    Trai seeks views on carriage & placement fees and carriage of minimum channels

    MUMBAI: The Telecom Regulatory Authority of India (Trai) has issued a consultation paper seeking comments from all stakeholders on placement and carriage fees and also over the requirements of minimum channel carrying capacity to be set up by MSOs.

    These three provisions in the Interconnection Regulations have been set aside by the Telecom Disputes Settlement & Appellate Tribunal (Tdsat) on petitions by MSOs.

    The consultation paper issued on Thursday also attempts to make amendments to the Tariff Order applicable for addressable systems – both MSOs and direct-to-home (DTH) services, through the consultation process. Trai has sought responses from stakeholders on its plan to link the prices of channel bouquets and individual (or a-la-carte) channels, to make it mandatory for provision of both free-to-air and pay channels on a-la-carte basis and to restrict offer of channels requiring special type of STBs only on a-la-carte basis or as part of separate bouquets that consists of only those category of channels that require a particular type of specialised STB.

    Trai has called for submission of views and reasons thereof by all the stakeholders by 11 January.

    Responses Sought on following issues related to amendments to the Interconnection Regulations:

    Whether the following proviso should be introduced in the clause 3(2): "provided that the provisions of this sub-regulation shall not apply in the case of a multi-system operator, which seeks signals of a particular TV channel from a broadcaster, while at the same time demanding carriage fee for carrying that channel on its distribution platform."

    Clause 3(2) has safeguards with regard to charging of carriage fee: (1) Carriage fee to be transparently declared in the RIO of the MSO, (2) The carriage fee is to be uniformly charged (3) The carriage fee not to be revised upwardly for a minimum period of 2 years, and (4) The details of the carriage fee are to be filed with the Authority and the Authority has a right to intervene in cases it deems fit.

    Trai said if any of the stakeholder is against this provisions, it should state the reasons thereof.

    (a) Whether there is a need to specify certain minimum channel carrying capacity for the MSOs in the interconnection regulations for DAS.

    (b) If yes, what should be the different categories (example cities/town/rural area) of areas and the minimum channel carrying capacity for each area.

    Whether there is a need for regulating the placement fee in all the Digital Addressable Systems. If so, how it should be regulated. The stakeholders have been asked to submit their comments with justifications.

    Responses sought on following Issues related to amendments to the Tariff Order applicable for Addressable Systems:

    Trai has suggested (a) a ceiling on the a-la-carte rates of pay channels forming part of bouquet(s) which shall not exceed three times the ascribed value of the pay channel in the bouquet and (b) that the a-la-carte rates of pay channels forming part of bouquet(s) shall not exceed two times the a-la carte rate of the channel offered by the broadcaster at wholesale rates for addressable systems.

    The stakeholders have been asked to offer their comments on the above conditions to prevent perverse a-la-carte pricing of the pay channels being offered as part of the bouquet(s). The stakeholders can also submit any other formulation that can achieve the same objective, along with its justification.

    To deletion of the word "Pay" to make it mandatory to offer both free-to-air and pay channels on a-la-carte basis. Trai calls it: "Freedom to choose the channel(s) on a-la-carte and/or bouquet(s)."

    Whether the channels that require special type of STB be offered only on a-la-carte basis or as part of separate bouquets that consists of only those channels that require a particular type of specialised STB.

    Bankrupt video game maker THQ finds a buyer in Clearlake Capital

    MUMBAI: Video game maker THQ, which has filed for bankruptcy, said it has entered into an asset purchase agreement with Cearlake Capital Group which has agreed to acquire the assets of THQ‘s operating business, including THQ‘s four owned studios and games in development.

    Clearlake has agreed to serve as the "stalking horse bidder" for a sale process, which allows other interested parties to come forward with competing bids.

    Aggregate consideration offered by Clearlake for the purchase totals approximately $60 million, including a new $10 million note for the benefit of the company‘s creditors. The company is asking the Court for a schedule to complete the sale process in about 30 days.

    The company‘s foreign operations, including Canada, are not included in the filings.

    The company has also obtained commitments from Wells Fargo and Clearlake for debtor-in possession (DIP) financing of approximately $37.5 million, subject to Court approval.

    THQ will continue operating its business without interruption during the sale period, subject to Court approval of THQ‘s first-day motions. All of the company‘s studios remain open, and all development teams continue.

    As part of the sale, the company is seeking approval to assume the contracts of these studios, and Clearlake will assume these contracts.

    "The sale and filing are necessary next steps to complete THQ‘s transformation and position the company for the future, as we remain confident in our existing pipeline of games, the strength of our studios and THQ‘s deep bench of talent," said THQ Chairman and CEO Brian Farrell.

