    Limited punitive action taken against 31 TV channels in 11 years

    NEW DELHI: As many as 31 TV channels were asked to stop transmission for specific period of time ranging from one day to 60 days including news channel for 30 days between 2005 and 2016.

    Minister of State for Information and Broadcasting Ministry Rajyavardhan Rathore told the Parliament that 22 private television channels including one channel for three different programmes and another for two programmes were asked to suspend transmission for duration ranging from one day to 30 days for telecasting content in violation of the Programme Code during the last three years and the current year.

    This included 14 in 2013, one in 2014, four in 2015, and three in 2016 (till November), Rathore said.

    The three in the current year are — NDTV India and Care World India with one violation each, and News Time Assam for three violations. The orders relating to NDTV and Care World India have been challenged in the courts of law. Earlier, in 2014, Manoranjan TV was punished twice.

    The channels punished in 2014 and 2015 are — Enterr 10, Zing, Mahua, SS TV, AXN, FTV, Movies OK, Comedy Central, Zoom TV, ABN Andhra Jyoti, UTV Bindass, WB, NTV, Big CBS Love, Jai Hind, Al Jazeera, and Satlon News.

    Action is taken against TV channels whenever any violation of the Programme and Advertising Codes is noticed or brought to the notice of the Ministry. The Ministry generally issues warnings or advisories to comply with the Codes or asks the channels to run an apology scroll on their channel.

    But, Rathore said the channels are occasionally taken off air temporarily for a limited period depending on the gravity of the violation.

    BENGALURU: New Delhi Television Limited (NDTV) Television segment reported lower loss at Rs 3.94 crore for the quarter ended 30 September 2016 (Q2-17, current quarter) as compared to the operating loss of Rs 8.41 crore during the corresponding quarter of the previous year (y-o-y). The segment’s consolidated operating loss in the current quarter was just a fraction of the operating loss of Rs 22.83 crore in the immediate trailing quarter (q-o-q).

    Overall, the company reported almost flat y-o-y net loss after taxes of Rs 17.22 crore as compared to a loss of Rs 17.19 crore. Loss in the immediate trailing quarter was more than double at Rs 38.36 crore. NDTV attributes the improved performance to improved advertising revenues alongside lower costs in Convergence, NDTV’s digital content subsidiary and E-Commerce segment.

    NDTV’s consolidated Total Income from Operations (TIO, revenue) in the current quarter declined 4.9 per cent y-o-y to Rs 123.31 crore from Rs 127.60 crore, but increased 9.3 per cent q-o-q from Rs 112.81 crore.

    NDTV had negative EBIDTA (operating loss) of Rs 3.64 crore in Q2-17; negative EBIDTA of Rs 10.91 crore in Q2-16; and negative EBIDTA of Rs 26.78 crore in Q1-17.

    Segment numbers

    NDTV’s Television Media and related operations (Television) segment reported 3.4 per cent y-o-y decline in revenue in Q2-17 at 121.03 crore as compared to Rs 125.25 crore, but an 8.3 per cent q-o-q increase from Rs Rs 111.78 crore. The segment’s operating loss has been mentioned above.

    NDTV’s Retail/eCommerce (eCommerce) segment reported 19 per cent y-o-y decline in revenue at Rs 3.20 crore as compared to Rs 3.95 crore, but a 60 per cent q-o-q increase from Rs 2 crore in Q1-17.

    Let us look at the other numbers reported by NDTV

    Total Expenditure (TE) in the current quarter declined 9.4 per cent y-o-y to Rs 134.84 crore (109.4 per cent of TIO) from Rs 148.77 crore (116.6 per cent of TIO) and declined 8.3 per cent q-o-q from Rs 147.11 crore (130.4 per cent of TIO) in Q1-17.

    NDTV’s consolidated Production Expense (PE) increased 4.4 per cent y-o-y in Q2-17 to Rs 28.62 crore (23.2 per cent of TIO) from Rs 27.41 crore (21.5 per cent of TIO) and increased 1.9 per cent q-o-q from Rs 28.09 crore (24.9 per cent of TIO).

    The company’s Marketing, distribution and promotional expense (Marketing expense) in the current quarter reduced 35 per cent y-o-y to Rs 19.67 crore (16 per cent of TIO) from Rs 30.28 crore (23.7 per cent of TIO) and declined 13.3 per cent from 22.69 crore (20.1 per cent of TIO) in Q1-17.

    NDTV’s Employee Benefit Expense (EBE) in Q2-17 declined 5.1 per cent y-o-y in Q2-17 to Rs 45.19 crore (36.6 per cent of TIO) from Rs 47.63 crore and declined 21.9 per cent from Rs 57.86 crore (51.3 per cent of TIO).

    Operating and administration expenses (Admin expenses) in Q2-17 increased 10.5 per cent y-o-y to Rs 34.71 crore (28.1 per cent of TIO) from Rs 31.42 crore (24.6 per cent of TIO) and increased 4.7 per cent q-o-q from Rs 33.14 crore (29.4 per cent of TIO).

