    TDSAT directs BECIL to re-audit Digicable’s headend

    NEW DELHI: The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has asked the Broadcast Engineering Consultants (India) Ltd (BECIL) to make a further audit of Digicable Network India’s system on whether there is a foolproof and tamper proof mechanism to truly and faithfully record the number of subscribers receiving the signals at Ahmedabad in case the feed of signals is taken from the Delhi headend to that city.

     

    The Tribunal, which had earlier asked BECIL to conduct an audit of Digicable Network and received its report, gave this direction on a petition by Digicable seeking transmission of digital addressable system signals of IndiaCast Distribution to Ahmedabad.

     

    Listing the matter for 29 January, TDSAT chairman Aftab Alam and members Kuldip Singh and B B Srivastava asked BECIL to submit the report within 10 days from the date of receipt of a copy of the order.

     

    The Tribunal was not satisfied with the contentions of Digicable counsel Diggaj Pathak, who had relied upon the paragraph in the earlier BECIL petition making note of the unique package ID, which he said would sufficiently record the number of subscribers in Ahmedabad even though the feed may be taken from the Delhi headend.

     

    BECIL may also indicate the position in regard to the Gospel CAS, which finds mention in its earlier report, the Tribunal said.

     

    Pathak submitted that in case IndiaCast was not willing to execute an agreement on negotiated terms, it must still provide the signals of its channels to Digicable on its RIO terms in as much as the latter had expressed its willingness to execute the agreement based on the respondent’s RIO.

     

    IndiaCast objected to giving its signals to Digicable for retransmission in Gujarat on a number of grounds, one of which relate to the alleged lacuna in Digicable’s technical system.

     

    The Tribunal decided to presently leave aside other objections raised by IndiaCast (including non-payment of its dues) and only deal with the issue of the technical lacuna in the petitioner’s system. 

     

    The Tribunal noted that the earlier audit by BECIL was on a petition by Digicable last year against a notice of disconnection issued by IndiaCast, and the Tribunal had asked BECIL to examine Digicable headend. The report was given on 21 August. Even as the BECIL’s report was received before the Tribunal, it had been represented that the parties had resolved their disputes bilaterally and the petition filed by the Digicable was withdrawn.

     

    Digicable executed an interconnect agreement with IndiaCast on its behalf and on behalf of a number of its JV companies for retransmission of IndiaCast signals in different DAS areas in the country. The licence fee under this agreement is payable on CPS basis and does not cover Gujarat. 

     

    Pathak submitted that Digicable will take the feed of the signals from its headend located in Delhi to Ahmedabad for retransmission there. 

     

    IndiaCast counsel Kunal Tandon said the earlier report had shown that there is no proper bifurcation of subscribers or set-top-boxes (STBs) on the basis of locations of the petitioner’s CAS in Delhi.

    NEW DELHI: Star India has been permitted by the Telecom Disputes Settlement and Arbitration Tribunal (TDSAT) to send its representative to the head-end of Rajasthan Infotech Media Services Pvt Ltd for further verification despite the report of the Broadcast Engineering Consultants (India) Ltd (BECIL).

     

    The report by BECIL showed that the MSO’s systems were technically compliant with the statutory norms.

     

    However, Star India wanted to verify the correctness of the commercial details.

     

    Star India was therefore permitted by TDSAT chairperson Aftab Alam and members Kuldip Singh and BB Srivastava to obtain the commercial details, including SMS reports, from the MSO’s system for the past months.

     

    The matter has been listed for further hearing on 19 August.

    NEW DELHI: The Government said that permission holders of the first batch of FM Radio Phase III will have to pay Rs 9000 per channel, per city, per month as monitoring charges continuously to the Broadcast Engineers Consultants (India) Ltd (BECIL).

     

    This will be subject to an escalation charge of five per cent per annum on monitoring charges.

     

    The Information and Broadcasting (I&B) Ministry also put on its website the format of the Project Management Agreement between the permission holder and BECIL.