    "We are grateful to our outstanding team of employees, partners and suppliers who have worked with us through this transition. We are pleased to have attracted a strong financial partner for our business, and we hope to complete the sale swiftly to make the process as seamless as possible."

    MUMBAI: Leading direct-to-home operator Dish TV has added two Bengali news and entertainment channels, Rupashi Bangla and Kolkata TV, to its lifetime free offer for the four metros.

    Under this offer, customers will be eligible to receive a basic channel tier comprising 70 plus channels free of cost for life. The offer spans for five years and requires customers to remain active by subscribing to a regular package at least twice during the year.

    The two Bengali channels, along with 70 plus free channels offered under Lifetime Free offer, is to only customers in Kolkata acquired after the announcement of this offer.

    Dish TV COO Salil Kapoor said, "By adding two popular Bengali news and entertainment channels to the lifetime basic tier free offer, we’re extending ourselves as a more personalised option to Dish TV subscribers in Kolkata."

    MUMBAI: Global pay-TV market added nearly 47 million subscribers in 2012 reaching a total of 864 million subscribers.

    ABI Research VP and practice director of core forecasting Jake Saunders said, "The growth in satellite, cable, and IPTV markets was strong, although digital terrestrial TV growth was flat in 2012. ABI Research expects that the pay-TV market will continue to grow in 2013 to reach 907 million subscribers".

    Worldwide IPTV subscriber base has been increasing rapidly over the past few years. In 2013, the worldwide IPTV subscriber base is expected to add over 9 million subscribers to reach 79.3 million. More than half of the net addition will be from Asia-Pacific; China alone is expected to add more than 3 million subscribers.

    The cable TV market will remain strong, especially due to the growth in Asian Pacific markets such as China and India. Cable TV will maintain the largest market share of the overall pay-TV market in 2013. However, rapidly growing IPTV will cause cable‘s market share to decline to 65.4 per cent in 2013 from 66.2 per cent in 2012.

    At present, 33 per cent of worldwide pay-TV subscribers are using High Definition (HD) TV services. HDTV penetration is the highest in North America followed by Western Europe; accounting for 84 per cent and 76 per cent of total pay-TV subscriptions respectively. As many of the countries in different regions are trying to switch over to digital transmission, the number of HD channels and packages offered by the operators increase.

    Research analyst Khin Sandi Lynn said, "Worldwide HD service adoption is expected to grow. ABI Research forecasts that 38% of global pay-TV subscribers will be subscribing to HDTV services in 2013".

    With this launch, Aaj Tak will now be accessible to viewers in Ontario, expanding Aaj Tak’s presence in the Ontario market.

    Mobile TV industry group OMVC to integrate functions within Nab

    MUMBAI: The Open Mobile Video Coalition (OMVC), which has served as the principal proponent for Mobile Television since 2007, has announced that it will integrate functions with the National Association of Broadcasters (NAB).

    Effective 1 January, key functions currently coordinated by the OMVC executive director, including OMVC’s technical groups, advocacy efforts and marketing activities, will be integrated into the Nab.

    Anne P. Schelle, who has served as OMVC’s executive director since shortly after it began, said: “The purpose of the OMVC was to help develop a Mobile TV standard, create an ecosystem for broadcasters, manufacturers and other interested parties and to encourage device development. We’ve done that, and with the recent launch of Dyle mobile TV, operated by a consortium of broadcasters known as the Mobile Content Venture, and similar activities by the Mobile500 Alliance, Mobile TV is available in more than 35 US markets covering some 55 percent of the population. Integration with the NAB is the logical next step as the commercialisation of Mobile TV enters its next exciting phase”.
    Nab president, CEO Gordon Smith applauded the OMVC’s work and pledged the association’s full support for building further momentum for Mobile TV.

    MUMBAI: Russia Today (RT), the global international news network, has switched all of its English-language news broadcasting to High Definition (HD) format, effective 16 December.

    The switch to HD was enabled by RT‘s move of its studios and headquarters offices to a brand new facility in Moscow, the news broadcaster said in a statement.

    The HD broadcasting launch marks another important achievement by RT, while such delivery is not yet offered by many other major international news channels.

    "We are incredibly proud of everything we have accomplished in just seven short years. The switch to HD is just the next step as we continue to grow and expand. The upgraded capabilities of our new, technologically sophisticated facility allow us to stay ahead of the competition," RT editor-in-chief Margarita Simonyan said.

    When RT first launched its 24-7 news broadcast in December of 2005, it employed some 300 journalists and consisted of just one TV channel, airing in English.

    Today the network boasts the staff of more than 2000 professionals, and its five channels broadcast in English, Arabic and Spanish, reaching 550 million people in more than 100 countries around the globe.

    In 2012, RT became the first Russian TV channel ever to garner a second nomination for the prestigious International Emmy award for its news coverage.
