    TRAI recommends no minimum entry net worth for MSO registration

    MUMBAI: The Telecom Regulatory Authority of India (TRAI) has recommended that there is no need to fix a minimum entry-level net worth for MSO registration. Moreover, it also added that there is no basis for introducing minimum net worth classification based on the area of operation for MSOs.

    TRAI on Monday released its recommendations on "Entry level net-worth requirement of multi system operators (MSOs) in cable TV services". Based on the written submissions of stakeholders and discussions in the open house discussions, recommendations have been framed by the regulatory body.

    Other recommendations include:

    ·         As the area-wise minimum net worth classification for registration of MSO is not required, there is no need to prescribe minimum net worth for remote areas of Jammu & Kashmir or North-East region.

    ·         The authority recommends that there is no merit in introducing minimum net worth for registration of MSOs based on network cost criteria.

    ·         The authority recommends that MIB may prescribe a standard proforma for self-declaration of net worth by applicants seeking registration as MSOs.

    ·         The authority recommends that MIB may consider skill development requirement of the sector and take appropriate action so that trained manpower is available to perform specialised tasks.

    The regulatory body issued a detailed consultation paper on "Entry Level Net Worth for MSOs in Cable TV Services" on 9 April. Post this, an open house discussion was held in New Delhi in June. The recommendations were finalised after looking at the comments received for the consultation paper and its own analysis.

    TRAI also mentioned that with the new regulatory framework in place, small and medium-size MSOs have it better.

    Earlier, TRAI also received a reference from Ministry of Information and Broadcasting (MIB) in 2018 seeking recommendations of the former on the appropriate levels for fixation of entry-level net-worth of the multi system operators (MSOs) for operationalising cable TV digitisation across the country.

    MUMBAI: The Ministry of Information and Broadcasting (MIB) has sought affidavits from both existing MSOs as well as fresh applicants that they are carrying all 24 DD channels, besides Lok Sabha and Rajya Sabha TV channels, on their TV network.

    The ministry has mentioned in the notice that in view of the contribution of Doordarshan towards dissemination of accurate information about policies and programmes of government, acceleration of socio-economic change, promotion of national integration and stimulation of scientific temper, it is mandated that all cable TV networks should carry DD channels.

    The ministry has noticed that the mandate is not being followed by several cable operators in contravention of existing rules. The ministry has also asked to submit the affidavit within one month of the issue of notice.

    Section 8 of The Cable Television Networks (Regulation) Act, 1995 states that cable operators will have to compulsorily include Doordarshan channels notified by the central government in the Official Gazette. The MIB also listed DD Arunprabha as a mandatory DD channel recently.

    MUMBAI: Cases have been filed in various courts across the country and while the Calcutta High Court has vacated the stay on the case and the Gujarat High Court has asked for a response from TRAI, the Bombay and Telangana courts are yet to decide on similar petitions.

    The Telangana HC reserved judgment on a case filed by local cable operators who said that the regulations are arbitrary. The Pune Cable Operators Association went ahead and challenged TRAI as well, asking for a stay on the lines of the Calcutta High Court order. The bench, however, asked them to submit a copy of the order and refused to provide relief.

    The Madras High Court dismissed the PIL against the TRAI tariff order last week by quoting the Supreme Court judgment that went in favour of the regulator late last year.

    On 14 January, a similar case before the Kerala High Court was also dismissed which related to the revenue sharing aspect as well.

    LCOs all over the country are up in arms against some suggestions that have been made in the new tariff regime by TRAI that came into effect from 1 February. After TRAI won the case against Star India in October, the regulator gave the industry time till December end to put things into action. This was later extended to 31 January which was confirmed to the last date and no more extensions would be granted beyond that.

    Two days ago, TRAI claimed that all the stakeholders were ready with the new regime’s requirements. It also praised itself for ensuring that a large number of customers had exercised their options.

    MUMBAI: Ministry of Information and Broadcasting (MIB), through Broadcast Engineering Consultants India Ltd (BECIL), is organising a conference of MSOs, the cable TV industry representatives, that will be held on 18 December in New Delhi. The discussions will pertain to several issues related to broadband services through cable TV networks.

    The aim is to discuss various issues as well as seek views of MSOs about feasibility, affordability, and ubiquity on the issue of broadband services through cable TV networks, infrastructure required for the same and modalities of payment and segregation of revenue earned for broadband activities.

    One of the major topics which will be in focus is the willingness of the operators to invest in the infrastructure required. The payment of 8 per cent adjusted gross revenue (AGR) as a fee to DoT, whether to be paid only on the broadband services or on overall revenue earned in respect of both the businesses will be also discussed. The need of creating a separate entity for broadband activities for segregation of the revenue earned on it will be also examined.

