    The MLC sues Spotify USA for unpaid royalties

    Mumbai: The Mechanical Licensing Collective (The MLC) has announced that it has filed a legal action against music streaming platform Spotify USA Inc. (Spotify) in the United States district court for the southern district of New York. The action seeks recovery of unpaid royalties due under the compulsory mechanical blanket license obtained by Spotify to reproduce and distribute musical works in the United States via its consumer music streaming platform.  

    The action states that, beginning in March 2024, Spotify asserted that its premium individual, duo and family subscription streaming plans were now bundled subscription offerings because those plans included access to audiobooks. Applying the rate formula applicable to bundled subscription offerings results in a reduction of the service provider revenue that Spotify reports, which results in an underpayment of royalties.

    The MLC believes that Spotify’s position does not comply with applicable law and regulations. The MLC has statutory authority to address Spotify’s noncompliance with its royalty payment obligations. The MLC is taking legal action to enforce these obligations and ensure that Spotify pays all royalties due from its use of songs on premium plans.

    “The MLC was designated by the Register of Copyrights to administer the blanket license and is the only entity with the statutory mandate to collect and distribute blanket license royalties and take legal action to enforce royalty payment obligations,” said The MLC’s CEO Kris Ahrend. “The MLC takes seriously its legal responsibility to take action on behalf of our Members when we believe usage reporting and royalty payments are materially incorrect.”

    The MLC seeks corrected usage reporting and associated unpaid royalties for periods dating back to March 2024, along with an order requiring compliance going forward. A copy of the complaint can be found here.

    Mumbai: KC College officially inaugurated its 10th International Media Summit, 2024, hosted by the Mass Media Department, on 6 March March, 2024, at the Churchgate campus.

    Themed “An Evolving Mediascape: Storytelling in the Time of AI,” the summit delved into the transformative impact of artificial intelligence (AI) on contemporary storytelling practices, attracting media enthusiasts, professionals, and thought leaders alike.

    The summit was inaugurated with the lighting of the lamp and included interesting speeches by the convenor, co-convenors, and the chief guest, HSNC University vice chancellor Dr Hemlata K Bagla.

    The inauguration was followed by an enlightening keynote speech by the founder of Storytellers, Soumitra Sen. He adeptly examined AI advising a balanced approach: “Go along with digital, but be attached with physical.” Emphasising human uniqueness, he highlighted the significance of cultivating curiosity and emotional intelligence, stressing that unpredictability is essential to outsmart AI.

    Dr Sandeep Athavale, chief mentor at EduGameLab at TCS, in another keynote address, highlighted the AI’s creative potential, stating, “Power of New – humans can create something new, as for AI whatever pattern it is aware of, it will be able to create.” He explored AI’s impact on educational games and its role in reshaping storytelling for an evolving mediascape.

    A puppeteer and TedX speaker Sangya Ojha showcased her expertise in puppetry and voiceover integrating traditional puppetry with AI insights. Her session emphasized the importance of balancing technological innovation with maintaining a human touch. Ojha’s poignant quote echoed the sentiment: “Let’s make AI an aid rather than a crutch.”

    The Barabari Project founder Harihar Menon discussed inequality and GDP correlation. The initiatives of the project includes promoting media literacy and employment in tech for marginalized communities.

    KA Pandit actuarial analyst Rakhi Mishra showcased AI’s transformative role in insurance, emphasizing its ability to boost productivity and customer satisfaction. She highlighted AI’s applications in fraud detection, underwriting, and streamlined insurance claims processing through a compelling video demonstration.

    The summit was then concluded by the paper presentations by various media professionals and students which included several interesting topics like, “Mimicking the Muse: Analyzing AI’s Impersonation of Deceased Poets”, and “The use of AI for personalized news content and delivery”, and many more.

    Mumbai: Association of Investment Bankers of India (AIBI), the investment bankers’ sole representative body to SEBI and various statutory authorities, has unveiled nine game changing initiatives at AIBI’s Annual Convention 2023-24. The Annual Convention was centered on the theme ‘Ease of Capital Formation’ in India. Securities and Exchange Board of India chairperson Madhabi Puri Buch launched a few of these initiatives.

    Aimed at raising the investor awareness while promoting financial literacy, a total of four initiatives were unveiled namely:

    •    Investor Section on AIBI Website
    •    An Aggregated Live Database of Current ECM Issuances
    •    Videos of upcoming IPOs
    •    Animated Video for Investors on ‘Know IPO Investing’

    Similarly, three initiatives such as standard practice manual for IPO offer documents; revamped AIBI due diligence manual; and compendium of AIBI advisories were unveiled, aiming towards building capacity, strengthening the institution of merchant banking, and achieving ease of doing business in capital formation.  

    Additionally, AIBI is also focusing on creating a robust investment culture in India, making it their brand tagline. AIBI Mascot called AIBI Chankakya – The Investment Banker was also unveiled to boost the visibility of AIBI.

