    Viacom18 secures dynamic injunction order to combat Bigg Boss copyright infringement

    Mumbai: In a significant legal triumph, Viacom18 has successfully obtained a dynamic injunction order from the Hon’ble Delhi High Court, marking a significant milestone in its unwavering fight against copyright infringement. The order grants Viacom18 the authority to protect from infringement of the ongoing reality shows, including Bigg Boss Hindi, Bigg Boss Kannada and the upcoming Bigg Boss Marathi.

    Bigg Boss, a highly popular reality show celebrated for its distinctive format featuring contestants from diverse backgrounds cohabiting and undertaking challenges for the coveted prize, is broadcast on the Viacom18 network through its COLORS branded Hindi and regional channels and on the JioCinema OTT app.

    The Delhi High Court, in its recent order, directed various rogue and pirate websites to be suspended/locked by respective domain name registrars. The court recognised the immense popularity of the shows in India and acknowledged Viacom18’s right in protecting the content. The order specifically restrains the rogue websites mentioned in the suit and further instructs Internet Service Providers (ISPs), the Department of Telecommunications (DoT), and the Ministry of Electronics and Information Technology (MeITy) to block access to such rogue websites. The order also allows Viacom18 to add any additional infringing websites using the name “Bigg Boss” in their domain or any other websites that are telecasting the program ‘Bigg Boss’ illegally and extend the injunction to such additional websites as well. This action aims to curb piracy and safeguard Viacom18’s substantial investment in producing and broadcasting these shows.

    This dynamic injunction order empowers Viacom18 to enforce its exploitation and broadcasting rights for the upcoming Bigg Boss events, ensuring that infringing activities are promptly addressed.  

    Commenting on the court’s decision, Viacom18 general counsel Anil Lale stated, “The issuance of this Dynamic Injunction Order underscores the court’s profound recognition of the inherent value of content and the pressing need to combat piracy in real-time. The proactive stance taken by the Honourable court provides invaluable support in our continuing fight against piracy.”

    Mumbai: Viacom18 has secured a broad dynamic injunction from the Delhi High Court for the Indian cricket team’s bilateral matches.

    Recently, to strengthen its hold in the sports broadcasting industry, Viacom18 had bagged the BCCI linear and digital right in a three-way bidding war between Viacom18, Sony and Star. As a result, for the next five years i.e., from September 2023 till March 2028, all bilateral games involving the Indian cricket team that will be played in India along with domestic cricket, shall now be broadcasted/streamed by Viacom18 on its television and OTT properties. With this Viacom18 has also become the prominent sports destination as it already has the digital rights for the Indian Premier League (IPL), Women’s Premier League (WPL) and other major sporting events like the Olympics 2024, MotoGP 2023, La Liga, Diamond League etc.

    The new sports broadcasting leader, Viacom18 Media Private Ltd, had approached the Delhi High Court seeking an ad-interim dynamic injunction to protect its Media Rights in relation to the BCCI Events against various rogue and pirate websites as well as John Does/Ashok Kumars/Unknown Defendants. The Court while expressing its concerns regarding the unending menace of piracy noted that the courts have become inundated with suits pertaining to such issues and suggested the importance of a robust anti-piracy policy to curb the issues. The Court observed that a prima facie case for interim injunction was made out and further held that the grant of an injunction would be necessary to avoid irreparable loss/injury from being caused to Viacom18.

    The court further ordered that Viacom18 shall not be bound to initiate any fresh proceedings in relation to any new alphanumeric/redirect/mirror websites that are expected to mushroom during the course of the BCCI events. Access to such websites shall be blocked by the Internet Service Providers (IPSs) upon being informed about the same by Viacom18 on an affidavit. This dynamic injunction provides Viacom18 to swiftly act against pirates and rogue websites infringing and making available the BCCI matches without due permissions. With this effective dynamic injunction Order from the Delhi High Court, Viacom18 has set the field to ensure a smooth exploitation of its rights and bowl-out any infringing and pirated content.  

    Such dynamic injunction orders re-affirm and assure the owner/licensee/assignee of IP rights that the humongous capitals invested in relation to such rights shall be protected against pirates and infringers. With such orders being passed by the courts, it has also become possible to unearth the identities of those hiding behind the cloak of anonymity on the internet and book them for their illegal actions.

    Mumbai: An FIR was registered on a complaint filed by Viacom18 at Banaswadi police station, Bangalore against a suspect who was arrested on 12 August. Viacom18 received a tip from Cinepolis, Orient Mall, Bangalore, and made the arrest.

