    Ajay Devgn Films appeal against verdict on YRF ties with single screen theatres

    NEW DELHI: Ajay Devgn Films has approached the appellate tribunal against the dismissal of their case where it claimed that the act by Yash Raj Films of releasing ‘Ek tha tiger‘ in single screens during Eid on condition that ‘Jab Tak hai Jaan‘ would be released during Diwali was anti-competitive.

    The Competition Commission of India had yesterday said, “There is no contravention of the Competition Act with regard to the agreement between Yash Raj Films and single screen exhibitors with regard to the film ‘Ek Tha Tiger‘ starring Salman Khan.”

    In a statement today, Ajay Devgn Films which is seeking to release ‘Son of Sardar‘ during Diwali said, “We are shocked by the rejection of our legitimate case by the CCI. We have approached the Appellate Tribunal against the order.”

    The Commission had said the agreements entered into in July/August were not anti-competitive.

    The allegation by Ajay Devgn was that at the time of the release of ‘Ek Tha Tiger‘ on 15 August, Yash Raj Films and its distributors had taken an undertaking that they would also release the film ‘Jab Tak Hai Jaan‘ by the same producer during Diwali. Ajay Devgn alleged that it was laid down that any single screen theatre who did not agree to booking of his theatre for both the films would not get the right to exhibit the single film.

    But the Commission was informed that ‘some did not agree to this and did not enter into the agreement‘.

    The Commission said, “The act of booking theatres by a distributor for its two films simultaneously when the theatre owners have the liberty either to agree or not to agree, is not a restraint on the freedom of business of theatre owners. The theatre owners can wait for other films and can refuse to book their theatres simultaneously for two films. Even otherwise the non significant position held by the single screen theatres does not cause any adverse effect on the competition. Furthermore under the Act, tie-in arrangements per se are not violative of section 3(4)(a) of the Act.”

    MUMBAI: Tips Industries has announced that its next comic caper Jayantabhai Ki Luv Story, starring Vivek Oberoi and Neha Sharma will release in the Valentine week on 15 February.

    Confirming the same, producer Kumar Taurani said, “We are happy to announce our next venture Jayantabhai Ki Luv Story, which will be a valentine week release. The shoots have been on schedule and we are very excited with the way things are shaping up. We can‘t wait for the film to hit theatres.”

    Talking about the film debut director Vinnil Markan said, “Jayantabhai Ki Luv Story is a film about how we fall in love unknowingly with people we least expect to. It‘s a true Indian rom-com that‘s light hearted, sensitive and entertaining with touch of bhaigiri, for which Vivek is famous.”

    He added, “We finished our first location. Kotachiwadi was a beautiful setting and lent itself so perfectly to the scenes. Both Vivek Oberoi and Neha Sharma were extremely supportive of the grueling schedule.”

    The light-hearted comedy follows a gangster‘s love story.

    DAR MentorCap gets Sebi approval for Rs 1 bn film fund

    MUMBAI: The DAR MentorCap jointly promoted by DAR Media Private Limited, a leading Mumbai-based film production and distribution company, and MentorCap Management Private Limited, an investment advisory firm, has received Securities and Exchange Board of India (Sebi) approval for its film fund under the new AIF guidelines.

    With an initial corpus of Rs 1 billion, the DAR MentorCap Film Fund has tenure of five years with a liquidation option for investors after three years. Apart from high-levels of corporate governance, transparency and credibility the fund is also seeking significant alpha generation targeted IRR in excess of 20 per cent.

    The Film Fund is being marketed as an exclusive product amongst an identified set of High Net worth Individuals (HNIs) and Institutional Investors.

    DAR MentorCap Founder & Partner Shailesh Haribhakti said, “The steady upswing in the Hindi film industry has now prepared it for systems, processes and good governance. The simultaneous establishment of the AIF regulations have created the space for this unique film fund that will execute over 20 projects in the next 2-3 years.

    “The most distinguishing aspect of the fund is that it already has a wide selection of projects to invest in through our partner DAR Media‘s extensive network and experience. From that perspective investors in the fund will see their money working from the word go.     MUMBAI: Bhushan Patel, who recently stirred 1920 – Evil Returns has been selected to direct Ragini MMS 2, the sequel of Ekta Kapoor‘s Ragini MMS that released in 2011.

