    TRAI gives more time for responses on infrastructure sharing for TV distribution

    NEW DELHI: Even as the Telecom Regulatory Authority of India extended to 4 July the deadline for its pre-consultation paper on infrastructure sharing in broadcasting TV distribution sector, it is yet to receive a single response on its paper on ‘Net Neutrality to ensure National Security and Customer Privacy’ despite an extension of date to 5 July.

    However, a reproduction of a summary of the pre-consultation paper on Net Neutrality on mygov.in has elicited around 80,000 responses from consumers.

    The paper on infrastructure sharing assumes greater importance with the regulator having issued a paper on opening up the Digital Terrestrial Transmission – a domain so far of Doordarshan – to private television channels.

    While the pre-consultation on Infrastructure sharing was issued on 23 May and the deadline for responses was 23 June, the paper on Net Neutrality was issued on 30 May seeking conments by 21 June.

    In its paper on Infrastructure sharing, the regulator wanted to know from stakeholders what could be the operational, commercial, technical and regulatory issues which require to be addressed at the time of developing policy and regulatory framework for enabling infrastructure sharing in the broadcasting TV distribution space.

    TRAI also asked whether stakeholders envisage any requirement for change in the existing licensing/registration framework laid for DTH, DAS and HITS broadcasting services.

    The regulator wants to know what more can be shared by the distributor platform operators (MSOs, HITS, DTH) for better utilization of infrastructure.

    TRAI said the pre-consultation paper had been issued with an aim to solicit stakeholder’s views on issues related to sharing of infrastructure on voluntary basis and separation of network and service provider functions so as to reduce cost of distribution of services and enhance competition in respect of all type of TV distribution platforms.

    With mounting pressure from different quarters for and against net neutrality, TRAI in its paper on Net Neutrality wants to know what India’s policy should be and/or regulatory approach in dealing with issues relating to net neutrality

    India is one of the fastest growing information and communication technologies markets in the world, fuelled largely by the cellular mobile revolution. Starting from a few million connections in 1997, there are more than a billion connections, with 97.5% of them being wireless subscribers. With this, the overall teledensity in India at the end of 2015 stood at 81.83%.

    India has also witnessed tremendous growth in terms of the total number of Internet users. At the end of December 2015, there were over 331 million Internet subscribers in the country, of which about 94% (over 311 million) were wireless Internet users.

    The current nature of telecommunications and internet access services in India is therefore largely wireless. The number of broadband users has also been increasing steadily over the years. At present, India has approximately 136.5 million broadband subscribers, a figure that is expected to rise significantly in the coming years, particularly in light of the Government’s ‘Digital India’ initiative.

    This initiative emphasizes the electronic delivery of services to all citizens as an urgent national priority, with ‘Broadband for All’ as one of its fundamental pillars. Providing broadband to all will require a significant expansion of service providers’ networks, with substantial investments in infrastructure development.

    NEW DELHI: Given the complicated issues around net neutrality, stakeholders have now been given more time to reply to a consultation paper on Free Data which also touched on this subject.

    Comments on the paper, issued by the Telecom Regulatory Authority of India on 19 May 2016, will have to be sent by 30 June 2016 with counter-comments on 14 July 2016. The earlier dates were 16 June and 30 June respectively.

    Stretching the discussion on net neutrality, TRAI had wants to know whether there is a need to have TSP agnostic platform to provide free data or suitable reimbursement to users without violating the principles of Differential Pricing for Data laid down in TRAI Regulation.

    It also wants to know if free data or suitable reimbursement to users should be limited to mobile data users only or could it be extended through technical means to subscribers of fixed line broadband or leased line.

    The paper says that in the recent past, some data services plans of the Telecom Service Providers (TSPs) came to the notice of TRAI which amounted to discriminatory tariff through offering zero or discounted tariffs to certain contents of certain websites/applications/platforms. The objective of offering such plans was claimed to be the desire of various service providers/content providers or platform providers to enable people of this country, especially the poor, to access certain content on the internet free of charge.

