    DD Free Dish fills up 3 vacant MPEG-2 slots

    MUMBAI: Public service broadcaster Prasar Bharati has allotted vacant slots to three channels on its direct-to-home (DTH) platform DD Free Dish in the 41st e-auction. According to media reports, the pubcaster has garnered Rs 21.69 crore in the latest round of e-auction.

    Hindi GEC Manoranjan Grand, Hindi movie channels Zingaat and Skystar Telugu have been allotted MPEG-2 slots for the period from 16 August 2019 to 29 February 2020. Manoranjan Grand, the new free to air (FTA) Hindi GEC will launch on 15 August while the test signal of the channel is already on.

    The Prasar Bharati board gave a green signal to e-auctioning of DTH slots on DD Free Dish in January. The e-auctioning was arbitrarily called off in October 2017. Earlier, FreeDish would conduct the e-auction every couple of months to award vacant channel slots to private broadcasters. The last e-auction was held in July 2017.

    MUMBAI: All four major broadcasters decided early this year to pull out their free-to-air channels from Prasar Bharati-run direct-to-home (DTH) operator DD Free Dish, the platform which was earlier a great challenge to private DTH players. Dish TV India group CEO Anil Dua stated that the decision has opened up opportunities for other existing players.

    In an earnings call after Dish TV’s quarterly results, Dua answered that customers have been in a wait and watch mode but some of the ‘creamy layer’ has definitely moved to other options. The second segment has also benefited Dish TV.

    “A large number of customers are still hoping that they will have their channels back or other new channels substituting for the ones which have gone. And there are, of course, bare minimum channels in terms of entertainment and movies still available,” Dua added.

    Although many customers are staying put, Dua stated it has opened up opportunities for other players. Dish TV has also capitalised upon this new opportunity during the first quarter of FY 20. However, he also noted that it really depends upon how that platform evolves and how customers react to that going forward.

    MUMBAI: The Delhi High Court on Tuesday granted an injunction to direct-to-home (DTH) operator Dish TV (plaintiff) against Prasar Bharati (defendant), preventing the public broadcaster from using the word 'Dish' for its free-to-air DTH platform DD Free Dish. The defendant was handed three months’ time to inform its subscribers of the new name, so as to not cause any confusion.

    Terming it as prima facie case of infringement, the single bench of Justice Sahay Endlaw refused to accept the pubcaster’s claim of publici juris.

    The plaintiff had instituted this suit for permanent injunction restraining the defendant from infringing the trade mark “Dish TV‟ of the plaintiff and from passing off the defendant’s services as that of the plaintiff by adoption of the name/mark “Free Dish‟ and for ancillary reliefs.

    The plaintiff had argued that the world ‘Dish’ was first appropriated by them and is a key component of its trademark. The defended opted for a logo similar in nature, even containing the dish that was a central to the Dish TV logo.

    The defendant refuted the charge of similarities in the logo and argued that the exclusive right to the Dish logo cannot be claimed by anyone.

    The court was not in agreement with the defendant’s argument of the word “Dish‟ being generic to DTH service or publici juris and/or common to the trade of DTH service for it to be said that adoption thereof by plaintiff for its DTH services cannot prevent others providing same service from using the same for the reason of its being essential for them for describing their service.

    “As far as the contention of the counsel for the defendant regarding public interest is concerned, it cannot be lost sight of that the defendant, after ten years changed the name of its service from DD Direct+ to DD Free Dish. It is not the case of the defendant that in doing so, any such consequence followed. The defendant has also not disclosed the need for such change. There is no reason for the defendant to now, upon being asked to make the change instead of affecting the same voluntarily, suspect any such harm to the public. Moreover, the said aspect can be taken care of by providing sufficient time to the defendant to make its customers / subscribers aware of the change including on its own telecast,” the order read.

    “Rather, I am dismayed that the defendant, a public sector enterprise, indulged in using another’s trade mark and in spite of the plaintiff objecting thereto, refused to act reasonably. The same is not expected of a public sector enterprise which according to the proclaimed litigation policy of the government is not to be indulged in. It is at least now expected that the officials responsible for conduct of the business of the defendant will bestow attention thereto and take a call, whether it is worthwhile to contest this litigation, obviously at the cost of the exchequer,” Justice Sahay Endlaw further stated.

    India’s sports broadcasting ecosystem threatened by ‘motivated’ PILs

    MUMBAI: On 10 May 2019, the Delhi High Court issued a notice in a petition challenging Section 3 (1) of the Sports Broadcasting Signal (Mandatory Sharing with Prasar Bharati) Act 2007, which restricts the retransmission of live broadcasting signals of sporting events of national importance by Prasar Bharati only on its terrestrial and DTH (DD Free Dish) networks.

