Dish files reply with FCC on proposed Time Warner Cable, Merger, says not in public interest

MUMBAI: Dish Network Corporation has filed a reply with the Federal Communications Commission (FCC) countering arguments made by Charter Communications, Inc. (Charter), Time Warner Cable, Inc. (TWC) and Bright House Net works (BHN) defending t he proposed merger between t he companies. In t he reply, DISH out lines how t he applicant s have f ailed t o prove t hat t his proposed merger is in t he public interest and reiterates its call for t he FCC t o deny the merger.

“If the proposed merger is approved, 90 percent of the nation’s high speed broadband homes would be cont rolled by two companies, and t he combined ‘New Charter’ would have every incentive t o sabot age OTT services like Sling TV that compete with the old school cable bundle,” said Jeffrey Blum, Dish senior vice president and deputy general counsel. “The proposed merger is harmful for consumers, competition and innovation, and should be denied.”

Following are key point s DISH makes in today’s filing. The complete filing can be found here.

Merger Will Not Serve the Public Interest:

New Charter will have an increased incentive and ability to Harm OVDs:  New Charter would have a particularly heightened incentive t o discriminate against competing OVD services, especially live streaming services like Sling TV – which is a total substitute for linear pay television.

New Charter is Likely t o Increase Broadband Prices, Further Prejudicing Rival OVDs:  New Charter will be able t o deploy another win- win strategy t o make it s broadband business more profitable, while still protecting its linear video business: raise t he price of broadband accesses it her directly or indirectly.

T he Merger Will Create a Dominant Duo poly wit h t he Incentive t o Engage in Anti-Competitive Parallel Conduct:  As Dish explained in it s Pet it ion t o Deny, t his transact ion will create a broadband duopoly, with Comcast and New Charter cont rolling about 90 percent of the high- speed broadband homes in t he country. Parallel action, with one of the two following the other, will be enough to foreclose an OVD from almost all high- speed homes in t he country.

T he Merger “Benefits” are Nothing More than Repackaged Plans and Conjecture: Charter also f ails t o provide any evidence t hat t he combination of Charter wit h TWC and BHN is necessary t o achieve many, if not all, of the benefit s it  t out s. From infrastructure through jobs and cost savings, Charter has offered lit t le more than recycled (non- merger- specific) business plans and conjecture.

CNN-IBN & IBN7 called the elections an hour before other channels

MUMBAI: CNN-IBN and IBN7 concluded that the Nitish Kumar and Lalu Prasad Yadav led Grand Alliance was set to form the government in Bihar, an hour before rest of the TV channels. CNN-IBN and IBN7 had called the elections and declared that Nitish Kumar was set to retain power on the 8 November at 10:03 am.

Both the channels were miles ahead of other channels in reporting the most accurate figures. By 9:30 am, while all channels were predicting a BJP win, CNN-IBN and IBN7 had already aired that the Grand Alliance was likely to win the elections. Network18’s extensive network of reporters who were present at every counting station all over Bihar tracked the trends and reported the same to the News Centre without any delay, thereby enabling the IBN Network to beat all other competing channels.

Commenting on this, IBN Network CEO Avinash Kaul asserted, “At Network18 we always strive to give our viewers information that they can absolutely rely on. This is yet another example of how we as a news network have the right mix of reporters, anchors and experts, who have the acumen to understand the pulse of politics, analyze the ground reality and bring forth the most accurate news, faster than anyone else.”

Former Union Minister P Chidambaram commented, “I must congratulate CNN-IBN for getting the results first and they got it just around 10am.”

The former CM of Bihar Rabri Devi also congratulated the channels for declaring that they have won, an hour before the others.

  • Film artists and intellectuals march to Rashtrapati Bhavan, decry charges of India becoming intolerant

Film artists and intellectuals march to Rashtrapati Bhavan, decry charges of India becoming intolerant

New Delhi, 7 November: A large number of filmmakes, intellectuals and artists led by vetran actor Anupam Kher – who had earlier questioned the logic of returning awards – today marched in Rajpath to Rashtrapati Bhavan to counter the protests by those who have been alleging “rising intolerance”.

Kher said the “award-wapsi” campaign was to defame the country by projecting a “wrong” picture of the situation.

A small delegation which also included Madhur Bhandarkar and some others presented a memorandum in this regard at Rashtrapati Bhavan. Prime Minister Narendra Modi is also meeting a small delegation this evening from amongst those who came for the march.

“India is a very tolerant country. Some people have coined the term ‘growing intolerance’. They are very few. Not every Indian thinks like that. We are secular people. We do not believe in pseudo-secularism, selective outrage or selective patriotism,” Kher, whose wife Kirron is a Bharatiya Janata Party member of Parliament.

“We had a meeting with a lot of writers, artistes, filmmakers and they also believe that there is no intolerance in the country… This march is a symbolic gesture on part of a lot of people over here who say India is one and free of intolerance,” the 60-year-old said.

Many filmmakers and artistes from the fraternity including Madhur Bhandarkar, Ashoke Pandit, Priyadarshan, Manoj Joshi, Abhijeet Bhattacharya, actor-director Bijoya Jena and writer Madhu Kishwar joined the march to hand over a memorandum signed by more than 40 personalities including actress Raveena Tandon.

Bhandarkar, a National Award winner, alleged that those involved in the protest over intolerance had opposed Prime Minister Narendra Modi before he was elected, which raised questions about their intention.

Kher asserted that they were not associated with any organisation or political party. “This march is led by Indians and for Indians.”

Film-maker Priyadarshan said the act of returning the awards is “childish”. He said these people should use the power of pen. Instances of intolerance have always been there. It is not something that happened yesterday.

Shah Rukh Khan never said he is returning his award, Priyadarshan said, but he said he disapproved of those critical of Khan who had said that there was extreme intolerance in the country.

The march also saw some disgruntled voices. Some National Award winning filmmakers and actresses who did not want to be named told indiantelevision.com that tjey felt let down because it was initially meant to be a march of ntellectual National Award Winners and not an Anupam Kher march.

At least 75 members of the intelligentsia have returned national or literary awards in an escalation of protests by writers, historians, filmmakers and scientists over “growing intolerance”, voicing fears that the country’s robust democracy might be “coming apart” in the current atmosphere.

The BJP-led government has dismissed the protest as “manufactured rebellion” and “politically” motivated.

“Nobody has the right to call our country intolerant. We are secular people and don’t believe in selective outrage,” Mr Kher said this morning. “I have right to go to the President and say that we don’t feel India is intolerant. These talks can’t happen only on twitter/ Facebook, they need a personal presence,” the actor has said.

The march follows the decision of a host of filmmakers, including Dibakar Banerjee and Anand Patwardhan, as well as writers and historians to raise voice against the rising intolerance under the BJP-led government and to return various government awards and honors.