    As per the MIB release, the conference will see participation from major MSOs, MIB, DOT, TRAI and BECIL officials.

    NEW DELHI: The Telecom Regulatory Authority of India (TRAI) on Monday directed all distributors of TV channels and broadcasters to restrain with immediate effect from placing registered television channel, whose TV rating is released by ratings agency, on the landing page or the boot-up screen.

    The reason behind this order, according to TRAI, was to protect the interest of service providers and consumers while ensuring “orderly growth of the sector”.

    Though the TRAI diktat comes into effect immediately, the regulator has given some breather to stakeholders to become fully compliant by 31 March 2019 by making necessary changes in agreements that may have been already signed. However, distributors and TV channels have been asked to revert to the regulator with updates within seven days.

    Landing channel or landing page or landing logical channel number (LCN) refers to the default LCN that is displayed whenever a STB is switched on. TV channel placed on this page is available to all STBs connected to the network of a distributor and is regarded as a prized real estate by DPOs.

    During a consultation process on the issue, many broadcasters had admitted that placing a TV channel on the landing page could influence the audience data or TV rating points (TRPs), while MSOs and other distributors had stated there were no such influence on ratings or if any, they were minimal.

    TRPs, according to TRAI, indicate the popularity of a programme or a TV channel by providing information about the television watching habit (for example, time spent by a viewer on a particular TV channel) of viewers from different socio-economic backgrounds. In an environment that prevails in India, despite digitisation of TV services, advertisers and corporate media planners still depend on TRPs while budgeting media spend on television.

    The issue of landing page had cropped on when some stakeholders cried foul over a year back and the regulator had been forced to issue interim orders, which were challenged at the disputes tribunal TDSAT. Ministry of Information and Broadcasting too had directed BARC India , collators of audience data, to desist from including data from landing page channels for its overall weekly figures.

    MUMBAI: The Parliament’s Standing Committee on Information Technology and Communications (SCIT) has sent out a stern message to the stakeholders of India’s broadcast and cable industry, including the Ministry of Information and Broadcasting (MIB): get your acts together.

    BJP MP Anurag Thakur-chaired all-party parliamentary panel has been especially critical of MIB’s handling of country’s digitisation of TV services or digital addressable system (DAS). It pointed out that MIB could not “absolve” itself of “responsibility” of DAS implementation as it was the administrative ministry for media matters.

    It has exhorted the ministry to put in place a monitoring mechanism at the federal level at the earliest to coordinate with the authorised officers for tracking violations by operators and to also hold periodic meetings with the stakeholders concerned to ensure that the mandated cable TV digitisation process is enforced.

    Putting the onus on the ministry to persuade MSOs to complete seeding of consumer data in the cable TV operators’ management information systems at the earliest, the parliamentary panel has directed the government to ensure proper agreements are signed between stakeholders (broadcasters, MSOs and LCOs). MIB has also been directed to update the panel on the progress made by MIB and to take extreme step of even cancellation of MSO licence in case of non-compliance.

     Interestingly, the committee told the nodal ministry to take a final decision within a definite time period in the case of Tamil Nadu government-controlled MSO Arasu Cable in keeping with TRAI norms for MSOs seeking to provide digital service.

     Arasu has been seeking temporary extension of its licence saying it has been unable to fully seed its subscribers with STBs that were taking long to import. In separate recommendations made earlier — not yet accepted by the government — TRAI had suggested barring federal or state governments or its organisations from segments of broadcast and TV services’ distribution.

     The committee said that it expects MIB to address effectively issues raised in the complaints filed by some MSOs and LCOs in Tamil Nadu (mostly against Arasu) and that the ministry should revert within three months reporting the progress made.

    The committee, while suggesting infrastructure sharing for distribution platforms, urged the government to provide necessary resources or financial incentives to distribution platforms like MSOs who were aiming to provide services in rural areas. Its rationale: developing infrastructure individually may be a costly proposition for cable TV operators.

     Alive to number of litigations in the broadcast and cable sectors, the committee exhorted MIB and the government to explore having a dialogue with courts on the need to close early cases relating to TRAI’s new guidelines on tariff, QoS and inter-connect, which were issued in 2016 but challenged in Chennai and Delhi high courts by Star TV-Vijay TV combine and Tata Sky and Airtel Digital. Both the cases are still pending final verdicts from the courts.

    The committee has recommended that an option of pay-per-use, as made available by DTH operators to subscribers, be explored for cable TV too as it could give the consumer more flexible options.

    Finally, the committee has directed the MIB to do a formal cable TV digitisation impact assessment study including all its aspects to get a clear picture on how far DAS has actually been able to achieve its intended objectives.

