    Separate Broadcasting Policy, use last mile operator for broadband spread: TDSAT seminar

    NEW DELHI: There should be a separate Broadcasting Policy analogous to the National Telecom Policy, and the existing laws and regulations should be enforced more stringently before drafting new ones.

    This was one of the recommendations on regulatory issues in broadcasting and distribution sector at a seminar by the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) held early this year.

    The last mile cable network should be leveraged to provide broadband services, according to the recommendations placed on the website of TDSAT yesterday.

    A general consensus also said the government needs to ensure that the amendments in existing regulations do not lead to confusion and ambiguity with regard to the original objectives of the legislations.

    A more effective consultation process should be designed so that the stakeholders do not need to resort to the adjudicatory system, and there should be a more pro-active approach on the implementation of recommendations of the policy makers, the recommendations relating to broadcasting said.

    The seminar on the ART (Adjudication, Regulation, Telecommunication) of Convergence on 6 and 7 February 2016 was attended by government, policy makers, adjudicatory body, and service providers to deliberate suggestions to prepare for challenges that arise with a converging digital environment.

    The seminar was inaugurated by Information and Broadcasting Minister Arun Jaitley, Supreme Court’s Justice J. Chelameswar presided over the function, and Attorney General Mukul Rohatgi was the guest of honour.

    Jaitley stressed the need for an adjudicatory mechanism for telecommunications and broadcasting which is agile and responsive to deal with emerging challenges.

    The seminar was held with the support of Department of Telecommunications (DoT), Department of Telecommunications and Information Technology (DeitY), Telecom Regulatory Authority of India (TRAI), Justices from the Supreme Court and High Court, and representatives of the industry. Ernst and Young was the knowledge partner for the seminar.

    Regulatory and Licensing Regime in a converged environment

    The conclusion was the need to frame a simplified, resilient and comprehensive convergence law and regulation encompassing all activities and sections of the industry, which are currently governed by myriad laws and regulations.

    Separate mechanisms are needed for content and carriage regulation, with independent bodies for each of them. There needs to be converged licensing regime for telecommunications and broadcasting.

    It was also stated that there needs to be a clear and well-defined separation of regulatory and adjudicatory powers, with the adjudicatory powers vested in an independent authority. Strategic spectrum should be under the control of the government, while the commercial spectrum should be under the control of the regulator.

    The governance mechanism should be digitized and the processes should be made simpler to use. The existing laws should be amended keeping in mind their compatibility with other regulations and processes. Legislations should be made technology agnostic to provide a level playing field for all the stakeholders.

    Adjudicatory mechanism — issues and way forward

    It was stated that the law needs to be amended to bring more clarity regarding jurisdictional powers of TDSAT mandated in the TRAI Act apropos writ jurisdiction of the High Courts.

    A separate mediation centre is required for resolving minor cases, both pre-trial as well as post-trial, which do not require the specialized expertise of the judges of the Supreme Court.

    The original character of the TDSAT needs to be restored; in addition whether certain types of disputes should be entrusted to TRAI for resolution in order to improve the efficacy of the overall adjudicatory mechanism.

    There should be a fully integrated electronic tribunal and innovative technologies should be used to deal with cases rapidly and efficiently, the recommendations said.

    Training should be provided to all the stakeholders in the sector to eliminate the digital divide. Regulations need to be updated in accordance with the changing technology.

    Content distribution in next generation networks

    There should be clear, defined and uniform regulations for broadband, net neutrality, advertising, patents, and competition and pricing matters.

    There was unanimity that net neutrality should be ensured to safeguard the interest of all stakeholders in the internet ecosystem.

    A suitable patents and copyright system should be developed for India keeping in mind the specific concerns of the domestic industry.

    It was felt that the industry should not be over-regulated as this would dis-incentivize stakeholders and hamper the interests of both the content creators and the consumers.

