    NEW DELHI: An application by the Indian Broadcasting Foundation seeking extension of time for its members to sign reference interconnect offers agreements with the Noida Software Technology Park Ltd (NSTPL)  has been turned down by the Telecom Disputes Settlement and Appellate Tribunal.  

    In a landmark judgment expected to have far reaching consequences on the Indian broadcasting industry, TDSAT had on 7 December last said that headend-in-the-sky (HITS) players should be treated on the same level as pan-India multi-system operators (MSOs) for commercial purposes.

    In its judgment on a petition filed by the NSTPL against Media Pro and others, the tribunal said its judgment would come into effect from 31 March 2016 by which time it hoped that the relevant reference interconnect offers will be revised wherever necessary.

    Apart from the IBF, some television channels had also filed applications seeking an extension, and the tribunal had addressed certain questions to the Telecom Regulatory Authority of India in this connection.

    In its order, chairman Aftab Alam and members Kuldip Singh and B B Srivastava said after hearing TRAI counsel Saket Singh on the questions addressed to the authority, “We take it to mean that TRAI does not wish any extension of the suspension of the judgment”.

    Answering the main of the four questions, Singh had told the Tribunal that the consultation paper dated 29 January 2016 under the caption ‘Tariff issues relating to TV services’ was part of an ongoing process which is undertaken by TRAI from time to time based on its assessment of the relevant issues in the sector. The exercise is undertaken independently though it may cover some of the issues highlighted in the tribunal’s judgment dated 7 December.

    The tribunal also noted that though the IBF had made the application for extension, it was ‘apparent’ from the hearings that took place on the previous dates that some of the major broadcasters ‘have divergent views not only inter-se but also at variance with the position taken the foundation in as much as none of the broadcasters has asked for any extension of the period of suspension of the judgment.’ The extension of the suspension of the judgment was primarily sought on the plea that following the judgment, TRAI had issued a consultation paper that intends to review the regulatory framework for the broadcasting sector.

    Naming the broadcasters – Star India, Taj TV, IndiaCast, and MSM who are all members of IBF, the tribunal said” “it appears that at least on the issue of enforcement or further suspension of the judgment, the foundation is not in a position to represent the collective views of all its members. We, therefore, see no reason to entertain the application on behalf of the foundation for any further suspension of the judgment.The application is turned down.” The tribunal directed the remaining cases in the batch to come up on 8 April.

    Expectedly, the judgment will also help the Hinduja Group’s HITS platform NXT Digital, which entered into the fray earlier this year.

    In the judgment of 7 December, the Tribunal had directed both Star and Taj, as well as the other broadcasters who have joined the proceedings as intervenors to issue fresh RIOs in compliance with the Interconnect Regulations, as explained in the judgment within one month from the date this order becomes operational and effective. It had said it would be then open to NSTPL to execute fresh interconnect agreements with Star and Taj, and with any other broadcasters on the basis of their respective RIOs or on negotiated terms within the limits.

    The tribunal said: “It is difficult to see a HITS operator as different from a pan-India MSO and in our considered view a HITS operator, in regard to the commercial terms for an interconnect arrangement has to be taken at par with a pan-India MSO and must, therefore, receive the same treatment.”

    The tribunal had noted that Star and Taj will have to execute fresh interconnect agreements with the petitioner within two weeks from the date of issuance of their fresh RIOs. The agreement with Star would relate back to 30 October 2015 and with Taj to 30 June 2015. The issuance of the fresh RIOs by the broadcasters will also give right to other distributors of channels with whom the broadcasters may be in interconnect agreement to have their agreements modified in terms of clause 13.2A.7.

    NSTPL had executed an RIO based agreement with Media Pro. At that time, it did not complain before the tribunal that it was being forced into the RIO based agreement even though it had ample opportunity to do so as the Media Pro application was pending before the tribunal. Later on, after Media Pro ceased to be an agent of the broadcasters, NSTPL, even after filing the present petition, signed RIO based agreements with both Star and Taj. The agreement with Star was for the period upto 30 July, 2015 and the two agreements with Taj were upto 31 March, 2015.

