    Indian copyright law is one of the strongest in the world: USTR report

    NEW DELHI: Despite vehement and exhaustive submissions arraying the strength of the Indian IP regime, India continues to be on the watch list in the United States Trade Representative (USTR) 2014 Special 301 Report.

     

    Others in the list are China, Russia, Algeria, Argentina, Chile, Indonesia, Pakistan, Thailand and Venezuela.

     

    The report, however, commends India for its achievements like digitisation and upgradation of IP offices and active copyright enforcement by the Delhi High Court through injunctive relief, to name a few. In the report, the US has also recognised the role of bilateral engagements between US and India to resolve concerns relating to Intellectual Property.

     

    “FICCI in its response to Hearing Testimony of India before USTR had strongly asserted that India has a well-established legislative, administrative and judicial framework to safeguard IPRs which meets its obligations under TRIPS, and has withheld the test of severe international scrutiny. We are glad to note that India has not been given the Priority Country status as this could have had serious ramification on economic, political and trade sanctions”, according to FICCI secretary general Dr A Didar Singh.

     

    “Indian IP law is TRIPS Compliant and more. Indian copyright law is one of the strongest and best in the world. India protected computer programmes by copyright much earlier than the US. The Indian Copyright Act 2012 law is in full conformity with international treaties of WIPO. The legislative and statutory measures are supplemented by appropriate administrative measures by the Governments both at the Centre and in the States for enforcement of IPRs; this includes Inter-Ministerial Committee on Enforcement of IPR laws, Copyright Enforcement Advisory Council (CEAC), Enforcement Cells, Intellectual Property Appellate Board (IPAB) and Automated Recording and Targeting System (ARTS) portal of Central Board of Excise and Customs (CBEC).”

     

     The national IP strategy gives utmost importance to IPR Portfolios. Recent upgradation of the Intellectual Property Offices in accordance with the international standards has been one of the significant steps taken by the Indian government to make it more service oriented and user friendly.

     

    With effect from 15 October 2013, Intellectual Property Office (IPO) has also started functioning as International Search Authority (ISA) and International Preliminary Examining Authority under PCT.

    MUMBAI:  In its bid to reach out to a large number of voters to exercise their valuable franchise, a ‘Voter Education Channel’ was launched by the election commission of India (ECI). The channel which can be viewed on YouTube, has video clips of many Indian icons urging citizens to cast their important vote.

     

    The first clip features a recorded speech by the chief election commissioner VS Sampath asking voters to ‘turn up at polling stations and exercise their right to vote in an informed and ethical manner’. This speech, uploaded yesterday has so far recorded 2028 hits. The other video links have sportspersons like boxer MC Mary Kom, cricketer MS Dhoni and badminton sensation Saina Nehwal, who are seen urging voters to exercise their vote. Channel viewers can also watch videos of ECI brand ambassadors like Aaamir Khan and former president of India Mr. A.P.J Abdul Kalam asking voters to do the same.

     

    The newly launched YouTube link also has a number of other messages recorded by various state election offices asking and motivating voters to cast their vote during this elections. The channel also provides details about the procedures deployed to use the electronic voting machines (EVMs) and their functioning while others mention about the none of the above (NOTA) option procedure. The link to this YouTube channel can also be found on the official website, www.eci.nic.in- under the section ‘Voter Education Channel’. A senior official from the ECI has said that many such video links will be posted soon on the YouTube channel.

    She was earlier the CEO of Firstpost.com, the news and opinion portal from the group. Lakshmi Narasimhan, the previous CEO for the group’s digital content business, is now moving onto a corporate role.

    MUMBAI: Launched in June last year, Star India’s digital sports offering – starsports.com – has since created a lot of traction among sports enthusiasts in the country. And the same can be said for Ten Sports’ website – tensports.com – that was re-launched not too long ago on 27 March and has since witnessed a spike in viewership.