    Finance Costs in the current year increased 26.8 per cent y-o-y to Rs 6.63 crore (5.4 per cent of TIO) from Rs 5.23 crore (4.1 per cent of TIO) and increasd 56 per cent q-o-q from Rs 4.25 crore (3.8 per cent of TIO).

    NDTV India ban: SC to hear appeal on 5 Dec; govt may restructure review panel

    MUMBAI: It is not going to be easy to gag the freedom of press. NDTV India’s appeal against the one-day ban on its Hindi channel will be heard next month by the Supreme Court.

    NDTV has challenged the ban for violating the constitutional right to free speech and expression.

    Appearing for NDTV, Fali Nariman, one of India’s most reputed lawyers, said that, because the government has suspended the ban, there was no urgent need for the court to stay the government’s order that called for a 24-hour ban and that the case could be heard a month later, during which NDTV expects the government to take a final decision.

    The government on November 7 put on hold its order asking NDTV India not to telecast for 24 hours starting 9 November for allegedly flouting norms.

    The Supreme Court adjourned the hearing to December 5 as Attorney General Mukul Rohatgi told Justice A.K. Sikri that there was no real urgency as their plea (by NDTV) for review of the decision was being considered by the government.

    The ban was put on hold by the government after representatives of NDTV met with Information and Broadcasting Minister Venkaiah Naidu. NDTV reiterated that its Hindi channel did not broadcast sensitive details of the terror attack on the Pathankot air base.

    The information and broadcasting (I&B) ministry said it was weighing restructuring the inter-ministerial committee (IMC) which reviews cases of violations in the broadcast media. The ministry was facing criticism for directing NDTV India to go off air for a day.

    MIB puts NDTV India ban on hold until further notice

    MUMBAI: The twists and turns in l’affaire NDTV continue.  The ministry of information and broadcasting (MIB) late in the evening today issued another order stated that its earlier diktat banning Hindi TV news channel NDTV India for a day on 9 November 2016 is to be held in “abeyance until further orders.”  What this means is that NDTV need not pull the plug on its Hindi news channel for a day for violations during its coverage of  the Pathankot terrorist attack earlier this year.

    The reason the MIB has stated is that NDTV has made a representation to it , which it is currently examining. And until it does so fully, the earlier order prohibiting transmission or retransmission of NDTV India under the Cable TV Networks Regulation Act is on hold.

    Earlier today, the NDTV management approached the Supreme Court challenging the MIB’s directive.

    And NDTV co-founder and executive chairperson Prannoy Roy met with I&B minister Venkaiah Naidu later in the day exhorting him that his channel’s views on it had perhaps not been fully and adequately appreciated.  Roy also wanted the decision to be reviewed. Following this, a new order was issued by the MIB putting its earlier order on hold.

     “Clearly the Modi government and the MIB have both faced a lot of political heat on account of the ban. It probably had not idea how much of verbal artillery fire it would face from the fourth estate when it took its step to ban NDTV India,” says a media observer. “It’s good that the MIB is taking it as it comes and has retracted its order temporarily until it examines NDTV’s stand. At least it will be able to say it gave the network a chance to make its representation and redeem itself in the public’s eyes which is stating that harsh days are ahead for the media. That the era of the Indira Gandhi emergency is upon us.”

    Earlier today Zee group chairman and BJP MP  Subhash Chandra had said that the actions against NDTV were in order and that instead of a day long ban, a lifelong ban against it should be issued. He also added that even the Indian courts would not overrule the MIB verdict as it had threatened Indian security with its reportage.

The Ministry of Information & Broadcasting (MIB) had directed NDTV India to go off air for 24 hours from 9 November 2016 00:01 hrs as a penalty for showing strategically-sensitive information while covering the Pathankot military operation in January this year.

    In response, the company argued that it was not the only channel that disclosed the information for which it is being penalised. NDTV has petitioned the Supreme Court challenging the order.

    In a BSE filing, the news network said that it has filed a writ petition before the Supreme Court, inter-alia, challenging the constitutional validity of the said order, and the provisions of law pursuant to which the said order has purportedly been passed.

    The Editors Guild of India, the Broadcast Editors Association (BEA), the News Broadcasters Association (NBA) and several influential personalities such as Rajdeep Sardesai, Sagarika Ghose, Rana Ayyub, Rahul Kanwal, Praveen Swami, and journalists from the channel — Ravish Kumar, etc have shown solidarity towards the channel and have come up in full support against the government’s order. They have demanded its immediate revocation.

    Others such as Zee group chairman Dr Subhash Chandra have said that the government is being soft on NDTV and that the ban should be for a lifetime for daring to carry reports which could harm the country’s security. He additionally said on twitter that if the channel dares to go to court to challenge the ban, its appeal will be rejected.

    The blackout of NDTV India comes at a crucial time when the news channels, apart from covering the current affairs, will be providing extensive coverage of the US Presidential Elections 2016.