    The Tribunal had also said that NSTPL must therefore be held bound by those agreements till the periods of those agreements and further, three months beyond that in terms of clause 8 of the Interconnect agreement. After those dates (29 October in case of Star and 30 June in case of Taj) the arrangement will be governed by the fresh agreements.

    Hinduja’s HITS platform NXT Digital to launch in August

    MUMBAI: The Hinduja Group has christened its headend in the sky (HITS) service platform as NXT Digital. The service is slated to launch in August 2015.

     

    Speaking to Indiantelevision.com, Hinduja Ventures’ investment arm Grant Investrade managing director Tony D’silva said, “We had applied for the HITS licence in November 2012 and finally after a wait of three years, we have got the Grant of Permission Agreement (GOPA) license on 14 July, 2015.”

     

    At the time of its launch, NXT Digital will concentrate on the phase III and IV digitisation markets, which currently have more than 110 million analogue TV households.

     

    The platform has already started rolling out set top boxes (STBs). “We have already got order for 2.5 million STBs,” informed D’silva adding that deals with two broadcast networks has also been signed. 

     

    NXT Digital will launch with 150-200 channels in August and aims to take it up to 500 plus MPEG-4 encrypted services including HD channels with the ability to insert local channels as per requirement by October-November 2015. Not just this, the platform will also introduce value added service (VAS) like Darshan, TV Everywhere, Games and Learning by December, this year.

     

    “We believe the platform will strongly support the laudable national mission to roll out Digital Addressable Systems (DAS) of broadcasting all over India,” said D’silva. 

     

    NXT Digital, according to D’silva, will not just help last mile operators (LMOs) and multi system operators (MSOs) in going digital as per government mandated standards and within set deadlines, but will also help them remain independent and retain the ownership of their network.

    According to D’silva, NXT Digital is a futuristic product, which caters to the next generation. Designed by Chlorophyll, the eagle in the logo symbolizes the empowered LMO/MSO who, with the new HITS platform, can soar into the skies with complete freedom and ownership, to achieve greater growth. The soaring eagle is also indicative of the reach of NXT Digital.

     

    D’Silva said, “While HITS is the pipeline of content delivery, our offering will not be limited to encrypted television channels through digitally addressable systems. Instead, we will offer a rich bouquet of every kind of additional digital service such as VAS, OTT and others that will keep getting added. Hence, we decided to go with the name NXT Digital, and both, the name and the logo represent the next level in the digital technology we will offer.”

      

    Research and outcome 

     

    In order to understand the market and the needs of the LMOs, the company  undertook an in-depth research to find out the requirements of the distribution fraternity in December 2014. A research was conducted with 2000 LMOs, MSOs and their representatives across 120 cities in phase III and IV markets. 

     

    The research threw up six major requirements of the LMOs and MSOs. These were as follows: 

     

    1) Retain ownership of their network

     

    2) Drive broadcaster deals

     

    3) Package and price their offerings according to the needs of their market

     

    4) To be able to acquire STBs according to their convenience

     

    5) The ability to insert local channels for their end-subscribers

     

    6) Have a sophisticated digital service that could help them compete with other digital platforms like DTH to ensure their digital offerings were future-ready so that their subscriber-bases would only grow.

     

    “In other words, they wanted to remain independent, own their network, and go digital as per government norms and within the deadlines,” D’Silva said.

     

    The HITS platform will offer the choice of two different service models: a white label service model and a full service model.

     

    “By signing up for a NXT Digital service, a network owner in a Phase III market can be saved the burden of having to make huge investments in the technology and highly skilled manpower required to convert his analog households to digital,” he informed.

     

    The entire infrastructure and backend, including a call centre for customer service, will be taken care by NXT Digital. “The network owner can concentrate on growing his business through managing his network, local channels deployment, broadcaster deals and more,” D’silva said. 

     

    Technology partners 

     

    The technology programme manager for NXT Digital is Castle Media and its team, led by Vynsley Fernandes, who has set up several world class operations in broadcasting and digital networks in India and overseas.

     

    GIL has partnered with Thaicom-7 for satellite, C-Band transponders, Nagravision DLK for CAS-embedded platform; OpenTV1 for middleware; Hansen Technologies for subscription management system and billing solutions and Changhong, Telesystems and others for STBs.

