in its investigation into the death of Sunanda Pushkar, it asked the channel head Arnab Goswami to respect Shashi Tharoor’s right to silence on the issue. A spokesperson meanwhile said it was “another big victory for Republic TV” as Tharoor failed to ‘gag’ the channel.

    The court asked Goswami and his channel to file its reply on the Congress MP’s plea to refrain from “misreporting” his wife Sunanda Pushkar’s death, and asked them to respect his “right to silence”.

    The court was hearing an application moved by Tharoor in his pending Rs-20 million defamation suit against Goswami and the channel for allegedly making defamatory remarks against him while airing news relating to the death of his wife. Tharoor alleged that they continued to engage in “defaming and maligning” him despite an assurance given in the court on 29 May by their counsel. The matter has now been fixed for 16 August 2017.

    Tharoor’s counsel Salman Khurshid submitted that the court must direct Goswami and the channel to not mention the expression “murder of Sunanda Pushkar”, as it is yet to be established by a competent court that her death was “murder”, to ensure the trial was not prejudiced.

    Senior advocate Sandeep Sethi, appearing for Goswami and the channel, said they have only placed the actual evidence and the police report while broadcasting the news. “We have not called him a murderer in any of the news broadcasts on the channel,” he said. The judge asked the counsel not to use names and said “they will have to abide by that.”

    Pushkar was found dead in a suite of a five-star hotel in south Delhi on the night of 17 January, 2014. The matter is under investigation.

    NEW DELHI: Even as it asked him to avoid rhetoric in his reports, the Delhi High Court today issued notice to Republic TV and Arnab Goswami over the Congress leader Shashi Tharoor’s defamation plea.

    Fixing the next date of hearing to 16 August, Justice Manmohan observed: “Bring down the rhetoric. You can put out your story. You can put out the facts. You cannot call him names. That is uncalled for.”

    Lok Sabha MP Tharoor had filed a civil defamation suit late last week against Goswami and the TV channel, seeking damages and compensation of Rs 20 million for allegedly making defamatory remarks against him during a news broadcast related to the death of his wife Sunanda Pushkar.

    The lawsuit filed through advocates Muhammad Ali Khan and Gaurav Gupta claimed that the recordings were released in a sensational manner and created a ‘non-existing controversy’ by maligning Tharoor’s public life and image.

    The petition said, “It is not out of place to say that Goswami and the TV channel broadcast news reports and ‘alleged expose’ which were intended to lead the viewers to believe that the deceased was murdered either by Tharoor or at his instance. Such a broadcast ‘clearly has the potential of adversely impacting the ongoing investigation into the death of the deceased’,” the plea said.

    Tharoor said Goswami had earlier aired similar news when he was the editor-in-chief with another TV news channel (Times Now), which was restrained by the National Broadcasting Standards Authority.

    The Congress MP also said the police was investigating the matter and had also registered an FIR. “It is pertinent to mention that the Delhi Police took statements from a number of people, including him,” the suit said. It also stated that during the probe not a single allegation has been made by the investigating authorities against the MP.

    NEW DELHI:On Friday, the Delhi High Court gave some relief to Republic TV’s Arnab Goswami in a case of IPR theft filed by Times of India group, but was petitioned by Congress leader and Thiruvanthapuram MP Shashi Tharoor who filed a defamation case against Goswami and his Republic.

    Tharoor in the petition has claimed from Goswami damages and compensation of Rs 20 million (Rs 2 crore) for allegedly making defamatory remarks towards him while airing news on Republic TV relating to the death of his wife Sunanda Pushkar. The case would be taken up on Monday.      

    According to a PTI report, Tharoor has also sought a direction from the high court to restrain the TV channel from broadcasting any show relating to the death of his wife till the investigation is completed by the Delhi Police.

    While the news was broken by a TV news channel, Tharoor used the channel’s tweet on the development to confirm by tweeting: “Pleased to confirm this story. We filed today in Delhi High Court. Had enough of his campaign of calumny.”

    The Congress leader, in his lawsuit, has made Goswami and Arg Outlier Media- Asianet News Private Limited, the company which owns Republic TV, as parties. The petition referred to the broadcasting of news items from 8 to 13 May 2017 when the TV channel claimed to air an expose connected to the death of Pushkar, PTI reported.

    “It is not out of place to say that defendants (Goswami and TV channel) broadcast news reports and alleged expose’ which were intended to lead the viewers to believe that the deceased was murdered either by plaintiff (Tharoor) or at the instance of the plaintiff.  Such a broadcast clearly has the potential of adversely impacting the ongoing investigation into the death of the deceased,” PTI quoted sections of the plea in the high court.

    However, Goswami seemed to remain unfazed on Friday. Via Republic TV’s Twitter handle he sent across his message on the civil defamation case to the world.