    During the investigation, police discovered incriminating evidence, and there is the possibility of an organised crime syndicate operating in the realm of illegal uploading and distribution of the film “Laal Singh Chaddha” and other pirated content.

    According to a preliminary police investigation, the accused may be involved in a larger piracy racket with websites such as Tamilrockers and Primerockers, which are engaged in uploading and illegally distributing pirated content. Because of their illegal actions, such pirate websites cause huge losses to producers, content owners, and creators.

    The arrest of the accused is a ray of hope for all content creators, and it could be a significant step toward action against pirates, as well as a sigh of relief for the industry.

    The company believes larger pirate networks may come to light as a result of this arrest, and the offenders may be prosecuted.

    Viacom18 recently obtained injunctive relief from the Madras High Court against a number of more than 12,000 specific websites/links, specified cable operators, internet service providers, as well as unknown individuals, prohibiting them from violating the film “Laal Singh Chaddha” or any part of it by copying, recording, reproducing, distributing, or downloading, etc. in any way without proper authorisation.

    MUMBAI: In its endeavour to fight counterfeit products and illegal usage of Intellectual Property (IP), Viacom18 Media Pvt. Ltd. joined hands with Economic Offence Wing of Mumbai Police to conduct raids on businesses trading in counterfeit products of its popular kids brand Peppa Pig. The raids conducted at Choice Gifts in Abdul Rahman Street and Rolex Novelty at Princess Street in Mumbai collectively seized a sizeable amount of counterfeit merchandise.

    Anil Lale, General Counsel, Viacom18 said: “The Govt. of India has taken up the issue of piracy and illegal usage of IP significantly over the past few years and we are proud to have worked with public agencies such as Department of Industrial Policy and Promotion, Maharashtra Cyber Crime Cell and Mumbai Police’s EOW to amp up these efforts. It is important to acknowledge that sale and purchase of counterfeit products are as serious offences as piracy since it takes away from the brand’s loyalty and diminishes its value for the creator.” He further added, “As rightful exclusive licensees, we feel its our duty to the customer – which in this case are young children, to safeguard their interest against fake products.”

    The Economic Offenses Wing of Mumbai Police has been at the forefront of a rigorous fight against counterfeit products. Over the course of last year alone they have been able to seize surreptitious businesses that trade in counterfeit products, severely denting the illegal counterfeit merchandizing business.

    MUMBAI: Traditional linear television needs to be free from the chains of regulations, and OTT entertainment platforms need to be left clear from any fresh legislation. That was the conclusion of the second panel at the sixth annual Media, Advertising and Entertainment legal summit 2017 which focused on whether the fresh emerging digital communication and entertainment should be allowed to function unfettered.

    The panel discussion on “The New Digital India Wave – An Untamed Beast” moderated by Castle Media CEO Vynsley Fernandes featured Indiantelevision.com founder, CEO and editor-in-chief Anil Wanvari, Alpha Partners associate partner Kunal Arora, Viacom 18 senior vice-president head business and legal affairs Anil Lale, Dhir & Dhir Associates’ partner KPS Kohli and Sony Pictures Entertainment head legal Ayan Roy Chowdhury.

    Wanvari began the discussion by giving a lay of the OTT landscape, emphasising that streaming services, social media platforms, and communication tools such as Snapchat, Skype, Whatsapp, Hike and Messenger, among other, are here to stay and they have seen very rapid uptake.

    “The next six months to a year are really going to see their adoption accelerating even further, courtesy dropping bandwidth prices – which are going to be shaved even further because of competition amongst the telcos,” said Wanvari. “This is going to lead to video consumption becoming more affordable for the masses and the explosion in data consumption will be like we never even imagined.”

    Wanvari pointed out that many of the OTT services have been promoted by broadcasters the services of which are already governed by the Programme Code, the Copyright Act, the Cable TV Regulations Act, and they adhere to strict standards and practices to ensure that they don’t go afoul of the law.

    “Broadcasters rely on self-regulation, and if there is a violation, the Broadcast Complaints Council ensures that the violator is brought in line,” added Lale.

    Arora stated that, as of now, there are no specific regulations governing OTT services – especially the communications services, though a consultation paper was floated by the Telecommunications Regulatory Authority of India (TRAI) in 2015.