    The behaviour of the stakeholders in the industry should be regulated instead of the economics of the industry, since regulation of the latter destroys business models while the former adds to both the consumers’ and the industry’s welfare.

    “I-way of the Future”

    It was felt that the challenge of slow implementation should be overcome through enhanced co-ordination among the stakeholders and the policy makers.

    A broadband highway needs to be built that ensures accessibility of high speed internet for everyone.

    Cyber security and privacy issues that arise due to the cross sector convergence and have standardized legislations for dealing with it needs to be addressed.

    A pro-active approach needs to be followed in policy making to speed up the creation and adoption of the next generation highway infrastructure.

    There should be a conducive business environment through policies that incentivize entrepreneurs and private participation. The expertise of the private sector should be leveraged. Start-ups needs to be encouraged to develop their capabilities and help build a compact, connected and coordinated network of smart cities.

    Auction of 2nd batch of 266 FM Phase III channels around mid-Sept

    NEW DELHI: The e-auction of the second batch of FM Radio Phase-III channels comprising 266 channels in 92 cities is to be held around mid-September this year. The channels include 227 channels in 69 fresh cities and 39 channels in 23 existing cities which had remained unsold as there were no bids.

    As in the first stage, the e-auctions will be conducted by C1 India Private Ltd and the process commenced on 20 June with the notice inviting applications (NIA).

    A Pre Bid conference will be held on 11 July 2016 at 2:30 PM and the last date for seeking clarifications on NIA is 14 July 2016 by 12:00 noon. Clarifications to NIA will be given on 21 July 2016.

    The last date for submission of Applications is 1 August 2016 by 5:00 pm. This will be followed on 16 August with the publication of ownership details of applicants. The Bidder Ownership Compliance Certificate will be issued on 22 August 2016.

    The Pre-Qualification of Bidders will be done by 1 September 2016 or completion of requisite formalities whichever is later, followed four to five days later by a Mock Auction.

    The main auction will start four days after the mock auction.

    The first payment of 25 per cent of the Successful Bid Amount will be made within five calendar days, and the remaining within 15 calendar days of the close of the Auction and notification of successful bidders by the government.

    The e-auction of the first batch of private FM radio phase-III comprising 135 channels in 69 Phase-II existing cities commenced on 27 July 2015 and was completed on 9 September 2015 after 125 rounds of bidding. Out of these, no bid was received in 13 cities having 26 channels, and partial bids were received in 9 cities with 12 channels remaining unsold, which Information and Broadcasting minister Arun Jaitley justified on the ground of “the demand – supply based market economics and bidder’s strategy”.

    However, he told Parliament on 4 December 2015 that the Ministry had received the full payment of Rs.1,055.9 crore notified on 16 September 2015 by 1 October that year

    Against the cumulative reserve price of Rs.550.18 crore for 135 channels, the government received aggregate provisional commitment of Rs.1156.9 crore for 97 channels in 56 cities. Out of 97 channels, 53 channels in 35 cities were sold at a premium over reserve price whereas 44 channels in 21 cities were sold at reserve price.

    The Ministry had decided to conduct e-auction of FM Radio Channels in batches under the extant FM Phase-III Policy.

    For the second batch, the Simultaneous Multiple Round Ascending e-auction process will be carried out for allotting the FM channels, conducted over the Internet. Bidders will be able to access the Electronic Auction System to be used for participation in the Auctions using web browsing software: Internet Explorer 11.x, or Mozilla 34.x. The EAS is a designated computer resource for the receiving of electronic records under the provisions of Section 13(2) of the Information Technology Act 2000, as amended from time to time.

    While issuing the notice for inviting applications, the government said it reserved the right to summarily disqualify any pre-qualified Bidder, at any stage of the Auction or after the Auction is completed on grounds of noncompliance with eligibility conditions, misrepresentation, non-compliance with the Auction Rules, non-compliance with any other pre-condition prescribed for participating in the Auction or for getting the FM channel, or any matter that may, in the opinion of the government, be contrary to general public interest.