     

    Under the agreement, BECIL will make all reasonable endeavours to complete each of the activities in respect of the building, installation, commissioning and completion of the common transmission infrastructure (CTI) to the satisfaction of the first party for delivery to the permission holder in accordance with the timeline set out, provided always that the legal and beneficial ownership and all right, title and interest to all and any parts of the licence holder’s share in the Common Transmission Infrastructure (at whatever stage of completion) and the Equipment shall at all times remain with the licence holder and BECIL will not have any right at law or in equity and at anytime to make any claim of title or create any lien, charge or other encumbrance whatsoever over all or any parts of the CTI or the equipment.

     

    The obligations of BECIL have been set out in a clause and will automatically conclude upon the commissioning of the CTI. For the avoidance of doubt, the performance of equipment installed at the site shall be the exclusive responsibility of the licence holder.

     

    In terms of the Phase III FM Radio Policy, successful bidders have to co-locate transmission facilities on existing All India Radio/Doordarshan (Prasar Bharati) towers or towers to be constructed by BECIL as the case may be and common facilities have to be integrated by BECIL.

     

    The licence holders have to enter into an agreement with Prasar Bharati whereby Prasar Bharati has agreed to make available land and tower aperture for the cities from where the permission holders are operating to build, install and operate the common facilities and other equipment of the FM radio broadcast facility.

    MUMBAI: Broadcast & Media Technology 2015, second International Exhibition on Broadcast Equipment & Technology, will be held on 17 & 18 July at ITC Grand Chola, Chennai. Organised by All India Broadcast Manufacturers and Distributors Association, the exhibition is approved by ITPO and supported by FICCI, Prasar Bharati, Audio Engineering Society India and many other Indian and foreign organisations. Over 100 companies from 20 countries will showcase the latest products and technologies related to radio and TV broadcasting as well as film in the exhibition. Jawhar Sircar, CEO, Prasar Bharati will inaugurate the exhibition on 17 July.

     

    Addressing a press conference in New Delhi recently, Satish Aggarwal, President, AIBMDA said the response to the exhibition was very encouraging and most leading equipment manufacturers and distributors including AGIV India, Aditya Infotech, Barbizon Lighting, BECIL, Black Magic Design, CAT-5 Broadcast, CDM Technologies, Canara Lighting, Canon, Carl Zeiss, Cineom Broadcast, Comcon Technologies, Datapoint Impex, Datavideo, Delta4cast, Digital Solutions, Dolby, Essel Shyam, Falcon Technologies, FOR-A, Hansa Cine Equipments, Harman International, Hytech Communications, Ideal Broadcasting, Lamhas Satellite, MediaGuru, Modi Digital, Netweb Technologies, Panasonic, Pranav Mediatech, Primetech Communications, Real Image, Rohde & Schwarz, Ross Video, SRSG Broadcast, Sconce Global, Semyung India, Setron India, Singh World and Visual Technologies India had confirmed their participation in the exhibition while many others like  Vitec and Yasuka Corporation were in the process of doing so.

     

    S. C. Oberoi, Secretary , AIBMDA added that Broadcast & Media Technology 2015 was the biggest  broadcast technology show in South India. The show this year would be 40% bigger than the one held last year. He said arrangements were being made to invite engineers and professionals working in the broadcast and film industry including  AIR and Doordarshan from Chennai, Hyderabad, Bangalore, Kochi and Thiruvananthapuram  to the exhibition. Care is being taken to provide good value for money to exhibitors by creating an atmosphere conducive for fruitful interaction between buyers and sellers during the exhibition.

    NEW DELHI: The Broadcast Engineering Consultants (India) Ltd, which had earlier been directed by the Telecom Disputes Settlement and Arbitration Tribunal (TDSAT) to conduct an audit of Digicable Network in a case filed against IndiaCast, has now been asked to include issues relating to Sun Distribution Services in its audit.

