    Govt aims at plugging loopholes that enable copyright theft

    NEW DELHI: The Government has approved an Intellectual Property Rights (IPR) policy aimed at creating a strong legal framework to protect IPR and create public awareness about the economic, social and cultural benefits of IPRs among all sections of society.

    Policy approved by the Union Cabinet has seven objectives which include IPR Awareness: Outreach and Promotion; Generation of IPRs; Legal and Legislative Framework; Administration and Management; Commercialization of IPRs; Enforcement and Adjudication; and Human Capital Development. The National Intellectual Property Rights (IPR) Policy will endeavor for a “Creative India; Innovative India’.

    The Policy recognises the abundance of creative and innovative energies that flow in India, and the need to tap into and channelise these energies towards a better and brighter future for all.

    The National IPR Policy is a vision document that aims to create and exploit synergies between all forms of intellectual property (IP), concerned statutes and agencies. It sets in place an institutional mechanism for implementation, monitoring and review. It aims to incorporate and adapt global best practices to the Indian scenario. This policy shall weave in the strengths of the Government, research and development organizations, educational institutions, corporate entities including MSMEs, start-ups and other stakeholders in the creation of an innovation-conducive environment, which stimulates creativity and innovation across sectors, as also facilitates a stable, transparent and service-oriented IPR administration in the country.

    The Policy recognizes that India has a well-established TRIPS-compliant legislative, administrative and judicial framework to safeguard IPRs, which meets its international obligations while utilizing the flexibilities provided in the international regime to address its developmental concerns.  It reiterates India’s commitment to the Doha Development Agenda and the TRIPS agreement.

    While IPRs are becoming increasingly important in the global arena, there is a need to increase awareness on IPRs in India, be it regarding the IPRs owned by oneself or respect for others’ IPRs. The importance of IPRs as a marketable financial asset and economic tool also needs to be recognised. For this, domestic IP filings, as also commercialization of patents granted, need to increase. Innovation and sub-optimal spending on R&D too are issues to be addressed.

    The broad contours of the National IPR Policy are a Vision Statement about an India where creativity and innovation are stimulated by Intellectual Property for the benefit of all; an India where intellectual property promotes advancement in science and technology, arts and culture, traditional knowledge and biodiversity resources; an India where knowledge is the main driver of development, and knowledge owned is transformed into knowledge shared.

    The aim is to stimulate a dynamic, vibrant and balanced intellectual property rights system in India to  foster creativity and innovation and thereby, promote entrepreneurship and enhance socio-economic and cultural development; and focus on enhancing access to healthcare, food security and environmental protection, among other sectors of vital social, economic and technological importance.

    The action by different ministries/ departments shall be monitored by The Department of Industrial Policy and Promotion (DIPP) which shall be the nodal department to coordinate, guide and oversee implementation and future development of IPRs in India.

    Welcoming the policy, NASSCOM also appreciated the decision to hand over IPR to the Department of Industrial Policy and Promotion. This single umbrella approach will help leverage linkages between various IP offices. The proposed Cell for IPR Promotion and Management (CIPAM) to be constituted under the aegis of DIPP, would be an important connection with the inventors and innovators.

    NASSCOM had in its interaction with the think tank highlighted  difficulties that companies face in monetizing intangibles like IPR and the proposal to create a ‘simple loan guarantee scheme to encourage start-ups’ based on IPRs as mortgage-able assets; financial support and securitization of IP rights for commercialization by enabling valuation of IP rights as intangible assets. 

    NASSCOM said the IT industry is committed to partner with the DIPP in the modernization efforts. Further, Periodic reviews and updates of  IP related rules, guidelines, procedures will ensure an effective IPR regime and NASSCOM is committed to work closely with the DIPP as the policy is implemented to support an innovation led Industry in India.

    Unlocking Indias potential to build a more sustainable tomorrow

    The CII-ITC’s 8th Sustainability Summit held in New Delhi saw the release of a new report on ‘How India Innovates: The promise of sustainable and inclusive innovation.’ As economic growth rates go down and global climate temperatures go up, innovation has become nothing short of a necessity. India, too, has declared 2010-2020 as the Decade of Innovation.

