  • Star-TRAI case hearing in Madras High Court starts

    NEW DELHI: Final hearing commenced in the petition by Star India and Vijay TV challenging the jurisdiction of Telecom Regulatory Authority of India to issue tariff orders on the ground that content came under the Copyright Act.

    Although the Supreme Court had in early May while staying the tariff order directed the Madras High Court to complete hearing within four weeks, the high court had earlier this month listed matter to come up for today.

    Heeding the directive of the apex court to hear the matter on a day-to-day basis, the hearing which commenced today will continue for another two or three days until it is concluded.

    The hearing in the court was today confined to hearing the counsel for Star India who is expected to continue tomorrow as well. This will be followed by counsel of the TRAI and the Union of India.

    Meanwhile, TRAI TV reference interconnect offer (RIO) and Quality of service order (QoS) came into effect from 2 May following the order of the High Court.

    Although the high court chief justice Indira Banerjee and Justice M Sundar had listed the matter for 12 June, it issued directions before that date that the matter would come up today (on Tuesday).

    In the hearing in April-end, it had said Section 3 of the Tariff order and all other consequences of such implementation/enforcement would be subject to the outcome of the main petition.

    Apart from the Tariff order which had originally been issued on 10 October last year, the regulator also issued the DAS Interconnect Regulations which had been issued on 14 October last year, and the Standards of Quality of Service and Consumer Protection (Digital Addressable Systems) Regulations which had been issued on 10 October last year.

  • MSOs upload channel capacity & RIO, AIDCF requests b’casters too

    MUMBAI: Multi-system-operators (MSOs) in India which fall under the aegis of All-India Digital Cable Federation (AIDCF) yesterday night uploaded their RIO, channel carrying capacity and interconnect agreements on their respective websites. AIDCF, a few days back, had advised its member-MSOs to upload the same before the deadline set by TRAI.

    It is not clear when or whether broadcasters will follow TRAI guidelines and upload RIO on their respective websites.

    In this digital era, MSOs are now ready to pass on the benefits of the new tariff order to 120 million viewers of TV channels.

    The new set of Tariff and Interconnect Regulations issued by TRAI will help in creating a level playing field for all the stakeholders, specially the end viewers who will now have complete freedom at their disposal. It will also help in bringing more transparency and fuel growth by regulating and balancing the entire broadcasting eco-system.

    AIDCF, once again requests all the Broadcasters to upload their RIO on their websites without any further ado, as the deadline for the same has already expired.

    they have already uploaded their RIO, Channel Carrying Capacity and

  • SPN India-SITI Networks dispute: TDSAT directs SITI to sign SPN RIO agreement (updated)

    MUMBAI: In a dispute between cable TV MSO SITI Networks and Sony Pictures Networks (SPN) India, the Telecom Disputes Appellate Tribunal (TDSAT) has ruled that the former should sign the existing reference interconnect Offer (RIO) of the latter.

    SITI Networks had approached the arbitrator saying that India’s leading broadcast network was threatening to disconnect its signals from it. And that it was imposing an “unjustified subscription fee hike” to renew its channel carriage agreement with it. This at a time when the nation is under the spell of SPN India’s biggest property the highly popular and most watched Indian Premier League (IPL).

    The MSO’s counsel appealed to the tribunal that SITI should be permitted to avail of the signals of the channels of SPN India on the same terms and conditions of the expired agreement till the latter publishes a new reference interconnect offer (RIO) as per the new TRAI regulations.

    SPN India’s counsel retaliated by saying that the MSO cannot seek an entitlement to the earlier subscription rates of the expired agreement for the former’s channels as its subscriber base had grown and the broadcast network deserved an increase in subscription fees.

    SPN India’s counsel further argued that since there is no valid agreement, the signals to SITI Networks platform should be disconnected unless the MSO executed the existing RIO as per the TRAI regulations.

    The TDSAT then directed SITI Networks to sign the existing SPN RIO within one week of the order (to avoid disconnection of signals) and with a provision to switch to the new RIO once the same is published as per the new TRAI regulations.

    The tribunal also asked both SITI Networks and SPN India to submit their detailed statements of accounts within the next 10 days so that it could help them settle their dispute on outstanding dues.

    Even as SPN India claimed that it had won a favorable order from the tribunal (no official comment was, however, available from it), a SITI Networks official spokesperson responded to indiantelevision.com saying that the “unjustified hike in subscription fees demand has been turned down by TDSAT and the court has directed to sign the agreement on a RIO basis in accordance with the prevailing regulations.”

