    SC upholds licence cancellation of Digi Cable Network, SCOD 18 Networking

    MUMBAI: Cancellation of licences granted to two MSOs Digi Cable Network and SCOD 18 Networking has been upheld by the Supreme Court on security ground. Before moving to apex court the petitioners had approached the Bombay High Court where their pleas challenging the cancellation order by Ministry of Information & Broadcasting (MIB) were dismissed.

    Earlier, the licences issued to these cable TV service providers were cancelled by the MIB on the ground that the Ministry of Home Affairs denied issuance of "security clearance" to them.  The apex court bench comprising Justice Abhay Manohar Sapre and Justice Indu Malhotra security agreed that security clearance is a mandatory requirement as per Cable Television Network (Amendment) Rules.

    The Union of India filed the copy of the reasons in a sealed cover which was made basis to deny security clearance to the appellant. Referring to the document, the bench observed that the order of cancellation was passed in conformity with the requirements of Rule 11C.

    “It is clear from mere reading of the Rule 11C (1) that grant of permission is subject to issue of security clearance from the central government to the applicant… Since the grant of permission was subject to obtaining of the security clearance from the concerned ministry, the competent authority was justified in cancelling the conditional permission for want of security clearance," the court said.

    The appellant also argued that they were not afforded any opportunity of hearing before cancelling the permission. They added that the order was passed without following the principle of natural justice and fair play.

    “In a situation of national security, a party cannot insist for the strict observance of the principles of natural justice. In such cases, it is the duty of the court to read into and provide for statutory exclusion, if not expressly provided in the rules governing the field. Depending on the facts of the particular case, it will, however, be open to the court to satisfy itself whether there were justifiable facts, and in that regard, the court is entitled to call for the files and see whether it is a case where the interest of national security is involved. Once the State is of the stand that the issue involves national security, the court shall not disclose the reasons to the affected party,” the judgement read.

    The bench also observed that the principles of natural justice were not violated in this case. The appeal has been dismissed finally as it was found to be devoid of any merit.

    NEW DELHI: Despite the Phase III deadline for Digital Addressable System (DAS) barely two weeks away and the Government’s assertions over this past weekend, the Ministry of Information & Broadcasting (MIB) has granted provisional licences to 14 multi-system operator (MSOs).

     

    However, as per the updated list, the MIB has not granted any new permanent MSO license.

     

    With this, the number of 10-year (permanent) registrations for MSOs remains 230 and the total has only risen by 14 to 567 by including the 337 which got provisional clearance (till 15 December, 2015).

     

    According to the list put on the MIB’s website, Kal Cables of Chennai and Digi Cable Network of Mumbai remain on the cancellation list. Scod 18 Networking Pvt Ltd of Mumbai has also been refused security clearance while SR Cable TV of Bangalore has shut down its business.

     

    The MIB has granted provisional registration to DEN Networks’ Nashik subsidiary DEN Discovery Digital Network for Maharashtra.

     

    On the other hand, Extreme Teleconnect has received pan-India licence. Other MSOs that were granted provisional licences for various districts are: Hindupur Cable TV Operators Welfare Association, RK Digital Cable Service, Srisivakami Amman Cable TV System, Shri Shyam Baba Cable Network, Raj Cable Network, Lonar Cable Network, Srivi Communication, Matarani Cable TV Network, Kulasekharam Television Network, Victoy Digital Network, Jajpur Digital Network Services and Treeshakti Cable Network.

     

    The pace appears particularly sluggish considering that the Home Ministry had announced over five months ago that it was aiming to do away with security clearances for MSOs.

     

    MIB sources told Indiantelevision.com that nothing had been received in writing in this regard from the Home Ministry.  

     

    The number of MSOs was 553 by 24 November, having risen from 470 earlier in November, but this increase was merely in those who had provisional licences.

     

    Considering the warning to broadcasters not to give digital signals to unregistered MSOs, the completion of DAS in urban areas by the end of this month appears to be a mammoth task.