     

    Earlier on 26 May, Sun had been denied permission to carry out an audit of Digicable on an objection raised by Digicable.

     

    However, in a separate order on 29 May, TDSAT had directed BECIL to carry out an audit in a case filed by Digicable against IndiaCast.

     

    The order by TDSAT chairman Aftab Alam and member Kuldip Singh today came on a miscellaneous application by Sun that BECIL may also address the apprehensions and suspicions of the Sun Distribution as regards the technical system of Digicable Network.

     

    The Tribunal said it found the request reasonable and directed that it would be open to having Sun Distribution Services’ representative present at the time of the audit of the Digicable’s system by BECIL.

     

    In case BECIL withholds the audit on the ground that it may damage the systems of Digicable Network, it would ensure that the data from the Subscriber Management System systems concerning Sun Distribution also may not be manipulated to give any false reports in future.

     

    On 26 May, Digicable had urged TDSAT not to allow Sun to undertake its audit on 24 July on the ground that the respondent was currently engaged in the replacement of its SMS.

     

    In the order of 29 May, BECIL had been asked to check and confirm whether Digicable’s Conditional Access System (CAS) and Subscriber Management System at its different headends are properly integrated and correctly and truly reflect its subscriber base. BECIL had also been asked to record the number of subscribers at the different DAS head-ends. BECIL was asked to conduct the technical audit of Digicable’s local areas with a view to find out whether there are any parallel systems running.

     

    Meanwhile in another case, Sun Distribution was asked not to disconnect the signals to Subodhaya Communications Pvt. Ltd. provided Subodhaya made payment of the amount mentioned in the notice as dues (Rs 8,98,544) within 10 days from today.

     

    Apart from the payment of dues, the petitioner shall continue to make payment of the monthly subscription fees on the basis of invoices raised by the respondent.

     

    Listing the matter for 14 July, the vacation bench of TDSAT said the payments would be without prejudice to the rights and contentions of the parties.

    NEW DELHI: Who is meant to maintain the monthly log of the activations of a particular channel: the multi system operator (MSO) or manufacturer, vendor or the supplier of the system?

     
    The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has asked the Telecom Regulatory Authority of India (TRAI) and the Broadcast Engineering Consultants India Limited (BECIL) for certain clarifications on the role of a MSO in the matter of maintaining monthly log of the activations of a particular channel.

     
    Listing the matter for 1 December, chairman justice Aftab Alam and member Kuldip Singh said BECIL will also clarify its finding on the point as to whether the system was not capable of generating the monthly log of activations on a particular channel or on a particular package or the system was not capable to do so without the matter being referred to its provider, that is to say, its manufacturer or supplier.

     
    The issue arose in a case of Den Networks against Sun Distribution Services wherein BECIL had carried out an audit of Den and given a report.

     
    Den submitted that though the provision of monthly log of the activations on a particular channel or on a particular package is indeed an obligation of the MSO, the use of the word ‘system provider’ makes it clear that the capability to provide monthly log of the activations on a particular channel or on a particular package should only lie with the manufacturer, vendor or the supplier of the system and the petitioner, which is an MSO, using the system can only obtain it from its vendor or ‘supplier’ of the system.

     
    TDSAT did not accept this submission and said, “Normally, the system in use in the hands of the MSO should itself be capable of providing monthly log of the activations on a particular channel or on the particular package without the matter being referred every time to the vendor, manufacturer or the supplier of the system.”

     
    The comments from TRAI and BECIL should reach the TDSAT within two weeks from the date of receipt of a copy of the order.

    NEW DELHI: The first meeting of the expert committee constituted earlier this year for the protection of broadcasting organisation at the World Intellectual Property Organisation (WIPO) will be held on 2 September.

     

    The aim is to discuss with members from broadcasting organisations and broadcasters to examine and articulate the stand being taken by India.