     

    Manpower and offices

     

    NXT Digital currently has close to 200 people working in different parts of the country. These people have been picked from the broadcast, cable and telecom sectors. 

     

    The company has four regional offices in Mumbai, Delhi, Kolkata and Bengaluru and 16 state offices. 

     

    Pricing and revenue share

     

    The STBs have been made available to LMOs on cash and carry model. While the SD STB is priced at Rs 1400, the HD box will cost Rs 1800. 

     

    NXT Digital will charge the LMO a flat fee of Rs 20 per subscriber.

     

    In case the consumer pays directly to the platform for any la carte channels, using the online mode of payment, NXT Digital will have a revenue share with the LMOs.   

     

    The HITS platform will work on a prepaid model. “While there will be an option for postpaid, but we will concentrate on the prepaid model. Not just this, unless the consumer application form (CAF) is in place, the customer will not be activated,” informed D’silva.

     

    Awareness drive

     

    GIL has readied a pan-Indian awareness drive across markets, showcasing its services portfolio, technology capabilities and quality of services. The company will conduct roadshows in 39 cities in order to train the LMOs.

     

    The campaign will be spread across all media consumed including but not limited to radio, local-media and OOH.

    NEW DELHI: The Hinduja group is all set to launch its HITS platform by January 2015. The test signals will begin by November 2014. The news was confirmed by IMCL MD and group CEO Tony D’silva to indiantelevision.com.

     

    The new HITS entrant, which already runs a multi system operator (MSO) business InCable, received the licence on 6 March 2014 from the Information and Broadcasting Ministry and has also paid the fee for it.

     

    Grant Investrade, a 100 per cent subsidiary of Hinduja Ventures, is the company which is rolling out the HITS service. A discussion with the company chairman is around, to ensure everything is in place before January.

     

    It is looking at capturing 15 to 20 per cent of the 120 million households in phase III and IV markets of digitisation. It has already arranged for funding of Rs 500 crore for the project.

     

    The HITS model will have a complete different vertical, which will cater to all the content and video on demand (VOD) services requirements. “The services will be made available to all the LMOs along with IMCL,” concludes D’silva.

    Hinduja group plans HITS platform; seeks licence from I&B Ministry

    MUMBAI: Hinduja Group, which has interests in cable TV distribution business through IndusInd Media and Communications Ltd, is planning to launch Headend-In-The-Sky (HITS) platform for smaller cable TV operators to offer digital service.

    The HITS business will be under Grant Investrade, an investment arm of the Hindujas. Grant Investrade holds 6 per cent stake in IMCL.

    Grant Investrade has applied to the Information and Broadcasting ministry for a licence to operate HITS.

    "We applied for HITS licence about two weeks back. We feel that there will be a huge demand for such a service in the third and fourth phase of digitisation which will spread over small towns," IMCL managing director Ravi Mansukhani tells Indiantelevision.com.

    Former Sun Group chief executive officer Tony D‘Silva will head the HITS business for the Hindujas. A veteran in the distribution business, D‘Silva has experience in both the broadcasting and the direct-to-home (DTH) side of the business. He was earlier heading Sun Direct, Kalanithi Maran‘s DTH company. Prior to that, he was headling Star India‘s distribution business.

    Wouldn‘t it have made more sense for the HITS business to reside in IMCL? "We are looking at creating a neutral platform which cable operators and other MSOs can also tap. So we decided that it be housed under a separate company," explains Mansukhani.

    IMCL is in talks with private equity investors to raise $75 million to fund the second phase of cable TV digitisation. The company plans to deploy four million set-top boxes (STBs) on top of the 1.5 million it is expecting to achieve in the first phase of digitisation.

    Building a HITS platform will involve huge investments as it requires transponder space on satellite, encryption systems and digital set-top boxes. Noida Software Technology Park Limited (NSTPL), part of the Jain TV Group, is planning to invest Rs 15 billion over five years in its Headend-In-The-Sky (HITS) project. The HITS service will operate under the JainHits brand.

    The government has mandated digitisation across India by 31 December 2014. The second phase in 38 more cities will be by 31 March 2013, following the switchover to digital delivery of cable TV in Mumbai, Delhi and Kolkata from 1 November. The revised deadline for switchover to digital delivery in Chennai is likely to be decided by the Madras High Court.