    Confirming the same, Balaji Motion Pictures CEO Tanuj Garg says, “What started off as a humble experimental film has turned into a huge franchise. We took a leap of faith in signing Bhushan even before his first release. Given the film‘s impressive film‘s box office performance, it was the right decision in hindsight.”

    Patel said, “To add to the excitement of delivering a hit, is the opportunity of directing another hit franchise for the Balaji banner. I am looking forward to Ragini MMS-2.”

    Balaji Motion Pictures head of acquisition and distribution Girish Johar said, “We have signed Bhushan Patel to direct our Ragini MMS 2 with Sunny Leone. We loved the promos of 1920- Evil Returns. For a debut director, Bhushan has done a great job in the film. We are confident that he will do justice to Ragini MMS 2.”

    Ragini MMS 2 is expected to be a supernatural and horror film too.

    The original movie, directed by Pawan Kripalani, featured Kainaz Motivala and Raj Kumar Yadav. In the sequel, Indo-Canadian porn star Sunny Leone will add spice.

    Anil Kapoor buys out indoor film studio; to shoot Indian version of 24 first

    MUMBAI: Anil Kapoor has invested in buying one of the biggest indoor film studios in the city situated in Andheri East. The company has, however, not disclosed the name of the studio.

    It is understood that the first project that will go on floors in this studio will be the actor‘s adaptation of the American series 24, in which he himself made a guest appearance.

    Abhinay Deo, who is known for helming Delhi Belly, will be directing the show. “Kapoor wants the Indian version of 24 to be on the same scale as the original,” says an insider.

    It is said that Kapoor has been going all out to make his Indian adaptation of 24 as grand as possible. A few days ago, he hired writer-director Rensil D‘Silva along with writers Bhawani Iyer and Priya Pinto to work on the screenplay. Kapoor even flew down one of the original writers of 24, Patrick Harbinson to brainstorm with Rensil and the team.

    In the original 24, Kapoor plays a cameo as the head of an imaginary Muslim nation. But in the Hindi series, he will play the lead role, which in the original is played by English-born Canadian actor Kiefer Sutherland.

    NEW DELHI: A fatwa has been issued by a Jaipur Mufti against the film Le Gaya Saddam‘s maker Amjad Khan and his film which deals with the system of divorce in Islam, following protests.

    The film‘s debutante director Khan, however, said his film had only tried to highlight the social problem of divorce and had not hurt any sentiments. The fatwa was issued by Abdul Sattar Razvi, Mufti of Ghatgate, Jaipur on Saturday night after a complaint received by a few locals that the film allegedly defamed Islam.

    According to the complainants, there was some “objectionable” content in the film against Islam that insulted the religion. Apparently, the objection is to the fact that the groom is the grandfather of the hero.

    But the director says, “I think there has been some misunderstanding. Those who have issued the fatwa have not seen the movie properly. I have kept the Shariat Laws in mind while making the film. The issue is the scene where it is shown that to remarry the same girl, the boy gets her married off to her grandfather. I have not shown anything against the religion of Islam and its laws.”

    When contacted, the Mufti said the Fatwa was issued as per the law of Islam. “Objection to a film/content which insults Islam is absolutely justified in the light of Islamic law. I have not seen the movie but, as they mentioned in their letter, certain things are absolutely objectionable,” he said.

    The Kolkata-based director, who also claimed that he is receiving threatening calls over phone, contested the assertions in the protest.

    “I have never hurt anybody‘s sentiment through the film. I have made this film to tell how women are affected by the alleged easy access of divorce in the (Muslim) community,” Khan said. “I will ask police to give me protection as I know they will harm me. I have already received threat calls,” he added.

    NEW DELHI: Ajay Devgn Films has received a setback with the Competition Commission of India (CCI) ruling that Yash Raj Films‘ (YRF) agreements with single screen exhibitors was not in contravention of the Competition Act.

    The CCI said the agreements entered into in July/August by YRF with single screen theatres were not anti-competitive.

    In its petition, Ajay Devgn Films had pointed out that during the release of Salman Khan-starrer ‘Ek Tha Tiger‘ on 15 August, YRF and its distributors had taken an undertaking from single screen theatres that they would also exhibit the film ‘Jab Tak Hai Jaan‘ by the same producer during Diwali.