    In addition to this, SITI Networks also appeared pleased that the tribunal has “asked the parties to submit their statement of accounts and the related invoices in reference to the outstanding issue.”

  • TRAI notifies tariff order implementation from 2 May, RIO in 60 days

    NEW DELHI: In keeping with the letter submitted to the Madras High Court earlier this week, the Telecom Regulatory Authority of India today issued an amendment to its tariff order extending the date for bringing it into force to 2 May 2017.

    Following the extension letter, both Star India and Vijay TV had not pressed their plea for extension.

    The Telecommunication (Broadcasting and Cable) Services (Eighth) (Addressable Systems) Tariff Order 2017 had been issued on 3 March 2017 to provide the tariff framework applicable to broadcasting services relating to television provided to subscribers, through addressable systems, throughout the territory of India.

    Clause 3 of the principal Tariff Order was required to be implemented after thirty days from the date of its publication in the Official Gazette.

    TRAI also said that with the notification today, the Regulation 7(1) of the Telecommunication (Broadcasting and Cable) Services (Addressable Systems) Interconnection Regulations, 2017 relating to publishing RIO within 60 days from the date of publication of regulations comes into effect foday.

    TRAI received representations from some stakeholders wherein it is mentioned that section (b) of sub-clause (3) of clause 1 of the principal Tariff Order stipulates that clause 3, which mandates that broadcasters have to declare the nature and MRP of pay channels will come into effect after 30 days from the date of publication of this Order in the Official Gazette.

    Stakeholders also mentioned that it is not clear where will broadcasters declare the nature and rates of channels as RIOs are required to be published within 60 days. They requested the Authority to remove the ambiguity with regards to schedule for declaration of nature and MRP of pay channels; and publishing of RIO.

    TRAI said in order to harmonize the provisions relating to implementation of the clause 3 of the principal Tariff Order and regulation 7(1) of the Telecommunication (Broadcasting and Cable) Services (Addressable Systems) Interconnection Regulations, 2017, the dates of the principal tariff order have been re-determined.

    In addition, Clause 10 has been amended as it mistakenly referred to the tariff order of 2010.

  • Discounts by broadcasters to be part of RIO to ensure transparency: TRAI

    NEW DELHI: In an effort to address the concerns of stakeholders, all broadcasters have been given the freedom to publish their reference interconnect orders (RIOs) encompassing terms and conditions that are clearly known to the distributors / multi-system operators.

    The Telecommunication (Broadcasting and Cable Services) Interconnection (Addressable Systems) Regulations 2017 notified by the Telecom Regulatory Authority of India has also mandated a time-bound framework for interconnect orders.

    A cap has been put on discounts offered by broadcasters to DPOs to ensure that the subscriber gets realistic maximum retail price. Furthermore, these discounts have to be objectively defined in the RIO.

    TRAI said this is expected to bring in level playing field and effective competition in the sector. While doing this, adequate flexibility and freedom has been   provided to service providers for innovation and business ingenuity in offering their services.

    Transparent and non-discriminatory access to all types of distribution networks have been brought under the   regulatory framework. Besides mandating a framework of  RIO  for  charging of  carriage fee  on   transparent basis, a cap on  the  rate at which a DPO  can  charge carriage fee has been  prescribed. Further, it has also been provided that the carriage fee shall change with the change in subscription level of channels. In this way, entry for new channels in the market has been made predictable.

    Other features include a common regulatory framework for all types of TV distribution platforms providing services through Addressable Systems; availability of signals to   service  providers on  non-exclusive  and non­discriminatory basis;  and ensuring  access  to   the    distribution  networks  for   re-transmission  of  TV channels on  all   types of  distribution  platforms on   non-exclusive and non- discriminatory basis.

    The broadcasters and distributors will devise and design their RIOs for providing signals of TV channels and access to the distribution networks respectively, in conformance with the regulations and the tariff orders notified by the Authority, and declare the same.

    There will be a time bound provisioning of signals of TV channels & access to the network on the basis of transparent RIO framework.

    All Interconnection agreements will be signed between broadcasters and distributors on the basis of RIO.

    MUMBAI: A new subsea cable will connect Singapore to Mumbai on India’s west coast. Apart from this one, cable entrepreneur Sunil Tagare recently announced another new subsea cable project, designed to connect Marseille to New York directly.

    Without giving funding details, Tagare, in LinkedIn posts, stated that his company Sing-India-Sing Cable would bypass India’s Reference Interconnection Offer (RIO) rules. It would land in an open cable station in Mumbai where the RIO charges would be zero and any carrier would be able to access the cable landing station, he added.