    Under the framework of Indo-German bilateral cooperation the Umbrella Programme for the Promotion of Micro, Small and Medium Enterprises (MSME) funded by the German Ministry of Economic Cooperation and Development (BMZ), GIZ India has partnered with CII-ITC-CESD to strengthen sustainable and inclusive innovations and to support the dissemination of knowledge and the scaling up of successful SI2.

    As part of this partnership GIZ and CII-ITC-CESD have conducted this study with the objective to provide the innovation eco-system with information on how business in India innovates and the promise it sees in Sustainable & Inclusive Innovation.

    According to the report, 79% companies in India innovate with radical solutions while 71% innovate with incremental or radical solutions. Companies have also identified exploiting green growth opportunities and reducing environmental impacts as other important factors to innovate. However, the bottom-of-pyramid market is still not an important driver for companies to innovate.

    According to Ms. Seema Arora, Executive Director, CII-ITC Centre of Excellence for Sustainable Development, awareness on sustainability issues has come a long way in the 30 years since the Brundtland Commission, with leading companies taking proactive steps towards building a more secure, sustainable and equitable future. She adds, “Regardless of whether it is called climate change, responsible business or CSR; the message today is clear – sustainable business is here to stay and industry must change the way it operates.”

    Sharing her thoughts on the event, Ms Arora, states, “The Centre is pivotal in spearheading the sustainability agenda in the country in that it was created by the industry itself. And the Summit is the realisation of the fact that by bringing civil society, government and industry together on one platform, we can truly succeed in co-creating a more sustainable India.”

    The Prime Minister’s Office set up the National Innovation Council with a mandate to substantially enhance the innovation ecosystem in India. The Council has developed a roadmap that would, among other things, create State Innovation Councils and innovation clusters. CII is a member of the National Innovation Council and is helping set up innovation clusters in a couple of sectors.

    FICCI Heal 2013 inaugurated with the theme “Sustainable Quality Healthcare”

    New Delhi: FICCI Heal 2013, an annual healthcare conference by FICCI was inaugurated today with theme “Sustainable Quality Healthcare”. The conference being held on 2nd – 3rd September will focus on the challenges by private healthcare sector for affordability and sustainability. The conference purpose is to highlight the issues that have great significance in influencing quality and cost of delivery through hospital planning, infrastructure, operations and innovation in technology and practice. Panellists would also share the insights on the myth that adherence to quality standards will raise the cost. Integrating and mainstreaming AYUSH system of medicine will also be a part of the discussion house.

     

    In this context, two compelling Papers on Costing in Healthcare and on Innovations in Healthcare were released. The Working Paper titled “Universal Health Cover for India: EvolvingaFrameworkfor Healthcare Reimbursement Methodologies” delves into aspects relating to provider reimbursement mechanisms for inpatient care and suggests a framework for tariff determination based on differential cost structures on account of quality, geography and severity of clinical conditions; centrally determined reference tariff rates based on a formula that recognizes relevant costs, quantum of government sponsored patients served; rewards for performance and timely tariff revision.

     

    FICCI also released another Knowledge Paper titled “Reinventing Affordable & Universal Healthcare through Innovation” which looks at the innovation landscape in the country and makes recommendations to translate potential in to successful innovation by creating a curriculum for creativity in education, framework for Industry-Academia engagement in translation research, incentives for the MSME and sharing of risks in innovative entrepreneurial initiatives, increased allocation of funds for investing into innovation, Insurance driven Demands, governance of Intellectual Property and creating an industry framework for innovation.

     

    Ms. Sangita Reddy, Chairperson, FICCI Health Services Committee & ED (Operations), Apollo Hospitals Group,  says, “a combination of improvement in rural infrastructure, innovation and technology initiatives to improve access have the potential to universalize access of healthcare. The need of the hour is to create an environment where public and private ventures can work sustainably towards providing quality care to the people”.

     

    Elaborating on the conference theme, Mr Rajen Padukone, Co-chair, FICCI Health Services Committee explains “there is a need for policies that will promote meaningful collaboration between the private and public sector. The conference will bring together the policymakers and heads of leading healthcare organizations to share opinions and best practices and will aim at generating realistic recommendations on the way forward.”

     

    Expressing his views on the medical technology sector, Dr GSK Velu, Co-chair, FICCI Health Services Committee and MD, Trivitron Healthcare says “Success in India will depend on establishing local and regional operational capabilities and delivering new innovations, low-cost manufacturing network, R&D, and market-specific commercial operations and capabilities.”
