    Adcap case adjourned to 24 July; broadcasters hope govt will reverse earlier order

    NEW DELHI: The Delhi High Court has adjourned the petition by the News Broadcasters Association (NBA) and others challenging the advertising cap of 12 minutes per hour sought to be imposed by the government to 24 July.

     

    The NBA and regional broadcasters along with music channels informed the court about recent developments vis-?-vis the new government and highlighted the fact that they were awaiting the government’s response against their joint representation.

     

    The Court agreed to the adjournment in order to give some more time for the aggrieved broadcasters and government to represent and decide an amicable solution amongst themselves.

     

    The order that the Telecom Regulatory Authority of India (TRAI) will not take any action against any channel pending the petition will continue. In an earlier hearing, the Court had, at the regulator’s instance, directed that all channels keep a record of the advertisements run by them.

     

    TRAI sought to tell the Court that the matter had been pending for long, but the bench headed by Chief Justice G Rohini said if the matter could be resolved, then it was better to give more time.

     

    For the broadcasters, this is a major relief even Information and Broadcasting Minister Arun Jaitley recently voiced his views against an ad cap on broadcasters.

     

    The NBA had challenged the ad cap rule, contending that TRAI does not have jurisdiction to regulate commercial airtime on television channels.

     

    Apart from the NBA, the petition have been filed by Sarthak Entertainment, Pioneer Channel Factory, E24 Glamoru, Sun TV Network, TV Vision, B4U Broadband, 9X Media, Kalaignar, Celebrities Management, Eanadu Television and Raj Television.

     

    The news and regional broadcasters fear that the capping of commercial airtime will curtail their ad revenues. They also argue that the ad cap must be brought only after the benefits of cable TV digitisation start showing.

    NEW DELHI: Even as it said it will not respond to applications of permissions for licences if an applicant has delayed in responding to queries by more than three months, the Information and Broadcasting Ministry today gave a final grace period of 15 days to 73 applications.

     

    The Ministry said in a note today that a stock-taking had shown that in 20 per cent to 40 per cent cases, applicants took anything between three months to one year to reply to the information sought by the Ministry. So, the ministry has said that henceforth, it will close requests where clarification has been due for more than three months.

     

    A final call has been given to all to send in their clarifications that are pending within 15 days.

     

    At the same time, it said that it is committed to granting permissions and other regulatory approvals as soon as clearances and clarifications are obtained in a speedy and transparent manner. It said that no permissions can be “held up intentionally.”

     

    However, the company’s response sometimes becomes crucial to expeditious disposal of such requests.

     

    Failure by the companies to reply, delays the whole process leading to an impression that the permissions are held up by the Ministry.

     

    The Ministry also sent separate emails to the concerned companies.

     

    Applicants include major players like Big RTL Broadcast, INX News, UTV Entertainment, Sarthak Entertainment, Focus group, News Express among others. Some of these have filed applications for more than one channel.

    NEW DELHI: Even as the stay on implementation of ad cap continues, the Delhi High Court adjourned the hearing of the petition of News Broadcasters Association (NBA) and other channels to 6 May as the NBA wanted more time to file a rejoinder to the reply by the government.

     

    Acting Chief Justice B.D. Ahmed and Justice Siddharth Mridul gave the order after the plea by NBA Senior Council NK Kaul seeking adjournment.

     

    The petitions have been filed by NBA, Sarthak Entertainment, Pioneer Channel Factory Pvt Ltd, E24 Glamoru Ltd, Sun TV Network Ltd, TV Vision Ltd, B4U Broadband, 9X Media Pvt Ltd, Kalaignar Pvt Ltd, Celebrities Management Pvt Ltd, Eanadu Television Pvt Ltd and Raj Television Pvt Ltd.

     

    The Senior Counsel for Telecom Regulatory Authority of India (TRAI), Saket Singh sought to intervene to seek early hearing, but the Court said the matter will come up for hearing only in May.