    On the Mumbai-Singapore cable, Tagare said that he would sell only full fibre pairs, but on the Marseille-New York cable you could buy a full, half or a quarter fibre pair and have complete control over upgrades and your equipment.

    And, Tagare, who has a record in cable projects, stated that Open India would also be an internet exchange where customers could freely choose the carriers and create real competition on the ground.

    In 1989, Tagare began the privately financed Fiber Optic Link Around the Global (Flag), which Verizon sold to Reliance Communications; now called as Global Cloud Xchange. Tagare, who quit Flag Telecom in 1996, later founded Project Oxygen cable project unrelated to the current Google operation of a similar name. He later established BuySellBandwidth capacity trading business.

    Tagare’s NY project will be called Brexit-1, he declared. It would connect over a dozen cables landing in Marseille from the Middle East, India and Asia to New York bypassing the United Kingdom, he added.

    It would be the lowest latency cable between Marseille and New York, he professed, adding, with the chaos around Brexit, it was virtually impossible to know how it would shake out over the next few years. The best bet right now was to avoid the UK totally.

    Brexit-1 cable has been designed to run through the Straits of Gibraltar, a decision that has set off a discussion online. Tagare said that route diversity was a critical element of network planning. Almost half a dozen cables already traversed the Straits of Gibraltar. Burying the cable would also enhance security.

    In his blog, Tagare stated:

    “The first cable will be a direct cable linking Mumbai, India to Tuas, Singapore called Sing-India-Sing. The second cable is called Brexit-1.

    I believe that India represents the biggest opportunity for new submarine cable deployment. The only reason it has lagged behind the rest of the world is the arcane RIO (Reference Interconnection Offer) regulations that enabled carriers to charge atrocious access charges. This was reflected in IP Transit rates more than an order of magnitude higher than those in Europe and the US — thereby significantly hurting businesses in India.

    So, recently, TRAI won a court case filed by Tata Communications and Bharti Airtel which now will force the carriers to drop their RIO charges by 90%. And TRAI is not done. It wants to pursue this further and get the carriers to drop the RIO charges by 98%.

    But as anyone who has done business in India knows, RIO is just one problem faced by customers. Basically, it is almost impossible to move between carriers for lack of Internet Exchanges. So you end up with having no choice from a practical perspective.

    It is quite possible you may not need a full fiber pair to India right now but if the price you are paying for a full fiber pair is equivalent to a handful of 100G circuits today, what difference does it make? The minimum speed per fiber pair will be 10 Tbps.”

    NEW DELHI: Indian broadcast regulator came out today with its third set of draft guidelines within five days — this time on interconnection issues. With an aim to bring about more uniformity and transparency in the broadcast carriage sector, TRAI attempts to tackle spiralling carriage cost, rampant discount schemes and uneven agreements between stakeholders, while creating room for distribution cost reimbursement.

    As often reiterated by the Telecom Disputes Settlement and Appellate Tribunal (TDSAT), TRAI said no broadcaster will provide signals of pay television channels to a distributor of television channels without entering into a written interconnection agreement with such a distributor of television channels.

    In the draft regulations, called the Telecommunication (Broadcasting and Cable Services) Interconnection (Addressable Systems) Regulations, 2016, published by TRAI today, the regulator said all broadcasters and distributors (DPOs) will publish on their websites a draft reference interconnection offer (RIO) for providing signals of all its pay television channels to a distributor of television channels within 30 days of commencement of these regulations or before launching of a pay television channel, in conformance with the provisions of the regulations and tariff orders notified by it.

    It also said that every broadcaster shall offer all television channels on a-la-carte basis to distributor of television channels. But it will be open to a broadcaster to offer its pay channels (in addition to offering of channels on a-la-carte basis) in form of bouquets.

    The draft inter-connect guidelines have been prepared after keeping in view the various orders and litigations pending in TDSAT or courts arising out of disputes between broadcasters and distributors or local cable broadcasters.

    Stakeholders have been asked to respond to the draft by 28 October 2016, with the year-end deadline for the final switch-off of analogue signals under the Digital Addressable Systems (DAS) less than three months away.   

    Interestingly, TRAI also dwells on carriage & placement fee — something that broadcasters have been saying is a growing menace hitting their bottomline — and discounts indicating how the issue can be tackled. 

    No carriage fee is to be paid by a broadcaster if the subscription of the channel is more than or equal to 20 per cent of the subscriber base. The rate of carriage fee has been capped at 20 paisa per channel per subscriber per month and the fee amount (charged by DPOs from TV channels) will decrease with increase in subscription numbers.

