    MSO in Belgaum booked for illegal piracy of Zee TV signals

    NEW DELHI: Karnataka police has registered a first information report (FIR) against Belgaum’s only multi-system operator, Riddhi Vision which is a joint venture of InCable, for illegal transmission of copyrighted content.

     

    The action was taken on a written complaint filed by Cable Star Copyrights Investigations, who is the distributor for Cable TV Rights all over India of Zee Entertainment Enterprises Limited (Zeel). 

     

    Karnataka police took cognizance under Section 37, 51, 52(A), 63, 68(A) of the Copyright Act for telecasting of the Hindi film ‘Khalnayak’ starring Sanjay Dutt and Madhuri Dixit on 20 July evening in Belgaum. The FIR was filed against the managing director and other directors of Riddhi Vision by Dr Chandragupt, superintendent of police in Belgaum. A spokesperson for Cable Star Copyrights Investigations told indiantelevision.com that the pirated content for which the rights were with Zee was being shown on the local channel run by the MSO.  

     

    The spokesperson added, “It has been a practice of various cable operators to run content and specially movies without obtaining permission from the content owners, and the industry has been demanding strict action.”

     

    He said Cable Star Copyrights Investigations is working for anti-piracy and distribution of Zee and other similar companies and has been a crusader against such piracy for several years and have previously lodged many such FIRs in various states.

     

    He said, “Such blatant transmission causes immense loss of revenue to the content owners and government. Cable Star Copyrights Investigations has also lodged many complaints against big cable operators in Maharashtra and other states, in which they are pressing for swift and strict action. Such police action would definitely be a right step towards stopping the menace of piracy, which has been the bane of entertainment industry.”

    Police case filed against two Hathway-linked LCOs in Kolkata for illegally carrying Star Sports 1 signals

    NEW DELHI: Kolkata police has registered a first information report (FIR) against two local cable operators (LCOs) Akash Darpan and Titli Cable Service, both linked to multi system operator Hathway Cable and Datacom’s network for illegally re-transmitting signals of Star Sports1 on unencrypted frequencies.

      

    The FIR follows the raids conducted by the Kolkata police after a complaint was filed by Star on 22 July against ‘the deliberate illegal acts of Hathway.’

     

    Acting on the complaint, the police raided the control rooms of the LCOs and found that the signals of Star Sports 1 were being retransmitted in unencrypted mode on LCN No. 872 meant for local channels. The police registered an FIR No. 649/14 dated 22 July 2014 against Hathway and the two LCOs under sections 120-B/409 IPC and 37/51/63/65/69 Copyright Act.

     

    Star said in a press release that ‘in order to mislead and deceive it, Hathway has adopted an unlawful methodology whereby Hathway’s electronic programming guide (EPG) displays to the subscribers that the said TV channel is available on an a-la-carte basis. However, the said channel is available and enjoyed by Hathway subscribers even without opting for the said TV channel on an a-la-carte basis by the unlawful placement of the TV channel in unencrypted frequencies/forms.’

     

    The broadcaster also claims that because of the unlawful placement of the channel, the subscriber base of Star Sports1 is not captured on the SMS and Cable Access System of Hathway.  Consequently, the MSO does not pay any license/subscription fee, though the channel is available and viewed by the Hathway subscribers.

     

    Star investigated the issue and video recorded the unencrypted retransmission by Hathway on 19 July on being informed of the illegal retransmission. 

     

    Even earlier, Hathway had illegally carried Star Sports channels on unencrypted frequencies in the DAS notified city of Mumbai in gross violation of the provisions of sections 51 & 63 of the Copyright Act, the Cable Television Networks (Regulation) Act and the applicable Regulations of the Telecom Regulatory Authority of India. A legal notice on 27 February 2014 was issued by Star Sports India in this regard.

    Digicable files police complaint against Hathway in Mumbai

    MUMBAI: Jagjit Singh Kohli is furious. The cable TV industry veteran and promoter of Digicable  has  reportedly filed a police complaint against Hathway Cable and a distributor Santosh Ankolekar.  The police complaint – a copy of which is with indiantelevision.com – names Hathway promoter Viren Raheja,  western region in charge and President finance Milind Karnik, an executive Rajendra Rane and Ankolekar as the guilty parties.