    Mumbai: Despite uncertainty in many quarters, these are interesting times for people following the multi-system operator (MSO) industry. Recently, Siti Networks Ltd (Siti) released its Q2 and H1 results for 2017-18, reigniting the hope for growth in the industry. Announcing growth in operating EBITDA, the company outperformed the competition in set-top box (STB) seeding by adding nearly 2.3 million boxes in the first half of the year as against near flat growth by other companies in the industry.

    For Siti, this forms the bedrock for future growth as monetisation of these boxes in H2 will bring incremental revenue benefit to the company. In the cable television distribution business, STB seeding, monetisation of seeded STBs, and collection efficiency are the core performance metrics.

    The broadband space is exploding with Reliance Jio having announced its impending entry and trial runs across various cities in the country. Siti is looking to leverage existing infrastructure and improve extraction levels. The company will look at a number of business models to ascertain what is the right fit in this business.

    In an email interaction, Rajesh Sethi spoke to Indiantelevision.com on a wide range of issues. Here’s what he had to say:

    What is the direction you are taking to turn around the fortunes of Siti Networks?

    We are one of the largest distribution platforms in the country and are working on the ethos of ‘demand more.’ We will leave no stone unturned to deliver the best to our customers while ensuring enhanced shareholder value. On the video front, this is going to be the last year of major seeding as we consolidate our market dominance. The focus will be on improving monetisation, collection efficiency, and prepaid implementation. We are well prepared to execute the tariff order as soon as the judgment is passed on the same.

    On the broadband front, we are looking to leverage our existing infrastructure and improve extraction levels. We will be selective in our broadband expansion and will look at a range of business models to ascertain what suits us best. The focus is on four pillars of people, process, product, and corporate governance with emphasis on compliances, systems and processes, harnessing inbuilt operating leverage, and making the organisation more agile and lean.

    What is your strategy to prune losses in the time to come?

    In the video business, seeding to capture the opportunity offered by digitisation, subsequent monetisation improvement, and enhanced collection efficiency will be the key priorities. These factors will form the bedrock for strong sustainable growth and ensure recurring cash flows.

    Broadband is a field that we are quite bullish on. Uptake in broadband is dependent on 4G pricing, which definitely is now looking to increase. Broadband growth will come from primarily form Tier 2 and 3 cities rather than the bigger cities. Broadband revenue performance will also see uptick with increasing customer base, churn, and fault rate control.

    Cost optimisation is a major lever in coming back to profitability and we are looking to rationalise our bandwidth, general and administrative, content, and HR costs to drive increased savings. The tariff order is expected to come by end of this fiscal and will substantially moderate content cost growth; content cost is expected to become a pass through.

    These actions are expected to contribute towards improved recurring cash flows and better profitability.

    How soon do you see a revival in the cable industry?

    The revival you speak of is already underway as Phase 3 and 4 monetisation has started happening and this will only move up, eventually being at par with monetisation levels in Phase 1. The bulk of Phase 4 seeding will be completed this fiscal and you will see strong subscription revenue growth lead by volume and monetisation increases. Thereafter, it is a steady state perpetuity business.

    The tariff order will moderate content cost growth as customer choice will dictate the content they view. At the same time, broadband is a big opportunity that will spur long-term growth and drive convergence. The industry is in a transitory phase and things will improve significantly in a year’s time.

    Why hasn’t digitisation helped the dynamics of the industry as envisioned?

    Ever since the announcement of digitisation, there were multiple delays due to a variety of factors. Phase 3 and 4 deadlines were delayed by more than a year due to multiple petitions, regulatory uncertainty, and other factors. As we speak, the tariff order is pending in the Chennai high court. Most DPOs incurred huge capital expenditure in upgradation of the network and purchasing STBs. The costs were incurred upfront and, therefore, monetisation got delayed.

    In addition to these delays, regulatory guidelines such as MIA/SIA also faced delays in enforcement. You are seeing this turbulence as we are in transition right now…once things settle down, you will witness strong recurring cash flows. The content delivery value chain will become more streamlined and the balance of power will shift to the DPOs.

    How important is it to have a lean workforce? Do you have a retrenchment strategy in place?  

    We have been focusing on areas where we can bring efficiencies into the system and one such effort in right sizing was executed in Q2 of 2017-18. This is a regular practice in most mature industries and allows the organisation to become leaner and agile. With this, we have given more latitude to our current employees by adding joint responsibilities in the video and broadband space in terms of delivery. We are focussed on employee growth with regular training sessions being held to upgrade skill sets and clearly delineating what is expected from them. Recently, we also rolled out our seven core values that define our DNA and influence behavior. We want to inculcate and sustain a high-performance culture in this company. These are the guiding principles in our efforts to take SITI to greater heights.