About INR 1.5 lac crores of equity funds garnered through IPO & Post-IPO transactions. In another global showcase, Indian IPOs have performed well post-listing. Interestingly, the average Indian IPO multiple in CY23 was 35 as against the related average Industry PE multiple of 63.” expressed AIBI chairman & Pantomath Capital Advisors MD Mahavir Lunawat.

    Lunawat further added, “With a galloping economy, a sizable population, and a robust regulatory framework, India has become the most desirable location for investors looking to capitalize on the nation’s potential.     Mumbai: Arthritis isn’t just a single disease; it’s a term that covers over 100 different conditions affecting joints and their surrounding tissues. It’s a leading cause of pain and disability worldwide. While it affects people of all ages, genders, and races, studies and my experience indicate a startling gender disparity in its prevalence and severity.

    What stands out in my years of practice is that arthritis disproportionately affects women more than men. This isn’t just a statistic; it’s a reality that many of my female patients live with every day. They often experience more severe symptoms, a higher degree of joint deterioration, and even a slower response to treatments.
    Why are women more affected with arthritis?

    Women are more commonly affected by arthritis than men, and several factors contribute to this disparity:

    a    Hormonal Differences: Estrogen, a female hormone, plays a significant role in the development and severity of arthritis. Post-menopausal women, who have lower estrogen levels, are particularly susceptible to developing arthritis.
    b    Genetic Factors: Certain genetic factors that predispose individuals to autoimmune diseases (like rheumatoid arthritis) are more common in women. This genetic predisposition can result in a higher incidence of arthritis among women.
      Biomechanical Variations: Women have wider hips and a different knee alignment than men, which can impact the way joints are used and potentially lead to increased wear and tear. This biomechanical difference can contribute to the development of osteoarthritis, particularly in the knees.
    d    Immune System Differences: Women’s immune systems function differently from men’s, partly due to hormonal influences. This difference can make women more susceptible to autoimmune conditions, including certain types of arthritis like rheumatoid arthritis.
      Increased Longevity: Statistically, women live longer than men. Since age is a significant risk factor for many types of arthritis, the longer life expectancy in women could contribute to a higher incidence of arthritis.
      Physical Activity Levels: Women may engage in different types and levels of physical activity compared to men, which can affect joint health and the risk of arthritis.
       Obesity: Women have higher rates of obesity compared to men, and obesity is a known risk factor for arthritis, particularly osteoarthritis.

    Lifestyle changes and medical treatments to deal with arthritis in women

    Lifestyle changes

    1.    Exercise regularly: Regular physical activity strengthens muscles around joints, improves flexibility, and can reduce pain. Activities like walking, swimming, or yoga are gentle on the joints.
    2.    Maintain a healthy weight: Excess weight puts additional stress on weight-bearing joints, like hips and knees. Losing weight can relieve this pressure and improve symptoms.
    3.    Balanced diet: A diet rich in fruits, vegetables, whole grains, and lean proteins can help reduce inflammation. Omega-3 fatty acids, found in fish and flaxseeds, are particularly beneficial.
    4.    Quit smoking: Smoking increases the risk of certain types of arthritis and can exacerbate symptoms. Quitting smoking can improve overall health and joint health.
    5.    Manage stress: Chronic stress can aggravate arthritis symptoms. Techniques like meditation, deep breathing, and mindfulness can help manage stress levels.
    6.    Adequate rest: Balancing activity with rest is important. Good sleep helps in the healing and repair of joint tissues.

    Medical Treatments

    1.    Medications:

    a    Pain relievers: Over-the-counter pain relievers like acetaminophen can alleviate pain.
    b    Nonsteroidal Anti-Inflammatory Drugs (NSAIDs): These reduce both pain and inflammation. Available over-the-counter or by prescription.
    c    Disease-Modifying Antirheumatic Drugs (DMARDs): Used for rheumatoid arthritis, DMARDs slow the progression of the disease.
    d    Biologic response modifiers: Typically used in conjunction with DMARDs, these target parts of the immune system that trigger inflammation and damage joints.

    2.    Physical therapy: A physical therapist can develop an exercise regimen to keep joints flexible and strengthen the muscles around the joints.
    3.    Joint assistive aids: Braces, shoe inserts, or other devices can help support the joints and reduce strain.
    4.    Surgery: In severe cases, joint repair, joint replacement, or joint fusion surgeries might be necessary.
    5.    Alternative therapies: Acupuncture, tai chi, and massage therapy might provide additional relief for some women.

    As we continue to grapple with the complexities of arthritis, particularly in women, our approach must be multifaceted. It requires collaboration between healthcare providers, researchers, patients, and society at large. My hope is that through increased awareness, targeted research, and personalised care, we can alleviate the burden of arthritis, especially for the women who disproportionately suffer from it.