     

    JSK – as he is known in the industry – is seeking justice. The reason for him taking such a drastic step is because the latter – who was a distributor of Digicable – did a deal with India’s leading cable TV MSO  as part of which he allegedly sold his  network to it. Ankolekar,  according to Digicable sources – was a small local cable operator  with a network of around 1,500 subscribers in the Andheri east area of Mumbai. Ankolekar grew rapidly  after his appointment as a distributor by Digicable in 2007. According to the MSO, he was given about 50,000 STBs to seed to local cable operators in the area and convert them to Digicable subscribers, which he did.

     

    “But the network was not really his,” says Kohli. “It was owned by Digicable, and we offered to show the documents to the Hathway management but they were not bothered about facts and continued using our network.”

     

    According to Kohli, Hathway swapped the Digicable boxes  for its own and when his team asked them to return them to him, it was not done. “The point is they may have inadvertently made a mistake but then they have to make amends which they are refusing to do,” says  Kohli.

     

    Hathway officials deny any wrongdoing. They state that it was Ankolekar who came to the MSO seeking help.

     

    “Digicable had not been able to make payments to broadcasters for quite sometime and his signals were consistently getting switched off,” says a senior Hathway executive. “When he came to us we offered to give him Hathway boxes as we were getting a large territory in the heart of Mumbai. And we would be in a position to provide consistent services to subscribers as our deals with broadcasters are in place.”

     

    The executive states that there was no swapping of boxes or anything of that sort. “Digicable had given the boxes to local cable operators,” says he. “We did too. But we did not take the Digicable boxes back  from the LCOs. If the boxes are with the LCOs, then Digicable should take them back from them.”

     

    The MSO stated – at the time of writing – that the company was unaware of Karnik or Viren Raheja being named in the FIR. “We would have got a call from the police station,” says a senior executive. “To the best of our knowledge only Rane and Santosh are named in the FIR and no one else. “

     

    Digicable had earlier had a run-in with Hathway last year when it had alleged that its former CEO Amit Nag had colluded with the latter  in “hijacking” its network in Kolkata.

    NEW DELHI: The Chief Judicial Magistrate, Lucknow, has sought report by 8 December from the Station Officer, Gomti Nagar, regarding social activist Nutan Thakur’s case for registration of FIR against Kishore Lulla, producer, Sanjay Leela Bhansali, director of Goliyon ki Raasleela: Ram Leela and Leela Samson, Censor Board Chairperson.

     

    As per the complaint, this title was given despite specific order of the Allahabad High Court in a previous case filed by her where the Court had said that religious sensitivity needs to be addressed.

     

    Later the Censor Board under Samson passed this film despite knowledge of orders of Allahabad High Court in Vinod Shanker Misra case where Court had regarded use of word Raasleela as hurting the sentiments of Hindus, a fact which was proved when the High Court banned this film in UP, saying that its title hurt the Hindu sentiments.

     

    Based on these facts, Thakur had presented an FIR before the Police and approached the Court when the police refused to register the FIR.

    MUMBAI: Of late Zee 24 Gantalu, the Telugu news channel of ZMCL has been a plethora of cases being filed against it.  The latest is that it has decided to finally take a stand and say ‘enough is enough’. The channel has filed a writ petition in the Hyderabad High Court yesterday to seek relief from the FIR lodged against it by DGP V Dinesh Reddy.

    A case of ‘spreading communal tension’ has been lodged in the police against it following which two employees (journalists) had been arrested and remanded in custody for two days. They are currently on bail and several other staff members have also taken anticipatory bail including the chief editor K Siva Prasad and the input editor.

    The news report that is creating trouble is the one about the DGP (who is to retire soon) going to various babas (godmen) including a Hindu and a Muslim and touching their feet. He claims that the video has been morphed. The other case is where the Muslim baba has accused the channel of calling him a ‘black magician’.

    “The words we used were ‘mantra gaadu’ which does not mean black magician but someone who is performing mantras,” says Zee 24 Gantalu editor K Siva Prasad.
    The court’s order will come out tomorrow.

    Last month another notice was sent to the channel regarding a video telecast on TRS chief K Chandrashekhar Rao on the repatriation of Seemandhara region’s employees.

    NEW DELHI: A Lucknow court has dismissed the petition filed by UP cadre IPS officer Amitabh Thakur for wanting to file a first information report against producer-actor-director Kamal R Khan with regard to alleged remarks against two scheduled castes in a comment about the film Raanjhana.