    Net Neutrality: Reactions from the consumers provide deep insights

    NEW DELHI: Issues relating to OTT and net neutrality have been in the news for almost two years now and the Telecom Regulatory Authority of India (TRAI), which had earlier issued a paper on Over-the-top (OTT) apps, came out with a paper on Net Neutrality on 30 May 2016.

    TRAI’s frequent revisiting of the Net Neutrality issue highlights the fact that the regulator is under immense pressure from various stakeholders with diverse interests. TRAI had first issued a consultation paper over 18 months back and had also passed an order — hotly contested by telecom companies— banning differential pricing floated by some telcos recently, which had sounded the death gong for Facebook’s FreeBasic in India.

    However as the TRAI website is seen generally only by those in the broadcasting or telecom sectors, a brief summary of TRAI’s pre-consultation paper has been placed on the mygov.in so that the general public can react and send in their feedbacks.

    As a result, over 73,000 posts have already come on this site from the general public who have unanimously supported net neutrality. Some have gone to the extent of asking why TRAI or the government should ask this question.

    Though indiantelevision.com firmly believes that at times the debate in India over Net Neutrality has been shrill and has clouded real and serious aspects of neutrality, there are some interesting feedbacks as well that indicate how general Indians view Net Neutrality.

    For example, one writer says: “TRAI focus should be broadband speed minimum 50MBps Download/ 25MBps Upload. There should be no pollution, so focus on fiber/copper with speeds of up to 10GBps (ten GBps) and ensure that latency is very low, connectivity is much better (speed and latency are different).”

    The same respondent points out that companies are offering 5GB on 4Mbps for high prices up to Rs 900 and data caps should be removed or have minimum of 1TBps. He has said that lease lines should be made affordable with customer support.

    Says another respondent: “I cannot imagine an India as net partial with a discriminatory telecom structure not letting me call my kin freely, surf net with discrimination. The Governments needs to recall and emulate Dr Ambedkar’s ideas, the esteemed voice of freedom and non-discrimination of free India.”

    Yet another individual says: “In the name of neutrality. Let us not stop access of net to one billion Indians. Many pay phone/net data bills (simply by transferring data) higher than electricity bills (which is consuming energy, which is costlier to produce). Let the government ensure that data service is affordable to all.”

    Another consumer says, “We want freedom to choose and not Internet Service Provider choosing for us. There is also stress on removing corruption which can be done by removing interest on security deposit, seven days extra charge after disconnection refund, towers on house and low heights.”

    Yet another respondent commented: “Without net neutrality, internet would go into the hands of people who can pay the ISPs to give their websites for cheaper price. This will hamper start-ups and other small players who cannot afford to pay the ISPs. For a thriving economy, it is important to have competing players in market. In the absence of net neutrality, this competition will be disrupted and monopoly will be established — which is not good for the consumers.”

    But the responses are not confined to just plain feedbacks, and some people have also tried to support their theories and assertions.

    A respondent has attached a presentation with diagrams to say,  “Internet traffic and congestion on network problem can be sorted out by dividing the network into logistic small segments. These small logic segments can have their unique set of protocols, which when connected with the large network enable it to tackle with security and cyber issues as well as enable the large network to tackle the Internet traffic and congestion issues.

    “The logical small segments should be designed and implemented in way so that they can be extended with the increase of customers as well as data demand on that network. The core of the large network can be designed/assembled in a way that its data limitations can be extended with demand (Same technique can be apply on the logistic small networks).”

    The person, who seems to have some understanding of technology and its functioning, adds that designing/assembling and implementation of smart networking system will lead to a major step for providing a standard Internet facility to the individuals, having fixed rate data plan with standard accessibility and speed of the Internet facility. The diagrams show one of a road where the light poles have small boxes to pass the Internet signal from one to the next.

    Incidentally, the original pre-consultation paper on net neutrality issued by TRAI on 30 May 2016 is available at http://www.trai.gov.in/Content/ConDis/20775_0.aspx  on the regulator’s website does not still have any comments uploaded on the issue.  The last date for submission of comments is 21 June 2016.

    He said the need was to have the vast majority of Indians, over a billion, who are still not on the internet. There is a need to deliver affordable internet access for the common man.