    The petitioner Vaibhav Jain had sought that the DD signals should also be carried on digital platforms so that viewers can access the ongoing cricket World Cup matches shown on Doordarshan channels on a free-to-air basis. Despite the petitioner’s lawyer insisting that some order be passed for the upcoming World Cup, the Court denied relief and listed the matter for 22 July, a week after the World Cup concludes.

    A similar petition has also been filed by one Ramesh Kumar in the Punjab & Haryana High Court. According to the PIL, the petitioner is a driver by profession and neither has access to cable and DTH networks nor owns a TV, and hence is unable to exercise his right to access sporting events of national importance on a free-to-air basis.

    Those following the matter closely believe some vested interest groups are misusing the PILs to circumvent the orders of the Supreme Court to amend the Sports Act, which is not only against the interest of India's sports broadcasters but also detrimental to building a self-sustainable sports ecosystem in the country.

    The Delhi HC PIL is the first challenge made to Section 3 (1) after the judgment passed in August 2017 by the SC which affirmed the Delhi High Court judgment and held that the live feed received by the public broadcaster from content right owners or holder is only for the purpose of retransmission on its own terrestrial and DTH networks and not to private cable operators.

    The top court had clarified that sharing of signal with Doordarshan was to provide sporting content access to consumers who did not have it and not those who have already subscribed to private cable networks.

    A similar interpretation of Section 3 (1) was offered by an earlier judgment of the SC in 2016, holding that Prasar Bharati was supposed to telecast sporting events for the benefit of general masses, who otherwise do not receive signals of private channel due to geographical remoteness or are lacking the financial capacity to pay for these channels.

    However, Section 8 of the Cable Television Networks Act makes it mandatory for all cable operators to carry two Doordarshan channels. This meant cable operators got access to the broadcast of sporting events through two avenues: through the channels of Star or Sony, or other sports broadcasters, for which they have to pay subscription fees, and via the channels of Doordarshan, which are free.

    In the recent consultation by MIB for extending mandatory sharing to private platforms, many sports federations including the AIFF (football), AITA (lawn tennis) among others argued that public interest is better served in ensuring that funds for sports development are generated by sale of media rights and extending mandatory sharing across all platforms will sound a death knell to sports funding.

    For instance, the Indian Olympic Association’s feedback on the proposed amendment read, “It dents the commercial model of sports broadcast as buying of exclusive rights of sporting event, especially the Olympics Games and delivering it in world-class quality incurs very high investment for the private broadcasters in India. Competitive bidding of broadcast rights is imperative to up-keep the Olympic movement’s efforts to support sports and athletes. Besides, the niche sports that do not yield space in television broadcast unlike the popular sports of football, cricket, kabaddi, etc use new technologies and internet. Olympic Channel is also promoting the popularity of various sports through its network, which could be affected by the new amendment.”

    Legal experts are of the view that in light of the Supreme Court judgment, as long as Section 3 (1) of the Sports Act stands in its present form, no court is likely to grant any interim relief permitting retransmission on private networks and digital platform. 

    An industry insider, who wished to remain anonymous, indicated that sports content gives immense bargaining power to sports broadcasters and therefore, challenge to Section 3 (1) becomes important so as to restore the balance in favour of cable operators.

    The outcome of challenge raised before the Delhi and Punjab High Courts will determine whether sports rights continue to remain viable considering that a successful challenge before the Courts would result in retransmission of sporting events by private cable and DTH operators along with the same being available for online streaming on a free-to-air basis.

    MUMBAI: Union Minister for Information and Broadcasting Prakash Javadekar on Saturday stated that DD Free Dish was the biggest direct-to-home (DTH) operator in the country with 3.5 crore connections.

    "There are five to six major operators and they put together have 5.5 crore connections. The biggest DTH operator in the country is Doordarshan with 3.5 crore DTH connections where we are giving free Dish," he said.

    The minister also added that India will soon become the largest country in the world where every household has a television set.

    "There is a new dream that every household will have a TV in the coming years. There are 25 crore households in India and 18 crore have a TV set. There are still seven crore households without a TV," Javadekar was quoted as saying by news agency PTI.

    Javadekar made the comments during a program to launch distribution of Free Dish set top boxes in Kashmir. On the occasion, a signature tune for Doordarshan's satellite channel for Jammu and Kashmir DD Kashir too was unveiled.