    In what could lead to some serious work in arithmetic, TRAI has suggested the distributors of TV channels may offer discounts on the carriage fee rate declared by them not exceeding 35 per cent of the rate of the carriage fee declared. Further, broadcaster can offer to a distributor a minimum of 20 per cent of the maximum retail price (MRP) of its pay channels or bouquets of pay channels as distribution fee. TV channels may also offer discounts on the MRP, provided that the sum of discounts and distribution fee in no case shall exceed 35 per cent of the declared MRP.

    The carriage fee payable by a broadcaster to the distributor under the interconnection agreement shall be calculated on the basis of the rate of carriage fee and the discounts offered in the reference interconnection offer. The term of the interconnection agreement will in no case be less than one year from the date of commencement of the agreement.

    The Authority suo-motu or otherwise may examine the reference interconnection offer submitted by a distributor of television channels and may modify the reference interconnection offer with the distributor amending the RIO accordingly and publish the same within fifteen days of receipt of the direction, if the Authority is of the opinion that the RIO has not been prepared in conformance with the provisions of the regulations and the tariff orders notified by the Authority.

    Pointing out that the new draft has attempted to keep the basic principles of non-exclusivity, non-discrimination, transparency, level playing field and fair competition in mind, TRAI said there should be a common interconnection framework for all addressable systems, DTH, HITS, DAS and IPTV.

    The “Must carry” provision for all addressable systems on first come first serve basis has been provided for and distributors have been asked to publish information about its platform, including available capacity and declare the rate of carriage fee.

    It will be mandatory for service providers to reduce the terms and conditions of all their interconnection agreements to writing and no service provider will provide for any clause in an interconnection agreement with the other service provider which would require, directly or indirectly, the latter to pay a minimum guaranteed amount.

    Furthermore, no broadcaster will provide signals of pay television channels to a distributor of television channels without entering into a written interconnection agreement with such distributor of television channels.

    The regulator said no broadcaster will provide for any clause, directly or indirectly, in an interconnection agreement with a distributor of TV channels which require such distributor to include the channels or bouquets of pay TV channels in any particular bouquet of channels offered by such distributor to the subscribers.

    A broadcaster may sign the interconnection agreement with distributors of TV channels for a-la-carte pay TV channels or bouquets of pay television channels of its subsidiary company or holding company or subsidiary company of the holding company which has obtained, in its name, the down-linking permission for its television channels from the Government, after written authorization by them.

    Every broadcaster will enter into a new written interconnection agreement with distributors of TV channels before the expiry of the existing interconnection agreement and notice of this will be given to the distributor at least 60 days prior to the date of expiry.

    The agreement between a broadcaster and a multi system operator (MSO) will include the details for describing the territory for the purpose of distribution of signals of television channels containing the registered area of operation of the MSO as mentioned in the registration granted by the Government. Provisions relating to territory covered or agreements between an MSO and LCO will not affect the direct-to-home platforms.

    It will be mandatory for service providers to reduce the terms and conditions of all their interconnection agreements to writing and no service provider will provide for any clause in an interconnection agreement with the other service provider which would require, directly or indirectly, the latter to pay a minimum guaranteed amount.

    Furthermore, no broadcaster will provide signals of pay television channels to a distributor of television channels without entering into a written interconnection agreement with such distributor of television channels.

    The regulator said no broadcaster will provide for any clause, directly or indirectly, in an interconnection agreement with a distributor of TV channels which require such distributor to include the channels or bouquets of pay TV channels in any particular bouquet of channels offered by such distributor to the subscribers.

    A broadcaster may sign the interconnection agreement with distributors of TV channels for a-la-carte pay TV channels or bouquets of pay television channels of its subsidiary company or holding company or subsidiary company of the holding company which has obtained, in its name, the down-linking permission for its television channels from the Government, after written authorization by them.

    Every broadcaster will enter into a new written interconnection agreement with distributors of TV channels before the expiry of the existing interconnection agreement and notice of this will be given to the distributor at least 60 days prior to the date of expiry.

    The agreement between a broadcaster and a multi system operator (MSO) will include the details for describing the territory for the purpose of distribution of signals of television channels containing the registered area of operation of the MSO as mentioned in the registration granted by the Government. Provisions relating to territory covered or agreements between an MSO and LCO will not affect the direct-to-home platforms.

    NEW DELHI: The maximum retail price of a general entertainment television channel under the digital addressable system cannot exceed Rs 12 and that of a sports channel cannot go above Rs 19, according to the draft of the DAS tariff order issued by the Telecom Regulatory Authority of India.

    The maximum prices of other genres are: movies – Rs 10, infotainment – Rs nine, kids – Rs seven, news and current affairs – Rs five, and devotional – Rs three.