    Ajay Devgn Films alleged that it was laid down that any single screen theatre which did not agree to exhibiting ‘Jab Tak hai Jaan‘ would not get to screen ‘Ek Tha Tiger‘.

    CCI was also informed that some single screen theatres did not agree to the YRF‘s condition.

    The Commission said, “The act of booking theatres by a distributor for its two films simultaneously when the theatre owners have the liberty either to agree or not to agree, is not a restraint on the freedom of business of theatre owners. The theatre owners can wait for other films and can refuse to book their theatres simultaneously for two films. Even otherwise, the non significant position held by the single screen theatres does not cause any adverse effect on the competition.”

    Furthermore under the Act, tie-in arrangements per se are not violating of section 3(4)(a) of the Act.

    “If many high ticket mega starrer films compete with each other to be released only on the occasion of festivals, the choice lies with the theatres and each theatre is at liberty to book its theatre even in advance and it cannot be said that this had appreciable adverse effect on the market. The subject of appreciability is of huge practical importance for competition,” it added.

    The Commission said according to its information, even single screen theatres in some of the states are further sub-divided in category A, category B and category C and the distributors discriminate between these categories and do not allow release of new films in category B or category C theatres and only choose category A theatres.

    ‘Thus the market of exhibition of new films on single screen theatres in the context of this case is not of enough significance to cause an appreciable adverse effect on the competition. Even otherwise, the market cannot be restricted to any particular period like Eid or Diwali and the market has to be considered a market available throughout the year.‘

    Justice S N Dhingra and members H C Gupta, R Prasad, Geeta Gouri, Anurag Goel, and M L Tayal said Ajay Devgn Films did not place on record data either of market share or of economic strength to show how the opposite parties were dominant in the proposed relevant market on the basis of above stated guiding factors.

    It was argued by the counsel for the informant that the opposite parties were dominant because Yash Raj Films was a big banner production house and had a big name and had given several blockbuster films.

    But the Commission said, “No enterprise can be considered dominant on the basis of big name. Dominance has to be determined as per law on the basis of market share, economic strength and other relevant factors stated under Section19 (4) of the Act.”

    The Commission said it was unable to accept ‘such a narrow approach‘ while determining the relevant market. A large number of movies are released in India every year. In Bollywood itself, 107 and 95 films were released in 2011 and 2012 (till now) respectively. Out of this, Yash Raj Films produced only two to four films each year. ‘This cannot be said to amount to dominance even in the Bollywood industry, leave aside film industry in India.‘ Therefore, the claim of Ajay Devgn Films that Yash Raj was a dominant player in the film industry in India cannot be accepted, it said.

    Ajay Devgn Films had alleged that the YRF agreements were in violation of section 3 as well as section 4 of the Competition Act. It submitted that ‘Ek Tha Tiger‘ was released at the time of Eid and ‘Jab Tak Hai Jaan‘ is to be released at the time of Diwali.

    ‘This grievance of the informant arose because the informant feared that he would not get enough theatres for his own film ‘Son of Sardar‘ because of the agreement of single screen theatres with the opposite parties at the time of releasing Ek Tha Tiger. Ajay Devgn Films contended that the agreement between the opposite parties and the film exhibitors for exhibition of the two films together amounted to contravention of section 3(4)(a), 3(4)(b) and 3(4)(d) as well as contravention of section 4(2)(a).

    MUMBAI: Veteran filmmaker Saeed Mirza and former secretary of the Information and Broadcasting ministry Raghu Menon have been appointed as new members of the Central Board of Film Certification (CBFC).

    With these appointments, the Censor Board now has 20 members along with Leela Samson who heads it as its chairperson.

    Mirza is known for memorable films like Albert Pinto Ko Gussa Kyon Ata Hai, Mohan Joshi Hazir Ho! and Salim Langde Pe Mat Ro, apart from helming the popular TV serial Nukkad.

    Menon, an IAS officer of 1974 batch, was Information and Broadcasting Secretary from July 2009 and retired in 2011. He is also a member of the Film and Television Institute of India (FTII) board.

    A notification of the new appointments has already been issued by the I & B ministry and some more appointments are expected to be made in the coming days. In the current make up, the Censor Board can at the most have 25 members along with a chairperson.

