    Bombay HC restraints 2 TV channels from broadcasting Zeel-owned films

    KOLKATA: In the month of July 2020, media giant, Zee Entertainment Enterprises Ltd (ZEEL) moved the Bombay high court to restrain television channels Maha Movie and Manoranjan TV from broadcasting its films namely Jung (1996) and Kartavya (1979) without obtaining a license from ZEEL for the same. The court passed an order asking them to suspend future broadcasting of the movies in any form or through any medium.

    Maha Movie is a television channel owned by Teleone Consumer Products Pvt Ltd and Manoranjan TV is a television channel owned by Creative Channel Advertising and Marketing Pvt Ltd.

    The matter was heard by justice KR Shriram on 16 July 2020 where ZEEL submitted that in the end of June 2020, it learnt that the Teleone Consumer Products Pvt Ltd and Creative Channel Advertising and Marketing Pvt Ltd were broadcasting both the films on their respective television channels without authorisation from ZEEL. Upon collecting data from Broadcast Audience Research Council (BARC), ZEEL learnt that Jung has been broadcasted thirty-seven times and Kartavya thirty-two times on Maha Movie and Jung has been broadcasted forty-two times and Kartavya nine times on Manoranjan TV till 2 July 2020.

    The court held that unauthorised broadcast/exploitation of the suit films on the said TV channels is a violation of the copyright vested in ZEEL. It also added that it was restraining the channels from creating, alienating and/or transferring any rights in Jung to a third party.

    By and under a Film Assignment Agreement executed between Soham Rockstar Entertainment and Zeel, the latter acquired exclusive linear rights, on-demand rights, local cable distribution rights, catch up TV rights, syndication rights, editing rights, promotion rights, air borne rights,

    surface transport rights, commercial establishment rights, dubbing rights, subtitling rights, Doordarshan rights, home video rights, subtitling rights in all languages of the world including Indian languages, and non-exclusive performance rights, merchandising rights, dubbing rights and clip rights in a total of sixty-four films, including the Jung and Kartavya, for a term of 10 years commencing from 19 July 2017 in respect of linear rights, home video rights, local cable distribution rights, subtitling and dubbing rights for Jung; 1st October 2016 in respect of on-demand rights for Jung and Kartavya; 15th September 2016 in respect of home video rights and

    local cable distribution rights for Kartavya, for the entire world, including India and overseas territories.

    NEW DELHI: Action was taken in 88 cases since 2013 to ensure compliance with or against violation of the Proigramme and Advertising Codes by private television channels.

    Minister of State for Information and Broadcasting Rajyavardhan Rathore told the Rajya Sabha today that this included thirteen cases of advisories issues to all news or general entertainment channels on issues like depiction of children, showing of road accident cases, urging channels to use sign language in Republic Day broadcasts, advisories about specific advertisements, showng films with displaying the Central Board of Film Certification certificate, telecast of anti-terrorist operations by security forces etc.

    There were 32 cases of violation in 2013, 22 in 2014, 23 in 2015 and eleven so far this year, the Mihister said.

    Amiong these, those channels which figure more than once in the list include Manoranjan TV, Colors, FTV, DY365, NTV, Comedy Central, and Raj News.

    indiantelevision.com had earlier this week reported that there were a total of 49 complaints since 2013 – four in 2016 – for vulgarity in advertisements.

    I&B suspends Comedy Central & ManoranjanTV for 10 days for alleged content violations

    NEW DELHI: Even as the government says it wants to give self-regulation a chance, two television channels – Comedy Central and Manoranjan TV – have been penalised for screening inappropriate content by the information & broadcasting ministry.

     

    The transmission or re-transmission of Comedy Central has been suspended for 10 days from midnight of 25 May for telecast of a show ‘Stand Up Club’ on 26 May last year at 20.52 hrs, while Manoranjan TV has been suspended from midnight 25 May for seven days for showing the film ‘Ek Chatur Naar’ with ‘A’ certificate on the afternoon of 11 February last year.

     

    Thus, Comedy Central will remain off air till 4 June while Manoranjan TV will not be transmitted till 1 June if all goes according to the ministry’s order.

     

    While the Viacom18 company spokesperson for Comedy Central said: “Since the matter is sub-judice, we cannot comment”, there was no response from Manoranjan TV despite repeated attempts. It is understood that a petition challenging the ministry order by Viacom18 is coming up for hearing early next week.

     

    The order says that the show on Comedy Central which had ‘obscene dialogues and vulgar words derogatory of women and hence appeared to offend good taste and decency. The portrayal in the programme did not appear suitable for unrestricted public exhibition and children.’

     

    The I&B’s inter-ministerial committee felt in the case of Manoranjan TV that this was a gross violation of the programme code and the argument of the channel that it happened due to a mistake on part of their staff cannot be accepted. Being a responsible TV channel, it should have put in place appropriate system to avoid such mistakes.

     

    The orders in both cases have been issued under section 20(2) and (3) of the Cable Television Networks (Regulation) Act 1995 and paras 8.1 and 8.2 of the Guidelines for Uplinking from India.

     

    In what is clearly hardening of stand, the I&B’s inter-ministerial committee has penalised five channels in the months of April and May for violation of the programme and advertising codes.

     

    Since one channel, Movies OK, obtained a stay order on the grounds that it had been served the notice too late, the ministry took precaution and had issued the penalty notices to both Comedy Central and Manoranjan TV on 17 May. The other channels penalised were Mahuaa and AXN.

     

    The I&B’s inter-ministerial committee had issued show cause notices to both Comedy Central and Manoranjan channels and also gave them an opportunity to make their representations.