    “One concern that I hear from the industry for the non-communication space that content can’t be regulated absolutely, while, for the communication-based OTT, it becomes quite essential to govern the content. For non-communication space, regulation is important from the pricing perspective. Just to keep things moving in the same direction, regulation should be drafted to make sure that the growth of the OTT sector doesn’t hamper or restrict the growth of the traditional sector, ” he added. “Also, with the amount of content flowing over the internet and on OTT services, monitoring and policing each one’s content could be very challenging for any government.”

    Fernandes interjected here saying that technology can intervene here, especially in cases of national security. “In the valley, the government could ask all traditional media to shut down during the time of crisis,” he said. “But, can digital media be controlled so as the servers are located outside India and don’t fall under the country’s jurisdiction?” he questioned.

    To this, Wanvari stated that the controls lie with the authorities as an order from either the TRAI or the home ministry or telecom ministry to the telecom and internet service providers can result in the complete shutdown of the internet in a geographical area which is under threat and totally defuse it.

    “There is this argument of a lack of a level-playing field between traditional media and digital media. There are two kinds of players,” said Arora. “Those which are international, and those which are promoted by indigenous players or groups. You see the more edgy content on the international OTT players, whereas the Indian ones are relatively adhering to the programming and content regulations as mandated for TV.”

    Kohli said, “For digital media there is no regulation. Their content is far more attractive to at least the younger generation because there is a little more skin and possibly abusive language. The traditional media is bound by rules and regulations, and hence it is controlled.”

    Lale mentioned that television has very few controls at the subscriber end, and the Indian families, as a whole, have to watch a little mature content, hence broadcasters have to be more careful. “On digital, because the content is available on your phone or laptop, the content is under your control. If you look at the AVoD service, you will not find content which is more mature – exactly as on TV – but, while on SVoD, you will get content like Games of Thrones. Hence, the payment also comes in this matter. GoT is the example that how regulations should be separated for digital and linear TV,” he said.

    Chowdhury said, “In India, whether we are paying to the service provider or we are paying to the government, in the form of direct-indirect taxes, levy or premiums, we pay for everything. So, there is no reason for the consumer to not shift from non-paying audience to paying audience. Also, the access cost is very less, so it is happening.”

    The panel was totally in agreement that there are enough regulations in place right from the Indian Penal Code, the Copyright Act, to haul up violators, if any, even on the piracy front. “The basic issue of piracy is enforcement. We don’t need a separate regulatory body for OTT services. We have self-regulation,” said Kohli. The government has the EMMC and IPC and various acts to stop the piracy on the web. But, the issue is who’s going to execute, whether you go to the police and enforce it, or is there any technical way of enforcement.”

    Roy Chowdhary proferred that, “Basically, enforcement should come from technology but telecom providers don’t want any controls as more data that is consumed the more they earn. But, if they are not open to cracking down on it, we can turn to blockchain which has an answer to it, which to a large extent curtails piracy.”

    This is Lale’s second stint with Viacom18 where he is returning to head the business legal function across its various verticals.

    “Apart from litigations, I will oversee the group’s overall business and legal proceedings that include contract negotiations as well,” Lale told Indiantelevision, confirming his appointment at Viacom18.

    His previous stint as group general counsel at Zee Entertainment Enterprises Ltd (ZEEL) saw him setting up a new and vibrant legal team and streamlining the legal functions. Within a span of two years, the legal team at Zee was recognised as the best in-house bunch of lawyers in media by Legal Era that also heaped recognition and awarded it for so.

    Lale had left Zee mid-July this year, as reported by indiantelevision.com.

    This would be a homecoming of sorts for Lale who had worked at Viacom18 from 2009 to 2014.

    MUMBAI: Zee Entertainment Enterprises Ltd (ZEEL)’s Anil Lale has put in his papers and is stepping down from his position as head of legal and group general counsel.

    A source close to the broadcaster informed, “ Anil Lale has officially put down his papers and is currently serving his notice period. He will stay in office till mid July.”

    Lale joined ZEEL on 26 August 2014, where he lead a growing legal team that enabled Zee’s media businesses across the world and managed all related litigation. This included the broadcast business of entertainment and news with a portfolio of 36 channels, international distribution and carriage of television channels across platforms throughout the world and content licensing of television programs, movies and formats across the world.

    Lale’s duties also included legal matters related to content production of television programs and Bollywood films, music label under the brand Zee Music Company where music is produced, acquired and licensed across platforms. Apart from this he was looking after the digital businesses including one of the largest OTT platforms (Ditto TV), commercial web portals and upcoming ventures in the digital space and news print business under the brand DNA.

    Prior joining ZEEL, Lale worked with Viacom 18 as a legal associate vice president.