    Life of Pi to premier in India at IFFI 2012

    New Delhi: The Central and Goa Governments have allocated a budget of Rs 90 million for the 43rd International Film Festival of India which will be inaugurated by versatile actor Akshay Kumar.

    The festival being held from 20 to 30 November will have the Indian premiere of Academy Award Winning Director Ang Lee‘s much awaited film ‘Life of Pi‘. The film‘s worldwide theatrical release is slated for November 23.

    Eminent Polish film maker Krzysztof Zanussi, will be conferred the Life Time Achievement Award at the Festival, which this year will have a special Centenary Award which will be decided by an independent jury.

    The inauguration will feature a medley choreographed by Maestro Saroj Khan and songs sung by Kailash Kher. Kher said he will be performing only on the Hindi film songs, keeping in view the celebration of 100 years of cinema.

    Information and Broadcasting Minister Manish Tewari has said the Centre will work towards making the forthcoming International Film Festival of India (IFFI) Goa a self sustainable event.

    Speaking over the weekend in Panaji, he said the Ministry will work towards this goal after the conclusion of IFFI 2012. The premier Festival is currently being financed by the Union and Goa government.

    “I agree with the spirit (that festival should be self sustainable). There is road to travel. Once we are through with this festival, we will see how possibly can make this happen,” the Minister said.

    Since the time IFFI moved to Goa as a permanent venue in 2004, efforts have been made to ensure that it is made self sustainable.

    The Taiwanese born American Director Ang Lee and the cast and crew of the film that includes Tabu, Irrfan Khan and the main lead and debutante Suraj Sharma will be present.

    The ‘Life of Pi‘ which is based on an adapted screenplay of a novel by the same name by Yann Martel, is a 3D adventure film telling the story of a 16 year old Piscine Molitor Patel (Pi) of Pondicherry (Puducheri), who survives a shipwreck along with animals like an orangutan, a zebra, a hyena and a Royal Bengal Tiger. The film explores the issues of spirituality, religion and life as a whole.

    Ang Lee is the man behind some of the most prestigious and acclaimed films such as Sense and Sensibility (1995), Crouching Tiger, Hidden Dragon (2000), Hulk (2003) and Brokeback Mountain (2005). His latest film, Life of Pi, besides providing a global platform for Indian artistes, also explores some of the scenic spots in India, including the countryside of Munnar and the French elegance of Pondicherry. During his interaction with the media, Ang Lee admitted that experiments like his are helping change the stereotype perceptions about Indians and the Asians in mainstream Hollywood.

    1920 Evil Returns trumps Chicken Khurana

    MUMBAI: 1920 – Evil Returns, a sequel, collected the highest in a week that saw seven releases, netting Rs 125 million in its opening weekend as it drew strong audiences from second rung multiplexes and single screen cinemas. The collections today are steady.

    Luv Shuv Tey Chicken Khurana, a Punjabi romantic comedy, has not been appreciated even in North where it was expected to do well. The film has collected Rs 47 million in its first weekend.

    The other four releases of the week, Ata Pata Laapat, Le Gaya Saddam, Future Toh Bright Hai Ji, Jaane Bhi Do Yaaro (revised restored version) and Sons Of Ram, which is co-owned by Amar Chitra Katha (ACK) Media and Cartoon Network.

    Sons of Ram is ACK Media‘s first feature film titled ‘Sons of Ram – Heroes will Rise‘.

    Chakravyuh, a dry subject on the Naxals vs System, lacked totally in entertainment quotient and found few takers. The film had a poor run at the box office with collections of Rs 160 million to show for its first nine days.

    Student of the Year benefitted due to the weeklong Dussehra holidays in Delhi- NCR and Dussehra holiday in general to collect a reasonable Rs 142 million in its second week, thus taking its two-week tally to Rs 602 million.

    English Vinglish added Rs 19 million in its fourth week taking its four week total to Rs 358 million.

    OMG Oh My God! braved the dull period and an onslaught of new releases to hold steady in its fifth week by collecting Rs 195 million, taking its total to Rs 756.5 million (excluding figures from Eastern circuits).

    Barfi! has come to the end of its fruitful run at the box office. The UTV Motion Pictures release collected Rs 3.5 million in its seventh week, taking its tally swell to Rs 1.08 billion.