    “A lot of research, thought and hard work has gone into the re-launch of tensports.com; we are aware of the opportunities in the digital space and want to really cash in on it,” reveals Ten Sports CEO Rajesh Sethi. “We are very focussed on getting the best coverage and updates to sports fans through tensports.com and going forward, we will only get deeper into the space.”

    To its credit, the revisited site is a definite improvement over its predecessor with various well-placed sections that are easy to navigate. Apart from separate tabs for sports like cricket, football, tennis, golf and WWE, a section has been demarcated for blogs, videos and the TV guide.

    “Not many know this fact, but the TV guide is something which receives the most visits during the day. It serves as the destination for all sports fans to keep track of various events or matches that are scheduled for the day,” says Sethi.

    It was after more than five months of beta testing that the overhauled site went live on 27 March. As of now, content generated is both in-house and from blogs but going forward; the plan is to have more in-house content.

    “The digital, content and marketing teams all got together to really push for the re-launch and I am really pleased with the results,” says Sethi. “We also want to create a lot of social traction and thus, have aligned our social media on the portal as well, and are confident that we will only grow from strength to strength.”

    Since going live, tensports.com has witnessed an increase in viewership. To delve into numbers, the portal gets about 1.6 million visitors per month, of which, 0.7 million are unique visitors. Breaking this down further, 0.42 million come from mobile and 0.28 million come from desktops. The new site has been designed to be very responsive and can easily adapt to various screens including desktops, mobiles, tablets etc.

    “This move has encouraged consumption on multiple screens and it reflects in our viewership as well. After the re-launch, the bounce rate on mobiles has reduced by 11 per cent and that of desktops by 27 per cent,” says Sethi, adding, “Social media is a very important tool for us, and we will leverage the platform to drive our fans to the website.” For the record, tensports.com has over 2.5 million likes on Facebook and 73,100 followers on Twitter.

    Plans are afoot to hold Google Hangout sessions with sports fans to keep up the engagement levels. Significantly, the Ten Sports’ sports calendar is a healthy mix of various sports, with big-ticket events like the Hockey World Cup, Asian Games and Commonwealth Games; it could be slated to be streamed live on the website along with being telecast on the channel.

    “We are yet to try out live beaming of an event, but I am confident of our ability to bring high quality video content to the fans with such important events coming up,” says Sethi. Asked about the business model, he does not reveal much except that the site plans on adopting a mix of ad and subscription revenues.

    With competition among sports broadcasters hotting up, viewers can only expect bigger and better sports entertainment lined up for them.

    MUMBAI: The video streaming site from Star India – starsports.com – has garnered unprecedented traction on the digital domain.

     

    The ICC World T20 final between India and Sri Lanka on starsports.com attracted a record 19.3 lakh unique individuals watching the video on the destination, delivering an unprecedented 37.6 lakh visits.

     

    While public figures are not available, the previous record for a single game is believed to have been achieved on IPL last year, with around 14.8 lakh visitors watching the video on 23 April 2013, when Chris Gayle scored 175 for Royal Challengers Bangalore. The final also beat the views registered for the retirement test match of Sachin Tendulkar, 10.3 lakh visitors, which marked the previous high point for starsports.com.

     

    Speaking on the occasion, Star India EVP and head new media Ajit Mohan said: “This is a proof that the fans are ready to embrace a completely new destination conceptualised around video. We are emerging as the best way to follow cricket. The success of ICC World T20 really positions us well for Pepsi IPL 2014, which is debuting on starsports.com this year, and where we have the opportunity to really deliver a whole new experience for IPL fans. Our aspiration is to break the 20 lakh mark for a single game.”

     

    Overall, starsports.com attracted more than 80.9 lakh users during the fortnight long tournament delivering more than 2.24 crore visits. The consumer engagement on starsports.com is continuing to grow dramatically. A total of 101 million live minutes of video were consumed by users during the last four matches played by India in the tournament, with an average of more than 30 minutes per live view. 

     

    Starsports.com offered live matches of ICC World Twenty20 as an ad-free subscription service on its advanced sports video player. In addition, the portal also offered a free, five-minute delayed service.