     

    The number of provisional licences has also slowed down, considering it had risen from 246 on 10 November to 323 by 24 November (an increase of 77) and has now risen by eleven to 337.

     

    Only three MSOs who had provisional licences have got permanent licence since September this year. Three provisional licensees have been permitted to change their area of operation. Thirteen permanent licensees have been allowed over the past few months to change their areas, of which one has been allowed to add more areas.

     

    The source said many MSOs holding provisional licences had not completed certain formalities relating to shareholders and so on.

    New Delhi: The number of multi system operators has raced to 553 by 24 November from around 470 early this month, as the government races to prepare to meet the deadline of completing the third phase of digital addressable system.

     

    Of these, 230 have got ten-year licences with three provisional licencees getting permanent licences, and a total of 323 (against 246 early this month) getting provisional licences. One temporary licencee was also given permanent licence till 2024 after its area of operation was changed.

     

    Information and Broadcasting Ministry sources said it had still not received any formal communication of the Home Ministry’s decision to do away with security clearances for MSOs, while some had been given provisional licences pending certain formalities relating to shareholders and so on.

     

    According to the list put on the I and B Ministry’s website today, Kal Cables of Chennai and Digi Cable Network Pvt Ltd of Mumbai remain on the cancellation list. Scod 18 Networking Pvt Ltd of Mumbai has also been refused security clearance while SR Cable TV Pvt Ltd of Bangalore has shut down its business.

    The new entrants in the permanent licence list include Waltair Entertainment Pvt. Ltd for Phase II in Vishakapatnam; Den Manoranjan Satellite Pvt. Ltd of Pune for Maharashtra; and Seemanchal Digital Network of Purnea for Bihar.

    NEW DELHI: The panic button appears to have been pressed. With the looming end of year deadline of completion of digital addressable system (DAS) Phase III, the number of multi system operators (MSOs) has jumped to 473 as of 4 November from 429 as on 21 October.

     

    Of these, 227 – one more in the past fortnight – have 10-year licences and a total of 246 (against 203 on 21 October) have obtained provisional licences.

     

    The only new entrant in the permanent licence list, cleared yesterday, is New Delhi’s DEN Ambey Cable Networks, which will provide DAS signals in Uttar Pradesh except Agra, Lucknow, Ghaziabad, Meerut and Varanasi.

     

    Information and Broadcasting (I&B) Ministry sources said it had still not received any formal communication of the Home Ministry’s decision to do away with security clearances for MSOs, while some had been given provisional licences pending certain formalities relating to shareholders and so on.

     

    According to the list put on the I&B Ministry’s website, Kal Cables of Chennai and Digi Cable Network of Mumbai remain on the cancellation list. On the other hand, Mumbai based Scod 18 Networking has also been refused security clearance while Bengaluru’s SR Cable TV has shut down its business.

     

    Twelve MSOs, which had earlier been granted permanent licences were permitted to change their areas of operation.

    NEW DELHI: Even as two months remain for digital addressable system (DAS) Phase III deadline of 31 December, 2015, a total of 429 multi system operators (MSOs) had obtained licences for DAS as on 21 October.

     

    Of these, 226 MSOs have 10-year licences, whereas 203 have obtained provisional licences since the Information and Broadcasting (I&B) Ministry has still not received any formal communication of the Home Ministry’s decision to do away with security clearances for MSOs.

     

    According to the last list issued on 30 September, the Ministry had registered a total of 400 MSOs including 173, which were provisional.

     

    Thus while there has been no increase in the number of permanent (10-year) licence holders, the number of provisional MSOs has gone up to 203.

     

    According to the list put on the I&B Ministry’s website, Kal Cables and Digi Cable Network Pvt Ltd of Mumbai remain on the cancellation list.

     

    Thirteen MSOs, which had earlier been granted permanent licences were permitted to change their areas of operation. 

     

    The only new entrant in the permanent licence holder is Nilgiri Cable TV Private Ltd for the third and fourth phase of DAS in Tamil Nadu.