    “The people of India know that Sunanda Pushkar was murdered and Republic TV has a right to investigate the case,” Goswami said in a tweet, adding in another emphatically: “Determined to pursue the truth in the Sunanda Pushkar murder case, despite Tharoor’s attempts to block us.”  

    Sunanda Pushkar was found dead in a suite of a five star hotel in south Delhi under mysterious circumstances on the night of 17 January, 2014.

    MUMBAI: Population First, with the support of India’s leading entertainment channel Colors Viacom 18, International Advertising Association (IAA) and UNFPA India, announced the winners of the First South Asia Laadli Media and Advertising Awards for Gender Sensitivity 2015-16 at Tata Theatre, NCPA. The awards were presented by Dr. Shashi Tharoor, MP, and hosted by the popular television journalist Barkha Dutt.

    The current edition of Laadli Media Awards which is one of its kind awards on gender issues had for the first time invited entries from five South Asian nations with the support of IAA. The entries were invited and the best were chosen from five nations which include – Pakistan, Bangladesh, Sri Lanka, Mauritius and Nepal.

    “Media is a messenger which wielded power, but is also bound by responsibility. Media is a mirror that exists not to flatter, but to reveal what is lacking in our society, which is flawed and must be corrected,” said Tharoor at the First Edition of South Asia Laadli Media and Advertising Awards for Gender Sensitivity. He said that the media must break gender stereotypes and not reinforce them. He applauded the winners and boosted them to continue doing good work like the Lifetime Achievement Awarded, noted Activist Ms. Kamla Bhasin. ‘Breaking News – Challenging Gender Barriers’, a book, which is compilation of the stories of the winners this year was also launched at the event.

    The winners of South Asian nations included, Lubna Jerar Naqvi who has 25 years of journalism experience and covers gender sensitive issues in Pakistan. She is a part of International Federation of Journalists (IFJ) as gender safety expert. She has written extensively on sexual harassment, violence against women, honour killings, child marriage and gender equality at large in Pakistan. From Sri Lanka, Dinitha Ratnayake hold a decade experience in journalism and is currently the Deputy Manager –Current Affairs in one of Sri Lanka’s major radio channels “Neth FM”. She has worked on several investigations with regards to women’s concerns in the country and speaks evocatively on women’s rights issues. Ramkala Khadka is a senior journalist of over 15 years experience with a leading Nepali newspaper, Annapurna Post. She specialises in writing on women’s issues. She has written critically about the citizenship rights of women and inheriting citizenship from both parents. She has also covered the affects of domestic violence on the children at home. Martine Luchmun is a senior journalist with Le Sentinelle. Her journalistic work covers women’s rights issues for the average Mauritian women readers ensuring these women have a greater understanding of their rights. She has written feature stories that showcase women role models who have overcome various odds and are still fighting on.

    Prominent Awards:

    The South Asia Laadli Media & Advertising Award for Gender Sensitivity 2015-16 for the category‘Best Short Film’ was given to Radhika Puri for her short film ‘Water Wives’ which digs into the existing system of husbands marrying multiple times inorder to have wives double as labourers to fetch water.

    The Laadli Media & Advertising Award for Gender Sensitivity 2015-16 for ‘Books in the Novella’category was given to Volga for her book Liberation of Sita published by Harper Collins. The Laadli Media & Advertising Award for Gender Sensitivity 2015-16 for ‘Films’ was given to one of the most appreciated film ‘Parched’ and ‘Neel Battey Sannatta’.

    Laadli Media & Advertising Award for Gender Sensitivity 2015-16 for the category ‘Best Campaign’ was given to ‘Vicks’ for its brilliant portrayal of third gender. The Laadli Media Award for ‘Game Changer’ is given to ‘Nayi Soch’ by Star India. Laadli Media & Advertising Award for Gender Sensitivity 2015-16 for the category ‘Best Play’ was given to “Shikhandi” the story of the In-betweens, written and directed by Faezeh Jalali.

    The South Asia Laadli Media & Advertising Award for Gender Sensitivity 2015-16 – Lifetime Achievement Award was given to Kamla Bhasin, Renowned Women’s Rights Activist.

    The jury for the Laadli Media awards included prestigious names editors, writers, academicians and media professionals like KV Sridhar, Sameera Khan, Deepa Gehlot, Dilip D’Souza, Kumar Ketkar, Amrita Chowdhury, Amy Fernandes, Kalpana Sharma, Gurbir Singh, Ayaz Memon, Namita Roy Ghose, Kiran Khalap, Namrata Zakaria, Neeru Nanda.

    Laadli Media Fellowship:

    Announcement of the four recipients of The Laadli Media Fellowship were also made during the evening. These journalists include Katta Kavitha from Telugu daily regional Nava Telengana, Shreya Ila Anusuya, a freelance journalist, Sindhuvasini from BBC Hindi and Vinaya Deshpande from Sunday Guardian. Each of the journalist receiving the fellowship will write four investigative reports over a period of four months on the theme of Gender and Sexuality.