     

    The meeting will discuss the text of the broadcasting treaty and proposals submitted by India during the 26th SCCR; discussion on the informal proposal submitted by Japan; discussion on the proposal submitted by European Union and discussion on the formats circulated by WlPO secretariat. 

     

    The members of the committee include representatives of all the concerned Ministries, representatives of the News Broadcasters Association and Indian Broadcasting Foundation, the radio industry, the film industry, Prasar Bharati, Amit Shukla who is Director (Copyright) in the Registrar of Copyrights (copyright division) of the Department of Higher Education; BECIL; the Advertising Standards Council of India (ASCI); Centre for Media Studies (CMS); Community Radio Forum; Community Radio Association; Association of Regional Television Broadcasters of India; School of Legal Studies in Cochin; Cine & TV Artistes Association; the Film Federation of India; the Indian Music Industry and the Film & TV producers Guild of India.

    Broadcast & Media Technology 2014 makes a Good Beginning

    MUMBAI: Broadcast & Media Technology 2014, South India’s First International Exhibition on Broadcast Equipment and Technology was held on 18 & 19 July at ITC Grand Chola, Chennai. Organised by All India Broadcst Manufacturers and Distributors Association, AIBMDA, and supported by ITPO and FICCI, the exhibition was attended by 28 leading Indian companies representing more than 100 foreign principals from 25 countries. Some of the companies that displayed their latest range of products and services at the exhibition were AGIV India, BECIL, Benchmark Broadcast, CDM Technologies, Canara Lighting, Cineom Broadcast, Datapoint Impex, Datavideo Technologies, Falcon Technologies, Harman International, Hytech Communications, Ideal Broadcasting, Ikegami, MediaGuru, Netweb Technologies, Panasonic, Pranav Mediatech, Prime Tech Communications, Real Image, Ross Video, SRSG Broadcast, Setron India, Singh World, Visual Technologies and WASP3D.

     

    Right from the time the exhibition was thrown open to visitors, a constant stream of  engineers and professionals from radio and TV channels in Chennai, Bangalore, Cochin, Coimbatore, Hyderabad and Thiruvananthapuram strolled into the brightly lit exhibition hall. Among the dignitaries who visited the show were Mr. R. Roshan Baig, Hon. Minister for Infrastructure Development & Information, Govt. of Karnataka, who specially flew to Chennai to see the exhibition, Mr. N. Thiyagrajan, Chief Engineer South Zone, Doordarshan and members of the press. Mr. Prakash Javadekar, Hon. Minister for Information & Broadcasting, Govt. of India wished the exhibition well. Mr. Jawhar Sircar, CEO Prasar Bharati, who was scheduled to inaugurate the exhibition but could not make it due to the ongoing parliament session, also sent his best wishes for the success of the exhibition.

     

    Feedback received at the end of the exhibition revealed that the exhibition, spread over an area of 1,000 sqm, was appreciated by exhibitors and over 700  quality visitors who visited it over a period of two days. What they liked most was the conducive atmosphere provided by the hotel for holding meaningful discussions between buyers and sellers. When contacted, Mr. Satish Aggarwal, President, AIBMDA said ‘We plan to double the size of the exhibition next year’.  ‘But only after a thorough review and consultation with our members’ added Mr. S. C. Oberoi, Secretary, AIBMDA.

    BECIL to conduct audit of status of IndiaCast channels on Dish TV

    NEW DELHI: The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) today directed an independent audit by BECIL of the package of IndiaCast UTV Media Distribution, being carried by Dish TV to ascertain the number of channels being offered to consumers who opted for them.

     

    Meanwhile, chairman justice Aftab Alam and member Kuldeep Singh directed Dish TV to furnish a bank guarantee of Rs 15 crore to be submitted within 10 days. The case will now be heard on 15 July.