    What is your vision for Siti Networks?

    We are the leading content provider in the country and will continue to sustain our preponderance in video. Simultaneously, broadband is a natural transition for an entity like ours. Customers have already shown indication towards moving to non-linear on-demand entertainment and we expect broadband penetration to see a huge increase. Hence, we are moving towards delivering non-linear content. This will be the future of content consumption and Siti is preparing earnestly for it.

    We are also working with our technology partners to bring innovative products to the market. Our vision is that we should be at the forefront of providing world-class technology to customers.

    How do you see the company evolving over the next two years?

    Siti will have consolidated its primary growth lever of video with strong recurring cash flows taking place. We will be offering substantial HD, OTT, and other VAS services. In addition, we intend to push the pedal on broadband and ensure we have sizeable presence in the high-speed-wired broadband space. We could go in for some inorganic expansion as well.

    NEW DELHI: The government of India yesterday issued a comprehensive FDI policy for various sectors where a slight change has been noticed in the media sector from what had already been announced in June 2016. Now, 100 per cent FDI is allowed in cable TV and HITS under automatic route for both digital and non-digital carriage services.

    For those segments of the media where automatic FDI approval is not granted and a government okay is needed, it would now be the nodal ministry — Ministry of Information and Broadcasting (MIB) — that would be responsible for the green signal instead of Commerce Ministry’s Foreign Investment Promotion Board, a division that has been now dismantled as part of government’s bid to make easy doing business in India.

    FDI in broadcast carriage services like teleports, DTH, cable networks (both MSOs and LCOs for DAS and non-DAS areas), mobile TV, headend-in-the-sky broadcasting service (HITS) is 100 per cent under automatic route.

    The foreign investment limit (FDI) in terrestrial broadcasting of FM Radio and up-linking of news and current affairs TV channels remain at 49 per cent subject to government approval. Up-linking and downlinking of non-news and current affairs TV channels continue to be 100 per cent under automatic route.

    Publishing of newspaper and periodicals dealing with news and current affairs  and publication of Indian editions of foreign magazines dealing with news and current affairs have a 26 per cent FDI limit subject to government approval.

    The head of an MSO company, on condition of anonymity, said it’s slightly confusing as to why it has been stated that 100 per cent FDI is allowed for carriage services like cable TV and HITS in both digital and non-digital areas  under automatic route.

    Though the government is of the opinion that 100 per cent digitization has been achieved in the country, broadcast carriage industry (MSOs and LCOs) insist there analog pockets in the country persist as set-top-boxes are still being seeded in small towns and rural areas.

  • Public authorities can deny cable laying permission to MSOs & LCOs

    NEW DELHI: Stressing that multi-system operators (MSOs) and local cable operators (LCOs) are required to lay and establish cables and erect posts from  time to time under, over, along, across, in or upon any immovable property  under the control or  management of a public authority, the operator can be directed to remove it or  shift it or alter its position, as the case may be, at  its own  cost in  the  time frame indicated by the  authority.

    In new Guidelines to enable the State Governments to put in place an appropriate mechanism for speedy clearances of requests by operators for Right of Way, the Information and Broadcasting Ministry has said that operators can be asked by the public authority in public interest to remove or shift or alter the position.

    In a letter sent to Chief Secretaries of all states, the Ministry said Cable Operators sometimes are required to lay and establish cables and erect posts from time to time under, over, along, across, in or upon any immovable property ever vested in or under the control or management of a public authority, after due permission.                                                            

    Section 48(5) of the Cable TV Networks (Regulation) Act 1995 specifies that the Central Government may lay down appropriate guidelines to enable the State Governments to put in place an appropriate mechanism for speedy clearance of requests from cable operators for laying cables or erecting posts in properties with a public authority.

    The Ministry has laid the basic guidelines for this purpose which covers the procedure and the obligations of both the operators and the public authority in this regard.

    It has also made it clear that no application by an operator can be rejected unless has been given an opportunity of being heard on the reasons for such rejection. The permission will be deemed to have been granted if the public authority fails to either grant permission or reject the applicationwithin 65 days of the receipt of the application.

    Where the  public  authority  accepts  the  undertaking  by  the licensee to discharge the  responsibility to  restore any damage that be cause, it may   seek a bank guarantee for  an amount in  lieu   of expenses for   restoration  of  such  damage, as  security for   performance  in   the discharge of the  responsibility.

    Any application to a public authority will be accompanied by a copy of the  registration granted by the  Government – by the Head Post Master for LCOs under Rule 5, and Central Government for MSOs under Rule 11C of  the Cable Television Networks Rules 1994;

    The extent of land required for establishment of the overground cable infrastructure will also have to be indicated.