     

    Additional Chief Judicial Magistrate Manish dismissed the petition alleging the objectionable criminal comments were made in a Video on YouTube. The petition was filed after the police refused to register an FIR. Thakur had given an FIR to Gomtinagar police station, Lucknow and SSP, Lucknow saying that Khan’s comments are clearly casteist in nature and constitute an offence under section 3(1)(x) of the SC, ST (Prevention of Atrocities) Act 1989.

     

    The ACJM said that an offence under the SC/ST Act is made only when it is aimed at a particular individual which is not the case here, and so no cognizable offence is being made.

     

    In the 09.40 minute video review uploaded on YouTube on 20 June, Khan said: “Sir, I don’t know whether you are from UP or not, but I am. In the whole of UP, you will find cobblers and sweepers who look like Dhanush but you will not find such single rotten Brahman as him in entire UP.” He also made some other extremely improper personal comments against the actor Dhanush.

     

    Khan has earlier invited controversies with his film Desh Drohi and his presence in Bigg Biss 3, is once again in trouble.

     

    In his very first film Desh Drohi, Khan indirectly referred to the Shiv Sena through his dialogue “Jitni nafrat humhare liye tumhare dil main hain , usse zyada pyar tumhare liye humare seene main hain. Kabhi UP Bihar aake dekhna, mehman ko bhagwan samajhte hain hum.”

     

    This resulted in the film being banned in Mumbai for two months.

    MUMBAI: More than 70,000 music fans attended the [V] Power Concert in Taipei, the large-scale outdoor music event organized by Channel [V] Taiwan and presented by Le Tea, a Taiwan beverage group.

    Held a few days ago the concert garnered artists from Taiwan, Hong Kong and Japan, including FIR, Edison Chan, 183 Club, Matsuura Aya, Fish Leong, Fan Fan and Kenji Wu, to perform live music for fans at Zhongshan Soccer Stadium.

    Le Tea was the event’s presenting sponsor for the second consecutive year. Music fans received tickets to the concert by purchasing Le Tea beverages. The promotional campaign led to a significant boost in its sales, particularly leading up to and during the concert period.

    Star Taiwan GM Wayne Chou says, “We are delighted that the [V] Power Concert was once again such a huge success – in terms of attendance as well as in the exposure it generated for Le Tea .

    “The calibre of artists we were able to attract this year made for a fantastic live concert, and will undoubtedly enthrall our viewers when we broadcast the show on Channel [V] Taiwan.     IMI seals Delhi unit in anti-piracy raid

    MUMBAI: The Indian Music Industry’s (IMI) anti-piracy team, in co-operation with the Censor Board of India had conducted a raid on 9 November and sealed a piracy unit in West Delhi. Operating under the name of Dugobs Replication Company, the raid on the establishment lead to seizure of goods valued at over Rs 200 million.

    IMI, represents the recording industry of India and is affiliated to the International Federation of the Phonographic Industry (IFPI), the world industry body.
    The piracy plant located at A – 25/ 2 Naraina Industrial area, phase I, as been hsealed and the establishment owner, Hiranand has been arrested.

    In total, over 90,000 CD’s and 10,00,000 inlay cards have been recovered along with equipment including a stamping and molding unit, a printing unit, a packing unit, a plant handling computer system and over 19 stampers, informs a statement.

    A first information report (FIR) has been registered against the accused and he is currently in police remand while further investigations are ongoing.

    Commenting on the raid, IMI deputy chief coordinator J N Saxena said, “This is an excellent piece of police work on information provided by IMI, and the police is now pursuing leads for facilitating further investigations. It is IMI’s constant endeavour to eradicate piracy, and together with judicial bodies and governmental agencies, we hope to one day seal all such nefarious establishments and bring to justice those who are guilty”.

    Elaborating further, IMI president VJ Lazarus added, “IMI has been working for the last ten years to control piracy and in the last four months itself, it has conducted raids on two of Delhi’s biggest CD plants- Deepak Arts CD plant and Dugobs Replication Company.”

    Deepak Arts CD plant was raided in July 2006 where goods worth over Rs 300 million were seized. The accused Deepak Malhotra, was arrested and placed in judicial custody for more than 40 days.

    IMI has constantly been demanding an optical disc law to be created in India to monitor CD plants. However, there has not been much success on this issue so far, adds the release.

    In Delhi, IPR is being flouted at every nook and corner in places, which include the Pallika Bazar, Chandni Chowk and Lala Lajpatrai market.
