  • Passing the Copyright Amendment Bill will resolve many issues

Passing the Copyright Amendment Bill will resolve many issues

MUMBAI: How does one react on the issue of copyright when a person appeals to a Court to remove a dialogue of the Salman Khan starrer ‘Veer’ because this person had uttered it some years earlier?

The filmmaker had to finally give in after which the dialogues were indeed deleted from the film on grounds that ‘the expression of the person while uttering the dialogue was copied.’

Said Anand And Anand Managing Director Rahul Ajatshatru, “Our lawyers and judges are not well versed with the Copyright Act while talking about the subject or passing an order on this topic. It is time the Copyright Amendment Bill is passed.”

Agreeing, Film Federation of India Secretary General Supran Sen said, “Some years ago the Mumbai High Court had said that if a particular video of a film is shown at home nothing happens, but if it is shown in society then copyright is infringed. This issue was challenged in the Madras High Court that said the Bombay High Court stand was wrong. Later it held that special courts should be set up to hear these matters.”

The matter led to a lot of debate after which it was decided to come out with a Copyright Amendment Bill. But though this has been through the Lok Sabha, it is yet to get the approval of the Rajya Sabha. “Hopefully this would be done after the Budget session of Parliament,” opined Amarchand Managing Partner Shardul Shroff.

The views were expressed during a discussion on the process of IP transfer and its legal ramifications in the specific case of film remakes during the FICCI Frames. RCL Motion Pictures head and producer Jagdish Rajpurohit, UTV Motion Pictures creative director Amar Butala, French Embassy, TV & Cinema head Deborah Benattar and International Federation of Film Producers Association former Director General Bertrand Mouiller also spoke.

Referring to RCL Motion Pictures obtaining the copyright of the French film ‘L’emmerduer’, Rajpurohit said:” “When we approached the French film producers, they were a little inquisitive, but decided to give us the remaking rights after some thought.”

But they will decide on associating with the Hindi remake ‘Bumboo’ after they come down to India and see whether the makers have followed the content verbatim or have deviated from the same. “I am sure they will be happy after watching the film and associate with our film,” observed Rajpurohit. The film releases in India on 31 July.

Butala said: “These days things have changed a lot and producers don’t want to go to Court on matters of copyright infringement. They sort the matter amicably.”

Mahesh Manjrekar’s Hindi version of anti-education film with Akshay Kumar

MUMBAI: Wanting to do a Hindi version of his anti-education Marathi film Shikashanachya Aaicha Gho for almost a year with Salman Khan, Mahesh Manjrekar has now decided to go ahead with the project with Akshay Kumar.

Manjrekar is furious after he read of the gruesome incident of a 15-year old student stabbing his teacher in Chennai to death. Said Manjrekar in a statement, “After what that 15-year old boy did to his teacher in Chennai, I‘ve to do the Hindi version of the film fast. What are the pressures on a child that make him so allergic to school life and teachers? What could‘ve provoked that boy to stab his teacher in Chennai? My film is very relevant to the situation that school-going children face. I need Akshay to take the message of a child‘s right to exercise his career options and to be freed of peer pressure to the maximum number of people.”

Kumar will to play the role of the tyrannical father who realises too late that his son‘s mind and heart are meant for cricket and not for formal education.

It may be remembered that though Khan was interested in doing the project, he was unable to do so because of date constraints.

AMPTP locks horns with FWICE over ban on Galani

MUMBAI: The Association of Motion Pictures and Television Programmers and Producers (AMPTPP) has slammed the Federation of Western India Cine Employees (FWICE) over its ban on producer Vijay Galani who is said to be in a dispute with Salman Khan on the latter’s payment issues.

Galani has been reportedly accused of not paying Khan Rs 150 million for the actor‘s role in his 2010 production. Following Khan’s plaint with the FWICE, it passed a non-cooperation directive against Galani which implies that he cannot make another film in Bollywood until he resolves the dispute with the actor.

The AMPTP believes that the non-cooperation directive issued by the Federation is illegal. It has alleged that the FWICE had unilaterally announced non-cooperation without holding a joint meeting with producers. "It is illegal and Galani has told us that he will be taking legal action against FWICE," president of AMPTPP Ratan Jain has reportedly said.

"The producer has told us that he does not owe Salman any money. The actor has not provided any documentary evidence to show that Galani has to pay him Rs 150 million," Jain averred.

  • Ormax Media study ranks Singham top favourite in 2011

Ormax Media study ranks Singham top favourite in 2011

MUMBAI: The Rohit Shetty directed Singham is the top favourite film of Bollywood audiences in 2011 while the Zoya Akhtar film Zindagi Na Milegi Dobara and the Imtiaz Ali directed Rockstar take the next two positions respectively, according to a recent study.

The next three positions are occupied by Salman Khan’s Ready and Bodyguard just a notch ahead of Shah Rukh Khan’s Don 2, according to Ormax Media’s consumer-based yearend report titled ‘Front Page 2011’.

The latter half of the chart consists of more experimental films that lacked a big star. In particular, No One Killed Jessica performs creditably at No. 7. It is the only film in this list that had an opening weekend of less than Rs 150 million and yet found appreciation on the strength of its content.

Commenting on the results, Ormax Media CEO Shailesh Kapoor said, “There are various award shows that give away Best Film awards. However, this ranking is based on structured consumer data from more than 32,000 cinegoers across India. There can’t be a bigger award than this!”

The ranking of the top ten favourite Bollywood films of 2011 was derived on the basis the ‘Word of Mouth’ (WOM) score of the film, using data collected through consumer research throughout the year. The WOM score represents the percentage of audiences who liked the film enough to recommend it strongly to their friends.

While box office business is heavily influenced by the opening weekend of a film, the WOM score reflects the audience feedback on the content alone, irrespective of the marketing or the distribution of the film.

    Sajid Nadiadwala developing Judwaa franchise

MUMBAI: Sajid Nadiadwala has plans to develop an entire Judwaa franchise, with every subsequent chapter featuring a different leading man.

Confirming the news Nadiadwala said, ” I will indeed be making a series of Judwaa films. But the whole idea is to have different actors playing double roles every time. Like after Salman in Judwaa, it is Saif in Judwaa 2. Similarly, I will have an actor who havsn‘t played double roles before in Judwaa 3 and so on.”

Word is going around that Ranbir Kapoor has agreed to play the lead in Judwaa 3.

Explaining as to why did he take so long to come up with the sequel of the Salman Khan-starrer, Nadiadwala said, “”After Judwaa, I waited for a long time for the same Salman-David Dhawan team to come up with a winning sequel. That was a tactical error and the franchise got stuck in a creative deadlock until Sajid decided he would carry the ‘Judwaa’ concept forward.”

Sajid Khan will direct Judwaa 2 that is expected to go on the floors later this year.