    "Today, we are making a small beginning in which we are giving set top boxes of free Dish TV for people living in far-flung areas and to poor people. However, as soon as our economy develops people will buy a TV as soon as they are able to address the six basic needs of food, clothing, shelter, healthcare, education and livelihood," the Minister explained.

    Minister of State in Prime Minister's Office Jitendra Singh said free DTH connections will help in flow of information in regions that are not well connected.

    "People in border areas will get some relief. They will get an avenue of entertainment and the information that should reach them," Singh said.

    The Lok Sabha MP from Udhampur said the Dogri bulletin on DD Kashir satellite channel was a long pending demand of people in Jammu.

    "Steps have been taken for promotion of Kashmiri language from time to time but similar steps for Dogri were delayed. Both Kashmiri and Dogri are rich but underrated languages," he said.

    Jammu and Kashmir Governor Satya Pal Malik said the distribution of Free Dish STBs would also prevent people from falling prey to fake news and false propaganda.

    MUMBAI: Union Minister for Environment, Forest & Climate and Information & Broadcasting Prakash Javadekar and Minister of State (Independent Charge), Ministry of Development of North East Region; Minister of State PMO; Minister of Personnel, Public Grievances and Pensions; Department of Atomic Energy; Department of Space Jitendra Singh on Saturday launched a spectrum of initiatives for the state of Jammu and Kashmir.

    In a vibrant launch ceremony held at SKICC, Srinagar Governor of Jammu and Kashmir Satya Pal Malik and both the ministers in presence of other dignitaries distributed Doordarshan’s Free Dish Set Top Boxes (STBs) in Jammu and Kashmir besides launching half an hour Dogri programme and News Bulletin from DD Kashir and the signature tune of the channel.

    The STBs will be provided free of cost and the audience will be able to view 100 channels for free.

    Addressing the gathering, Javadekar appreciated the efforts of the MIB especially Doordarshan for reaching out to the public in border areas to disseminate the message of information, education and entertainment.

    He said that after the basic necessities, information and entertainment are the most important needs of the people and the central government under the leadership of Prime Minister Narendra Modi is taking all the steps to reach out to the people to ensure these facilities.

    Lauding the role of All India Radio, the minister said that PM Modi has very ably utilised the services of such medium through Mann Ki Baat which has now become very popular.

    Javadekar said that Doordarshan and All India Radio have credibility which gives these channels an edge over the others who sometimes get carried away with rumours. Doordarshan is an institution of trust, he further added.

    MoS PMO Jitendra Singh appreciated the efforts taken by Doordarshan to reach out to the people throughout the country. The launch of Dogri programme and news bulletin will go a long way in bringing sense of pride and oneness among the people. He termed Doordarshan as a single channel that can bring hearts together.

    Governor of Jammu & Kashmir Satya Pal Malik while addressing the audience said that the people living in border areas will surely get benefitted with this initiative. The problems of the youth of the state need to be addressed in order to bring in peace and prosperity in the region. He impressed upon Doordarshan and All India Radio to keep spreading out to the remotest of corners to provide information to the last mile.

    Chairman, Prasar Bharati A Surya Prakash, while addressing the audience highlighted the qualities of DD Free Dish DTH and termed it as the tools of empowerment. He laid emphasis on the commitment of the Government to bring peace and prosperity across the region.

    Secretary, Information & Broadcasting Amit Khare, director general, Doordarshan Supriya Sahu, chief secretary, Government of Jammu and Kashmir BVR Subrahmanyam and other State and Central Government officials were also present on the occasion.

    The news bulletin will be telecast daily at 6 pm on DD Kashir in digital mode. The signature tune, which resonates with the spirit of the valley, has been composed by Rahul Sharma.

    DD Free Dish to air Bangladesh’s BTV World, South Korea’s KBS World

    MUMBAI: In a big boost to India-Bangladesh cooperation, the Government of India has decided to show BTV World, a channel owned by Bangladesh TV, on the Doordarshan Free Dish.

    At the same time, DD India would be made available in Bangladesh for being viewed by the people in that country.

    This arrangement is as a result of an MoU signed between Prasar Bharati and Bangladesh TV (BTV) on 7 May 2019. The channel – BTV World would be of special interest to the viewers of Eastern India.

    The decision marks an important watershed in the strengthening of ties between the two countries and follows an earlier decision taken by the two Governments to co-produce a film on Banga Bandhu Sheikh Mujibur Rahman, which will be directed by the eminent film director-producer Shyam Benegal.

    The Government has also approved the proposal of Prasar Bharati for making available the KBS World, an English 24×7 channel of Government of Republic of South Korea on the DD Free Dish for the Indian viewers.