    Even as the TRAI permitted broadcasters to offer bouquets if they wish to, it has said that the total price of the bouquet will not exceed 85 per cent of the total individual price of each of the channels in such a bouquet.

    Furthermore, as consumers are often unsure of the fact that free to air channels are not be charged, the Authority has decided that bouquets of pay channels and FTA channels have to be separate — there can be no bundling of pay and FTA channels both, at the broadcaster as well as at the distributor of television channels level, as it will help to reduce forced bundling of packages with FTA channels in view of fixed fee/CPS deals being executed by the broadcasters. The Tariff order states that broadcasters will have to qualify a channel as a pay TV or a free channel.

    All stakeholders have been asked to respond to the tariff order draft by 24 October, after which TRAI will form its final opinion and issue the Telecommunication (Broadcasting and Cable Services) (Eighth) (Addressable Systems) Tariff Order 2016.

    The maximum retail price of a pay channel transmitted in SD format in a given genre shall not exceed the rate specified for such genre.  

    The maximum retail price of a pay channel transmitted in HD format shall not be more than three times the maximum retail price of corresponding channel transmitted in SD format, But if the corresponding SD channel of a HD channel is not available, the maximum retail price of such HD channel shall not exceed three times the rate specified for corresponding genre.

    The ceiling on maximum retail price shall apply to all the existing pay channels as well as to new pay channels that are launched or converted from free to air channel to pay channel after the commencement of this tariff order.

    In the new framework, the number of genres has been reduced to 7 from existing 11. Some of the existing genres have been grouped together to form a new genre, while some genres have been retained.

    In case a genre has been retained as it is, the maximum retail price of a channel to the customer in that genre will be 1.20 times the existing price cap for that genre for addressable systems. In case, multiple genres have been clubbed to form a new genre, maximum retail price of a channel in that genre to the customer will be 1.20 times the existing price cap of that genre which has the highest price cap for addressable systems.

    Meanwhile, TRAI also issued a draft of the Standards of Quality of Service and Consumer Protection (Digital Addressable Systems) Regulations, 2016 and wanted stakeholders to react to these by 25 October 2016.

    The broadcaster will have to ensure that the maximum retail price of such bouquet of pay channels in a relevant geographical area shall be uniform for all distribution platforms in that area; that it should not contain any free to air channel or HD or SD variants of the same channels or any premium channels.

    The Q of S Regulations have addressed almost every aspect of the cable TV ecosystem going forward fixing the responsibility of the broadcaster, the cable TV platform, the distributor and consumer. It covers everything from subscriber management systems to disconnection and reconnection of services to a la carte pricing to package pricing to the tariffs that can be charged by cable TV operators, MSOs, and broadcasters to billing to creating consumer awareness about DAS. 

    Referring to the discussions it held with stakeholders, TRAI says the Authority had prescribed a genre-ceiling subject to inflation linked hikes. All the channels have to prescribe channel rate in accordance with the applicable genre-ceilings in non-addressable and addressable systems.

    Some broadcasters had submitted that they agree with genre-wise pricing, maximum and minimum defined for channel pricing with regular revision of caps from time to time.

    Broadcasters have also submitted that the price cap should be based on channel popularity, number of channels in a particular genre and actual viewership based on distributor of television channels disclosures. They have further opined that a maximum of 33% discount on wholesale price across all genres must be allowed with the frequency to revisit genre ceilings be 1 to 2 years.

    A majority of the distributors of television channels have submitted that the price caps may be determined by TRAI using the existing commercial agreements data filed with TRAI.

    According to them, one such method to arrive the genre-wise price caps can be a simple average of current RIO rates of channels in a genre. Most of the distributors of television channels have further submitted that there exists and inverse relation between price of a channel and popularity-viewership. As a-la-carte rates increase, penetration of the channel decreases thereby decreasing ad-revenue. They are of the opinion that a maximum of 40-50% discounts should be allowed on the RIO rates for fair and non-discriminatory pricing of channels to all the distributors of television channels. They further suggested that the frequency to revisit genre ceilings may be 1- 5 years.

    The existing framework for genre ceiling is working well. Therefore in order to have continuity, the Authority is of the view that existing genre ceiling should continue. However, in the new framework, broadcasters will provide distribution fee of 20% on the MRP to distributors of television channels. Accordingly, the Authority has proposed a new genre-ceiling for MRP to customers with adequate scope to cater for additional business margins at 20% of the existing genre ceilings for addressable systems. It is expected that the prices will be regulated by the market forces based on the demand of channels or TRP.