     

    Powered by live and video rights, the site covers the best of world sports including major cricket tournaments, BPL, La Liga and Serie A in football, F1, hockey, tennis and badminton.

    Website, reference handbook launched on general elections 2014

    NEW DELHI: ‘General Elections 2014: Reference Handbook’ , a compendium on past elections and the latest provisions relating to the general elections, was released on 3 April to  disseminate information about the mammoth exercise to elect the sixteenth Lok Sabha. 
     

    The Press Information Bureau has made the book made available in English, Hindi and 11 regional languages, namely, Assamese, Bengali, Gujarati, Kannada, Malayalam, Marathi, Oriya, Punjabi, Tamil, Telugu and Urdu. 

     

    The Bureau has also launched a web-portal, dedicated for the general elections 2014:  pib.nic.in/elections2014This will be used for dissemination of important instructions, orders and press notes of the ECI. The Reference Handbook also will be made available on this portal. On Counting-Day, i.e. 16 May, this portal shall also be used to disseminate official trends and results, based on real-time data made available by the Election Commission of India. These trends and results will also be shared on social media, and through SMS. 
     

    A number of factsheets, backgrounders and features have already been issued on various aspects of the general elections. The backgrounders cover detailed and in-depth analysis of various aspects of past elections, with special focus on the fifteenth Lok Sabha elections (2009 general elections). State-wise fact-sheets impart information on various states pertaining to electorate, Parliamentary Constituencies, past elections etc. 

    Many of the features have been contributed by senior officers of the Election Commission of India. The features range from the topics like ‘Evolution of Election System in India’, ‘Electoral Laws in India’, ‘Salient Features of Representation of the People Act 1952’, ‘SVEEP- Tool for Voters Awareness’. New developments like NOTA and VVPAT also figure in the topic-list and Guidelines for media, Paid News, Opinion Polls & Exit Polls have also been covered under features. 

    Once the results have been declared, this office will analyse the data of the sixteenth general elections in detail, and a compiled version thereof will be released.

    NEW DELHI: In a judgment that may serve as a precursor to similar action around the globe, the Court of Justice of the European Union (CJEU) has said that the Internet Service Providers (ISPs) in Europe can legally block piracy sites that illegally distribute copyright-protected material.

                          

    The Motion Picture Association’s European branch welcomed the decision as a “proportionate and valid measure” in fighting copyright infringement and “an important milestone in the creative industries’ ongoing efforts to curb online piracy.”

     

    The verdict sets a clear legal framework across the European Union territories and confirms national court rulings in several territories. The ruling also sends a strong signal to ISPs that website blocking is an effective measure to reduce overall infringement, the MPA said, and that ISP is typically the best-place to tackle copyright infringement.

     

    The European court ruled on a case filed on 15 June 2012 before the Austrian Supreme Court. Distributors Constantin Film and Wega took action against Austrian ISP UPC Telekabel Wien for not blocking access to kino.to, the largest piracy site in German-speaking Europe with a top 40 ranking on Alexa.com and up to four million visitors per day. The case went all the way to Europe’s Supreme Court, with the CJEU asking to clarify the legality of site blocking, which Internet freedom advocates have compared to censorship.

     

    MPA EMEA president and MD Chris Marcich said the verdict means that rights holders “will continue to have the ability to secure balanced website blocking orders from national courts across the EU to address infringing sites.”

     

    Marcich said: “I am particularly encouraged by the strong stance the CJEU has taken in relation to the responsibility of intermediaries to address copyright infringement. A sustainable internet that benefits all must operate fairly, with proportionate and balanced rules. We must all play a constructive role in this aim, including search engines who continue to lead consumers to illegal money-making sites.”

     

    He cited the hard work the movie industry across Europe is carrying out to “develop new, innovative and consumer-friendly platforms delivering the shows and movies that audiences want to see — whilst ensuring that the creators and makers get compensated for their hard work.”

     

    According to MPA figures, citizens in Europe have access to over 3,000 legal on-demand video services.