    Interested parties were asked to get a copy of this document and any subsequent amendments to the NIA from the MIB website, www.mib.nic.in.

    Before operating the FM service a separate specific license i.e. Wireless Operating License shall be obtained by the company from the WPC (Wireless Planning & Co-ordination) Wing of Ministry of Communications & IT, permitting utilization of appropriate frequencies/band for the establishment and operation of concerned wireless component of FM radio Service under usual terms and conditions of such license. The Grant of such License shall be governed by the rules, procedures and guidelines and shall be subject to compliance with all requirements of the WPC wing.

    Winning Bidders of FM channel(s) in each city shall be determined in the first stage, a Channel Allocation Stage, which will allocate FM channel(s) simultaneously for all the cities. A second stage, a Frequency Allocation Stage, will identify specific frequencies for the Winning Bidders. More specifically, the two stages shall operate as follows:

    The Channel Allocation Stage will allocate number (count) of FM Channels in each of the Cities to the winning bidders. In this stage, Bidders in each City will bid for number of Channels only without linkage to any specific Radio frequency. This stage will consist of a number of Clock Rounds. These rounds will stop once the Auction Activity Requirement is 100 percent and there is no bid submitted by any of the bidders for all Cities in all the channels.

    Speaking on the prestigious win, RJ Balaji said, “Nobody imagines for a disaster like this to occur. For the first time, an RJ and an actor teamed up and brought the spirit of the city alive. I am humbled at receiving the Indian of the Year Award. However, this award does not belong to me. It belongs to the lakhs of volunteers who extended their support to the social movement. It belongs to and represents the people of Chennai. The catastrophic Chennai floods were an awakening for not only the people of Chennai; but for the nation too. The Chennai floods were the worst disaster in 100 years and also the best thing that happened to us in decades. We all were wearing a mask being made out of caste, creed, religion, race, money and authority, but all those mask were washed away by the rain and we understood that we are all just humans after all and all that matters is to remain one. It brought out the true spirit and volunteerism of the people in Chennai to help each other at the time of need. It was for this reason that the city was able to bounce back in a week.”

    New Delhi: Around 95% of the Plan expenditure of Prasar Bharati currently involves technical equipment and the endeavour is to provide momentum to technical infrastructure projects, Information and Broadcasting Ministry Arun Jaitley said today.

    Answering a question in Parliament about Revised Estimates (REs), he said these are prepared to optimize utilization of allocated funds according to the progress of various projects and time schedule of supply of equipment/works.

    Out of the REs during the last three years, reduction in RE during 2013-14 with reference to Budget Estimate (BE) of that year was marginal.

    During 2014-15, reduction in RE was largely due to cancellation of tenders received on e-procurement portal, Cancellation of tenders on techno-commercial evaluation, delay in supply of equipment etc.

    During the year 2015-16, RE was reduced due to various reasons such as time taken regarding decision on clustering & de-clustering of digital transmitters, non participation of bidders in tendering process etc. 

    The alternatives available for the technical/technology choices and the plan of action, with the chosen technology, require wide consultations which consume time and, to prevent sub-optimal choices, expenditure is postponed. This, at times, leads to reduction in plan expenditure at RE stage. This also was a contributing factor in the last two years. 

    Doordarshan follows rules & procedures based on the guidelines given in the Directorate General of Supplies & Disposals (DGS&D) Manual, GFR 2005 and Central Vigilance Commission (CVC) guidelines for procurement of Capital equipment/Turnkey projects on Supply, Installation, Testing and Commissioning (SITC) basis etc.

    Tenders are invited through e-procurement mode, as per the mandate of Ministry of Finance, and according to the Standard Bidding Document prescribed by the Prasar Bharati. Ministry/Prasar Bharati have no plans to follow the policy (ies) of private broadcasters in so far as procurement of equipment/finalization of tenders is concerned.