     

    The petitions by both sides came up today in the context of the earlier order of 19 December 2013, wherein Dish TV had committed that from January 2014, “it shall take all the 22 channels of the petitioner (with regard to which the fixed deal agreement comes to an end on 31.12.2013) out of its packages and put them on a-la-carte basis on its platform. In respect of the remaining 16 channels likewise, the respondent shall put them on a-la-carte basis on its platform, with effect from 1 April 2014 on expiry of the fixed deal agreement on 31 March 2014. No legal objection can be taken to the arrangement proposed to be made by the respondent.”

     

    Dish TV had then stated that “a scroll running on the TV screens will only say that after 31 December 2013 the 22 channels of the petitioner shall be available only on a-la-carte basis and invite anyone who want to subscribe to any of those channels on a-la-carte basis, to communicate on the SMS number mentioned in that scroll.”

     

    The dispute before the Tribunal related the number of people who had opted according to the scroll run by Dish TV and whether payment was made in that regard.

    Afghanistan to have 24-hour TV news channel with Indian expertise from Prasar Bharati

    NEW DELHI: Afganistan will have a news channel run by the public service Radio and Television Afghanistan (RTA) in the next three months which is expected to get technical help from Prasar Bharati.

     

    RTA today signed a Memorandum of Understanding with Prasar Bharati which will enable the two public service broadcasters to exchange programmes and India will extend help to Afghanistan in infrastructure. The MoU was signed by RTA director general Zarin Anzor and his counterpart in Prasar Bharati, Jawhar Sircar. Abdul Rahman Panjshiri, head of international relations in Afghanistan, was also present, apart from All India Radio Director General L D Mandloi and other officials.

     

    The news channel will initially telecast news for six hours but will gradually become 24×7 channel.

     

    Afghanistan will send ten journalists and editors to India for training with the public service broadcaster to upgrade their talent pool, particularly, for their proposed News channel.

     

    An MoU was signed by him and CEO, Prasar Bharati on 27 to further strengthen bilateral cooperation between the two countries in the field of broadcasting.

     

    As part of its programme of development and reconstruction of war-ravaged Afghanistan, the government has already been providing assistance in the field of Broadcasting and Telecommunication and implemented several projects in various parts of Afghanistan. Sircar said that Prasar Bharati has been helping Afghanistan earlier on an ad hoc basis, but this agreement formalized the framework.

     

    A number of transmission towers and television studios with modern equipment have been provided.

     

    RTA has a network of 24 TV transmitters with downlink facilities at various parts, one 100 KW Short Wave transmitter with seven antennas catering service to its neighbouring countries and one Uplink Earth station in Kabul providing connectivity.

     

    The Afghan delegation requested Prasar Bharati and the Broadcast Engineering Consultants (India) Ltd. (BECIL) to help in repair and maintenance of the existing transmission facilities such as Uplink, Short Wave transmitter, and TV network.

     

    As there are lot of similarities in Indian and Afghan culture, RTA is very keen to have Indian programmes related to serials, documentaries, scientific programmes, films, etc.

     

    Doordarshan has already agreed to send two senior TV producers to RTA to help improving the quality and bring creativeness and innovations in their home productions. Prasar Bharati has accepted the requests from RTA and has assured it all possible help in achieving their goals.

     

    Addressing mediapersons, Anzor said the Afghans are very fond of Indian films and understand Hindi and Urdu. However, he agreed that its radio wing could take programmes in Dari and Pushtu languages from the External Services of All India Radio.

     

    Sircar said that the exchange of programmes would be on a ‘gratis basis’ and India will bear the costs. There were possibilities of production as well, he added.

     

    Panjshiri said short wave signals were not dissipated, and so AIR should be able to provide signals in medium wave or FM as Voice of America was doing. He said that Afghanistan would also like to learn from the Indian experience in Digital Radio Mondiale (DRM).

     

    He said Afghanistan today had forty TV channels, four FM channels, and eight AM transmitters – in the private and public sector. There are five private news agencies apart from one run by the government.

     

    Anzor admitted that there had been lack of communication, when it was pointed out to him that Afghanistan could pick up the streaming of AIR bulletins from its website and broadcast this in that country.