    “More importantly, despite the boom in smartphone penetration, studies show over 62 percent of customers with 3G enabled devices, are not activating data plans.”

    He said DataWind intends to bring the world’s most affordable internet access to India, using it’s patented technology. DataWind firmly believes that this digital and internet divide can be addressed through technology intervention, at an affordable price for this segment of customers. It is focused on driving the cost downward to a level where access to technology becomes ‘universally affordable’ and democratization of technology finds its true meaning.

    TRAI to give its views on net neutrality soon, govt confident of achieving total digitization by year-end

    New Delhi: The Telecom Regulatory Authority of India is expected to come out with its final views on net neutrality in ‘a couple of months’, its chairman R S Sharma said today. He said that the Department of Telecom had sought a comprehensive view on net neutrality.

    Speaking at the CASBAA India Forum 2016, he said TRAI had a month earlier ruled against Facebook’s Free Basics programme, upholding net neutrality and leaving a level playing field for all players. “No service provider shall offer or charge discriminatory tariffs for data services on the basis of content,” the TRAI said in the order on discriminatory pricing of data content.

    “No service provider shall enter into any arrangement, agreement or contract, by whatever name called, with any person, natural or legal, that has the effect of discriminatory tariffs for data services being offered or charged to the consumer on the basis of content,” the order said. The matter came to a head when Airtel decided to charge separately for Internet-based calls, but withdrew its plan later after facing public protests.

    He admitted that the regulations had not addressed various other concerns related to net neutrality in India but said TRAI had issued a consultation paper on the subject and also received various responses from both broadcasters and telecom service providers.

    Sharma acknowledged the challenges and opportunities as the country witnesses the fourth phase of Digital Addressable System (DAS). He said, “TRAI is not here to promote legacy systems in cable TV where a structural monopoly exists. With the objective of providing the right of choice to the consumers, we will allow the march of technology. At the same time, for healthy growth of the sector, it is crucial to strike the right balance between all the stakeholders through a constructive dialogue.”

    Taking lessons from the evolution of the telecom industry, Sharma urged the stakeholders in broadcasting to actively collaborate on issues like ‘infrastructure sharing’ and ‘set-top boxes’. “Today five or six telcos are willing to share one mobile tower showing how sharing and competition can go hand in hand. This can materialise in the broadcasting space as well. While TRAI has no plans to make infrastructure sharing mandatory, it may tweak the existing licensing system to provide support to the stakeholders who are interested in the idea,” he added.

    The issue of interoperability of the set-top box was discussed at length and TRAI’s S K Gupta stressed on the importance of pushing the use of a common set-top box by different operators. He pointed out that cost of procuring and maintaining set-top boxes weighs heavily on the balance sheets of MSOs, LCOs and digital TV companies. He also said that interconnected agreements between LCOs and MSOs can give two-way cable networks to the end users.

    Information and Broadcasting Ministry Joint Secretary (Broadcasting) R Jaya said “Phase IV of cable TV digitization is one of the most prominent routes to broadband connectivity which is key for providing services to citizens. It is high time for the industry to understand the value of interconnect agreements.”  She also reassured that MIB will complete its cable TV digitization drive by the end of 2016.

    At a later session, TRAI principal adviser U K Srivastava said that the regulations were being prepared on the basis of the responses received. Addressing a session on whether OTT can make a dent in India, he said OTT was now driving telecom service providers. Regulations were therefore needed to prevent manipulation or misuse. He did not rule out the possibility of another consultation paper in view of changes in technology. Essentially, he said the process had to be open and inclusive.

    Answering a question, Srivastava said it was too early to talk about carriage fee etc., but the regulator would want to ensure that the consumer pays for the services he receives.   

    The forum examined the ripple effect of the country’s digitization initiative, bringing together all the stakeholders including multi-system operators (MSO), local cable operators (LCO), DTH players, satellite technology providers, and regulators, among others was Digital India: The Four Phases of Cable Enlightenment.

    CASBAA’S CEO Christopher Slaughter set the tone by establishing the relation between the digitization of the cable TV system in India and Prime Minister Narendra Modi’s Digital India campaign.