    Simultaneously, people of Korea would be able to view DD India in their country.

    MUMBAI: Prasar Bharati has invited applications to fill up reserved Bucket R1 MPEG-2 slots of DD Free Dish DTH Platform on pro-rata basis for the period from 15 April to 31 May in accordance with amendment to Policy Guidelines  of slots of DD Free Dish, notified on March 30 2019.

    Only devotional/spiritual satellite channels, including channels promoting yoga, ayurveda, health and wellness based on traditional methods, licensed by the Ministry of I&B and categorized as Bucket R1 as per the amendment to policy guidelines for allotment of slots on DD Free Dish Direct to home satellite platform, notified by Prasar Bharati on 30.3.2019, are eligible to apply for allocation of these slots on pro-rata basis.

    The interim reserve/base price of Bucket R1 for allotment of slots on DD Free Dish on pro-rata basis is Rs 3.00 crore per year. Hence, the pro-rata carriage fee for the period from 15.04.2019 to 31.05.2019 will be Rs. 45,58,356/- (Rupees forty five lakhs fifty eight thousand three hundred fifty six only) inclusive of GST @18%.

    Broadcasters desirous of placing their Channels on DD Free Dish shall be required to declare genre and language of their channel while applying for pro-rata allocation.

    E-auction, if required, will be held on 12.04.2019.

    BENGALURU: In calendar year 2018 (1 January 2018 to 31 December 2018), India’s private direct to home (DTH) service providers added 29.3 lakh net subscribers of which 10.4 lakh additions were made in the last quarter of the calendar year (Oct-Dec 2018, Q3 2019, period under review).

    According to Telecom Regulatory Authority of India (TRAI) quarterly Indicator Reports, DTH has attained net pay active subscriber base of around  704.9 lakh (70.49 million, 7.049 crore)  with five pay DTH service providers as on 31 December, 2018. This is in addition to the subscribers of the free DTH services of Doordarshan. Quarterly growth in the DTH sector in terms of the net active subscriber base and market share of DTH operators in terms of the percentage of net active subscribers during the quarter is depicted in the following charts.

    Two major DTH players – Airtel Direct TV (Airtel DTH) and the merged Dish TV Videocon d2h entity (Dish TV) have about 55 percent of the market share of private DTH subscribers in the country. During CY 2018, these two players added 17.06 lakh (1.706 million, 0.1706 crore) subscribers, or 58.2 percent of the net subscribers that were added by all the five private DTH players in the country. Airtel DTH added 10.63 lakh (1.063 million, 0.1063 crore) net subscribers, while Dish TV added 6.43 lakh (0.643 million, 0.0643 crore) during the period under review.

    As per the latest TRAI quarterly Indicator Reports, the highest number of DTH subscribers in 2018 by private players were added in the Apr-Jun quarter with 18.4 lakh (1.84 million, 0.184 crore) subscriber additions. In the first quarter of CY 2018, the private DTH players lost 30,000 subscribers. Please refer to the figure below for the private DTH subscriber trends during CY-2018.

    Dish TV is by far the largest DTH player in the country and probably the second largest globally. As on 31 December 2018, Dish TV claimed a net active subscriber base of 236 lakh (23.6 million, 2.36 crore) while Airtel DTH claimed a net active subscriber base of 150 lakh (15 million, 1.5 crore).

    The government’s DD Free Dish DTH service claims to reach out to nearly 300 lakh (30 million) as per reports and the FICCI-EY 2019 report, it has the capability to breach the 50 million mark if broadcasters keep supplying it with pay-TV content. It must however be noted that an exact number for registered or active subscribers is not available since this is a free DTH service.

    MUMBAI: T TV, Taur Punjab Di, is the latest 24 hour free to air channel being launched by Teleone Consumers Product Pvt Ltd which is a part of DV Group of companies and is aimed at providing quality entertainment to the north Indian audience.

    The channel is available on DD Free Dish channel number 73 and on Dish TV and will focus on Punjabi songs and Punjabi movies to provide a wholesome entertainment diet to its north Indian viewers.

    DV Group has varied interest in specialised Ayurveda medicine, serious players in media and broadcasting segment with Maha Movie and now T TV and has plans to diversify in this segment with the aim of launching few more channels in different genres. The group is headed by the chairman Darshan Singh and MD Vishvajeet Sharma.

    T TV has sourced the best movies of yesteryears depicting the rich Punjabi culture and will showcase those movies to inculcate rich Punjabi heritage and will also air Punjabi songs which are universally acceptable to the entire Indian audience.