    Later Ministry Director (B and C) Neeti Sarkar said the ministry has minimal intervention on the content side of the broadcasting industry. “We have made our procedures smoother by allowing single window clearance at the time of launching a new channel. Having said that, there has always been room for dialogue with all stakeholders,” she said.

    TRAI advisor Sunil Kumar Singhal said that it is time to bring consumer at the centre stage and then create regulations. He said, “There is a trust deficit among stakeholders. In the last few years, significant investments have been made in the digitization drive. Now it is time for us to monetize these capabilities.”

    Ministry special secretary J S Mathur talked about the recent developments in the media and broadcasting industry. “At the Ministry, the pace of permissions has scaled up. In the first three phases of digitization, we covered 70 million (7 crore) households. We also realize the need for a broadcasting policy and are willing to have more related conversations with all stakeholders,” he said.

Addressing a session on whether OTT can make a dent in India, he said OTT was now driving telecom service providers. Regulations were therefore needed to prevent manipulation or misuse. He did not rule out the possibility of another consultation paper in view of changes in technology. Essentially, he said the process had to be open and inclusive.

    Answering a question, Srivastava said it was too early to talk about carriage fee etc., but the regulator would want to ensure that the consumer pays for the services he receives.   

    The forum examined the ripple effect of the country’s digitization initiative, bringing together all the stakeholders including multi-system operators (MSO), local cable operators (LCO), DTH players, satellite technology providers, and regulators, among others was Digital India: The Four Phases of Cable Enlightenment.

    CASBAA’S CEO Christopher Slaughter set the tone by establishing the relation between the digitization of the cable TV system in India and Prime Minister Narendra Modi’s Digital India campaign.

    Later Ministry Director (B and C) Neeti Sarkar said the ministry has minimal intervention on the content side of the broadcasting industry. “We have made our procedures smoother by allowing single window clearance at the time of launching a new channel. Having said that, there has always been room for dialogue with all stakeholders,” she said.

    TRAI advisor Sunil Kumar Singhal said that it is time to bring consumer at the centre stage and then create regulations. He said, “There is a trust deficit among stakeholders. In the last few years, significant investments have been made in the digitization drive. Now it is time for us to monetize these capabilities.”

    Ministry special secretary J S Mathur talked about the recent developments in the media and broadcasting industry. “At the Ministry, the pace of permissions has scaled up. In the first three phases of digitization, we covered 70 million (7 crore) households. We also realize the need for a broadcasting policy and are willing to have more related conversations with all stakeholders,” he said.

    MUMBAI: Everyone in the world should have access to the Internet says Facebook founder Mark Zuckerberg.

    Voicing his disappointment over Indian regulator – the Telecom Regulatory Authority of India’s (TRAI) decision, which upheld net neutrality and ruled against differential pricing of data services, Zuckerberg took to his social networking website and said, “Today India’s telecom regulator decided to restrict programs that provide free access to data. This restricts one of Internet.org’s initiatives, Free Basics, as well as programs by other organizations that provide free access to data.”

    With an aim to provide basic internet services to all, Zuckerberg launched Internet.org with many different initiatives — including extending networks through solar-powered planes, satellites and lasers, providing free data access through Free Basics, reducing data use through apps, and empowering local entrepreneurs through Express Wi-Fi.

    “While we’re disappointed with today’s decision, I want to personally communicate that we are committed to keep working to break down barriers to connectivity in India and around the world. Internet.org has many initiatives, and we will keep working until everyone has access to the internet,” he added.

    He added that with Internet.org, more than 19 million people in 38 countries have been connected through its different programs.

    “Connecting India is an important goal we won’t give up on, because more than a billion people in India don’t have access to the internet. We know that connecting them can help lift people out of poverty, create millions of jobs and spread education opportunities. We care about these people, and that’s why we’re so committed to connecting them,” he voiced.

    Zuckerberg said that Facebook’s mission was to make the world more open and connected. “That mission continues, and so does our commitment to India,” he said.

    It may be recalled that Facebook faced a lot of flak recently when it asked its users to support Free Basics via a poll. Free Basics has been criticised over grounds that it curbed people’s freedom to access the internet of their choice.
